Tom Udall, D-N.M., who asked \u201cIf U.S. forces are told to leave, will we depart Iraq or will be stay uninvited as our forces are doing in Syria, and under what legal authority will they remain?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Responded Tillerson: \u201cWe will remain in Iraq until ISIS is defeated and we are confident that ISIS has been defeated.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/defensenews\/pentagon\/2017\/10\/30\/after-16-years-congressional-debate-on-military-force-authorizations-remains-stalled\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/3499007.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">After 16 years, congressional debate on military force authorizations remains stalled<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Defense Secretary Jim Mattis testified before senators Monday that a new force authorization in the war on terror would be welcome, but isn&#039;t needed.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">When Udall pushed again on what legal authority that would occur, Tillerson responded by citing the 2001 and 2002 AUMFs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the secretary stressed that \u201cwe are there also at the invitation of the Iraqi government and that [Iraqi Prime Minister Haider al-Abadi] has given to me no indication he is in any particular hurry to have us depart.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mieke Eoyang, vice president of the national security program at the Third Way think tank, called the idea of staying in Iraq against the desire of Baghdad \u201cinsanity.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAt that point, the U.S. would be considered an invading force by the Iraqis and would become a target not only of ISIS, but the Iraqi Security Forces,\u201d said Eoyang, a longtime Democratic staff member on the Hill.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThat\u2019s from a practical perspective. From a legal perspective, they\u2019re on even shakier ground. ISIS didn\u2019t exist when they passed the 2001 AUMF and the 2002 AUMF was to enforce U.N. Security Council resolutions. They don\u2019t have that here. Tillerson needs to go talk to Mattis and his lawyer before he commits to that position.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kori Schake, a fellow with the Hoover Institution who worked at both the National Security Council and the Defense Department during the George W. Bush administration, said it is \u201cunfortunate Secretary of State Tillerson gave the impression we would remain in Iraq without Iraqi approval.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But, Schake thinks Tillerson may have inadvertently stumbled into that stance. Tillerson\u2019s response came as part of a broader question from Udall about the role of Iran-backed militias in Iraq. Last week during a visit to Iraq, Tillerson called for Iran-backed militias to either turn down arms or leave the country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI honestly think he was trying to clean up his previous awkward suggestion Iraqi Shi\u2019ia militia \u2018go home\u2019 to Iran, and bungled into another round of making news that will require cleaning up,\u201d Schake said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Asked for clarification on Tillerson\u2019s remarks, a State Department spokesman said the department doesn\u2019t deal in hypotheticals and deferred to the secretary\u2019s comments. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pentagon spokeswoman Dana White said she would \u201cassociate us\u201d with Tillerson\u2018s comments, adding \u201cI won\u2019t answer hypotheticals. We are in Iraq to defeat ISIS and as [Tillerson] said we are there by invitation.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A senior Iraqi diplomat, informed of Tillerson\u2019s comments, told Defense News that \u201cthe U.S. forces are at the official request of the Iraqi government; the effectiveness of their support and the coalition allies\u2019 to the Iraqi Security forces is gratefully acknowledged. The Iraqi government is committed to maintaining the course of cooperation with our allies until the ultimate defeat of ISIS, in such a way that ensures that there is no sequel to this terrorist
