{"id":55917,"date":"2021-04-16T18:29:09","date_gmt":"2021-04-16T18:29:09","guid":{"rendered":"https:\/\/one.sightlinemg.com\/defensenews\/uncategorized\/2021\/04\/16\/us-senators-propose-roadblock-for-f-35-sale-to-uae\/"},"modified":"2026-08-08T00:07:11","modified_gmt":"2026-08-08T00:07:11","slug":"us-senators-propose-roadblock-for-f-35-sale-to-uae","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/defensenews\/congress\/2021\/04\/16\/us-senators-propose-roadblock-for-f-35-sale-to-uae\/","title":{"rendered":"US senators propose roadblock for F-35 sale to UAE"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2015 A duo of Democratic senators offered a bill Friday that could block the U.S. sale of F-35 fighter jets to the United Arab Emirates after the Biden administration<a href=\"https:\/\/www.defensenews.com\/global\/mideast-africa\/2021\/04\/14\/biden-admin-moving-ahead-with-uae-f-35-drone-sales-for-now\/\" target=_blank> acknowledged<\/a> it is advancing the Trump-era deal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Senate Foreign Relations Committee Chairman Bob Menendez, D-N.J., and Sen. Dianne Feinstein, D-Calif., would require the administration make a raft of assurances and commitments to Congress that the F-35\u2032s sensitive technology and Israel\u2019s security are fully protected. The bill targets a <a href=\"https:\/\/www.defensenews.com\/global\/mideast-africa\/2021\/01\/20\/just-hours-before-bidens-inauguration-the-uae-and-us-come-to-a-deal-on-f-35-sales\/\" target=_blank>pending deal<\/a> that includes 50 Lockheed Martin-made F-35s worth $10.4 billion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI remain concerned with the implications of a sale of our most advanced fighter jet given numerous outstanding, unanswered questions about the implications of this sale for U.S. national security, our technology interests, and implications for regional stability including the legal parameters of Israel\u2019s Qualitative Military Edge,\u201d Menendez said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Menendez, who led opposition to President Donald Trump\u2019s efforts to <a href=\"https:\/\/www.defensenews.com\/global\/mideast-africa\/2021\/01\/20\/just-hours-before-bidens-inauguration-the-uae-and-us-come-to-a-deal-on-f-35-sales\/\" target=_blank>fast-track the deal in his final days<\/a> in office, offered similar legislation at the time with Feinstein. A monthslong <a href=\"https:\/\/www.defensenews.com\/congress\/2020\/12\/09\/amid-veto-threat-senate-rejects-ban-on-trumps-big-uae-arms-sale\/\" target=_blank>fight<\/a> centered on concerns that weapons supplied to the UAE would be used in the Libyan and Yemeni civil wars, and about the Emirati government\u2019s relationships with Russia and China.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c[I]f the Administration has decided to proceed with this Trump-era deal, then we must enact protections to ensure the incredibly sensitive technology of these aircraft is not compromised by powers hostile to the United States, including making sure the UAE pulls-back from its burgeoning relationship with China and other U.S. competitors,\u201d Menendez said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The deal followed the signing of the Abraham Accords between Israel, Bahrain and the UAE, under which the Arab states agreed to normalize relations with Israel. The Trump White House expressed confidence the \u201cUAE is capable of protecting the technologies involved and of using them in a responsible manner.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In January, the Biden administration announced <a href=\"https:\/\/www.defensenews.com\/global\/2021\/01\/27\/biden-admin-hits-pause-on-trump-foreign-weapon-sales-launches-review\/\" target=_blank>a review of all recent arms sales cleared by the Trump administration<\/a>. This week, a State Department spokesman said it would \u201c<a href=\"https:\/\/www.defensenews.com\/global\/mideast-africa\/2021\/04\/14\/biden-admin-moving-ahead-with-uae-f-35-drone-sales-for-now\/\" target=_blank>move forward<\/a>\u201d with a broader UAE deal worth $23 billion, \u201ceven as we continue reviewing details and consulting with Emirati officials to ensure we have developed mutual understandings with respect to Emirati obligations before, during, and after delivery.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The administration\u2019s decision not to cancel the sale doesn\u2019t mean it\u2019s guaranteed to happen. The administration retains the ability to stop any weapons sale prior to delivery, which for the F-35s may be 2025 or 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Menendez-Feinstein bill would require the president, before an F-35 is delivered to any Middle Eastern country other than Israel, ensures the sale won\u2019t harm Israel\u2019s military edge, that tech security measures are emplaced, and that the recipient hasn\u2019t provided weapons to adversaries of Israel or the U.S.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For 10 years after the F-35 is delivered, the president would have to certify annually that the U.S. is continuing the security measures, the recipient hasn\u2019t engaged in operations against Israel or U.S. interests, and the country hasn\u2019t committed or enabled human rights violations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The human rights requirement might present a significant obstacle for the UAE, which has been criticized for enforcing a <a href=\"https:\/\/debbiedingell.house.gov\/news\/documentsingle.aspx?DocumentID=2946\" target=_blank>blockade against Yemen<\/a>, contributing to famine there. In 2019, Human Rights Watch <a href=\"https:\/\/www.hrw.org\/world-report\/2019\/country-chapters\/united-arab-emirates#\" target=_blank>alleged<\/a> on a number of abuses by the UAE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Arms control <a href=\"https:\/\/www.defensenews.com\/congress\/2021\/01\/12\/lawsuit-threatens-23b-weapons-sale-to-uae\/\" target=_blank>advocates<\/a> have condemned the Biden administration\u2019s decision to resume the UAE sale. They\u2019ve also <a href=\"https:\/\/winwithoutwar.org\/policy\/80-orgs-and-experts-to-biden-to-fulfill-promise-of-ending-u-s-support-in-yemen-cancel-36-5b-in-military-support\/\" target=_blank>demanded<\/a> $36.5 billion in sales to Saudi Arabia and the UAE be scrapped.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s positive that senior Senate leaders are concerned about transfer of F-35s to the United Arab Emirates and signaling that strong provisions are needed for any future sales to the region,\u201d Arms Control Association Senior Fellow Jeff Abramson said in a statement. \u201cBetter yet would be to simply recognize that Emirati past and current behavior should disqualify them from these F-35s as well as billions of dollars of drones and munitions that the Trump administration proposed.
