{"id":53078,"date":"2018-10-04T14:16:59","date_gmt":"2018-10-04T14:16:59","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2018\/10\/04\/pentagon-breakdown-led-to-industry-payments-rule-being-published-shanahan-says\/"},"modified":"2026-08-07T23:49:28","modified_gmt":"2026-08-07T23:49:28","slug":"pentagon-breakdown-led-to-industry-payments-rule-being-published-shanahan-says","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/pentagon\/2018\/10\/04\/pentagon-breakdown-led-to-industry-payments-rule-being-published-shanahan-says\/","title":{"rendered":"Pentagon breakdown led to industry payments rule being published, Shanahan says"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 On Monday, Deputy Secretary of Defense Patrick Shanahan <a href=\"https:\/\/www.defensenews.com\/pentagon\/2018\/10\/02\/facing-industry-pressure-pentagon-backs-off-contract-payment-changes\/\" target=\"_blank\">killed a proposed change<\/a> to the way the Pentagon handles industry cash flow, following <a href=\"https:\/\/www.defensenews.com\/industry\/2018\/09\/24\/defense-industry-fighting-dod-proposal-to-change-performance-payments\/\" target=\"_blank\">complaints from industry<\/a> and <a href=\"https:\/\/www.defensenews.com\/congress\/2018\/09\/25\/lead-lawmakers-urge-dod-to-halt-new-payment-rule\/\" target=\"_blank\">members of Congress<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What happened, and what comes next, remains unclear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking to reporters Wednesday, Shanahan, the number two at the Pentagon, said he had not seen the proposed rule until he got a letter from the Hill raising objections, and indicated there was some sort of process breakdown in the shop of Ellen Lord, the undersecretary of defense for acquisition and sustainment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI don\u2019t know the details within Ellen\u2019s shop. I got a letter from folks in Congress that said \u2018please look into this,\u2019 I sat down with Ellen and she shared with me that they hadn\u2019t fully coordinated the input and I said &#8216;well fine, we\u2019ll just pull it back, we\u2019ll fully coordinate it and we\u2019ll move along,\u2019\u201d Shanahan said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m not down managing the details of all those rules and regulation. Ellen does. They had an escape,\u201d Shanahan added. \u201cWe encourage employees to go as fast as possible and make as many changes as feasible. Ellen Lord has an idea.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">While not naming the members who raised concerns to him, Shanahan was likely referencing the Sept. 21 letter sent by Rep. Mac Thornberry, R-Texas, and Sen. Jim Inhofe, R-Okla., the chairs of the House and Senate Armed Services Committees, which called the proposal \u201cfundamentally flawed&#8221; and asked that it be rescinded and revisited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That came after three major industry groups \u2014 The National Defense Industrial Association, the Professional Services Council and the Aerospace Industries Association \u2014 objected to the proposed change, which would have slashed payments on work to be performed from 80 percent to 50 percent, with incremental increases for maintaining quality or on-time delivery, or decreases for companies that have committed fraud.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the process broke down in Shanahan\u2019s eyes is not clear, as the language seemed to follow the traditional path for proposed rules, including being posted to the federal register on Aug. 24, and being made open for a public comment period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In fact, the final public hearing on the issue was scheduled for Oct. 10. However, the Pentagon on Wednesday announced that hearing would be cancelled. The statement read as follows: \u201cThis proposed rule is withdrawn in order for DoD to conduct additional outreach with industry regarding contract financing methods. Implementation in the Defense Federal Acquisition Regulation Supplement (DFARS) of section 831 of the National Defense Authorization Act for Fiscal Year 2017 will be addressed in a proposed rule to be published under DFARS Case 2019-D002.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And that raises the question of what happens next. That statement would seem to indicate the department intends to make some changes and then try again with the broad idea of performance incentives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis really gets at, how do we update and modernize how we&#8217;re doing progress payments and performance payments,\u201d Shanahan said when asked about next steps. \u201cWe&#8217;re going to make changes and we&#8217;ll approve those.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, David Berteau, a former Pentagon official who is now the president and CEO of the Professional Services Council, says the department needs to do more than just tweak a few things and try again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf DoD simply updates and recoordinates the previous language, I don\u2019t think that is likely to address the serious policy concerns raised by the associations or the Congress,\u201d he said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Pentagon killed a proposed change in how industry gets its cash.
