{"id":52284,"date":"2014-12-09T19:37:20","date_gmt":"2014-12-09T19:37:20","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2014\/12\/09\/senate-panels-work-presages-coming-fight-over-scope-of-aumf\/"},"modified":"2026-08-07T23:44:55","modified_gmt":"2026-08-07T23:44:55","slug":"senate-panels-work-presages-coming-fight-over-scope-of-aumf","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2014\/12\/09\/senate-panels-work-presages-coming-fight-over-scope-of-aumf\/","title":{"rendered":"Senate Panel\u2019s Work Presages Coming Fight Over Scope of AUMF"},"content":{"rendered":"\n<p><span class=\"character dateline\">WASHINGTON \u2013 <\/span> A fight is brewing in the US Senate over how much \u2014 or how little \u2014 authority lawmakers should hand the president in <a href=\"http:\/\/www.defensenews.com\/apps\/pbcs.dll\/article?AID=2014312050033\">fighting the Islamic State<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Senate Foreign Relations Committee on Tuesday will begin a sprint toward crafting and voting on a measure that would legally authorize ongoing US operations against the violent Sunni group. Secretary of State John Kerry will appear before the panel, which will mark up and vote on the measure Thursday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The authorization for the use of military force (AUMF) on which the panel will vote later this week is being penned by Chairman Sen. Robert Menendez, D-N.J. He has yet to release its text, but provided an outline of his thinking about such a measure late last month.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Let&#8217;s not, however, make the 9\/11 mistake of rushing into an AUMF, an authorization for the use of military force, that has become the overriding authorization for the last 13 years, has been used for indefinite duration and has been used from South Asia to the Persian Gulf to Africa and Southeast Asia,&#8221; Menendez said just weeks ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;The fact is we need to ensure that whatever authorization for the use of military force we consider is comprehensive and appropriate in scope and duration to meet the threat and sustain the fight,&#8221; he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the committee&#8217;s top Republican, Sen. Bob Corker of Tennessee. told reporters Tuesday he is concerned the Menendez measure would handcuff the president.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;It is interesting that the way I read the AUMF, what the people who are proposing this particular version say they want is really an ISIS protection plan, isn&#8217;t it?&#8221; he asked rhetorically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Because you can use all force against al-Qaida and others, but against ISIS you cannot. It&#8217;s kind of an interesting approach,&#8221; said Corker, insinuating Menendez is preparing a version that would limit the scope of military force the US could use against the group.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some panel members, like Sen. Tim Kaine, a Virginia Democrat who has introduced one of a handful of authorizations pending in both chambers, have been pushing for a measure that would be tailored specifically for the Islamic State threat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But those members have not directly called for limiting the kinds of tactics the executive branch could employ.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Corker&#8217;s comments are key because he will take the Foreign Relations gavel in January when the new Congress is seated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So it will be Corker, not Menendez, who would be charged with passing out of committee any final AUMF the Senate might vote on next year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Democratic and Republican senators say there is virtually no chance the version the committee will take up Thursday will hit the Senate floor before the chamber adjourns later this week for the final time this
