The question of the day is, Will the stolen personal information make certain employees susceptible to blackmail?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><b>Related: <\/b><a href=\"http:\/\/www.federaltimes.com\/story\/government\/cybersecurity\/2015\/06\/11\/opm-hack-undetected-year\/71085960\/\" title=\"http:\/\/www.federaltimes.com\/story\/government\/cybersecurity\/2015\/06\/11\/opm-hack-undetected-year\/71085960\/\">OPM hack went undetected for a year<\/a><\/p>\n\n\n\n<p><span>If an employee already holds a security clearance or works in a sensitive position, his or her ability to protect classified information should not be doubted, barring any conduct that could turn him or her into a security risk. As the <a href=\"http:\/\/www.state.gov\/m\/ds\/clearances\/60321.htm\">Adjudicative Guidelines for Determining Access to Classified Information<\/a> states, &#8220;<\/span><span style=\"color: #252525;\">No coercive policing could replace the self-discipline and integrity of the person entrusted with the nation&#8217;s secrets as the most effective means of protecting them.&#8221;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is also important to remember that trustworthiness is not a quality required only of employees with access to classified or sensitive information. In fact, an agency can remove an employee when it loses faith in him or her, so long as it can show a nexus between the adverse action and the efficiency of the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While trust for the sake of the efficiency of the service and trust for the sake of national security are two very different beasts, they are both based on the same basic principles. So here are some key points that agency managers and supervisors should keep in mind whenever questions about an employee&#8217;s trustfulness arise.<\/p>\n\n\n\n<p><span>In <i><a href=\"http:\/\/www.mspb.gov\/netsearch\/viewdocs.aspx?docnumber=1087072&amp;version=1091429&amp;application=ACROBAT\">Beauford v. U.S. Postal Service<\/a><\/i><\/span><span style=\"color: #252525;\">(2014)<\/span><span>, the Merit Systems Protection Board adopted <\/span><em><span style=\"color: #252525;\">Webster&#8217;s Collegiate Dictionary<\/span><\/em><span style=\"color: #252525;\"><i>&#8216;s <\/i>definition of &#8220;trustworthiness&#8221;<i> as <\/i><\/span><span style=\"color: #252525;\">&#8220;worthy of confidence.&#8221; All it takes to establish the nexus between a removal action and the efficiency of the service is a deciding official&#8217;s &#8220;declaration that he lost confidence and trust in an employee.&#8221;<br\/><\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Agencies must ask not only if they can trust an employee, but if the public can as well. &#8220;The public will not, and should not be expected to, place trust and confidence in a government employee found guilty of a criminal misdemeanor, especially where the criminal activity relates to the role of the governmental agency,&#8221; the board said in <i><a href=\"http:\/\/www.mspb.gov\/netsearch\/viewdocs.aspx?docnumber=250148&amp;version=250420&amp;application=ACROBAT\">Richardson v. Resolution Trust Corporation<\/a><\/i> (1995).<\/p>\n\n\n\n<p><span style=\"color: #252525;\">A supervisor&#8217;s loss of confidence in an employee does not have to result in the employee being put on administrative leave. &#8220;Even in cases of serious employee misconduct, the agency may feel that the   <g class=\"gr_ gr_50 gr-alert gr_gramm Punctuation only-del replaceWithoutSep\" data-gr-id=\"50\" id=\"50\">    employee,   <\/g> if appropriately monitored, poses no imminent threat and does not need to be placed on administrative leave. We would   <g class=\"gr_ gr_49 gr-alert gr_gramm Grammar multiReplace\" data-gr-id=\"49\" id=\"49\">    be loathe   <\/g> to remove an agency&#8217;s ability to bestow this discretionary kindness on employees facing removal,&#8221; the U.S. Court of Appeals for the Federal Circuit said in <\/span>Carr v. Department of Justice (2000)<\/p>\n\n\n\n<p><span style=\"color: #252525;\">If the agency keeps an employee in his or her position after learning he or she engaged in certain misconduct, it may have difficulty removing him because the continuation in a &#8220;position with unlimited access to the installation   <g class=\"gr_ gr_43 gr-alert gr_gramm Grammar multiReplace\" data-gr-id=\"43\" id=\"43\">    evidences   <\/g> continued reposing of trust in him,&#8221; the MSPB found in <i><a href=\"http:\/\/www.mspb.gov\/decisions\/searchdec.htm\">Stead v. Department of the Army<\/a><\/i><\/span>(1985).<\/p>\n\n\n\n<p>An agency does not have to retain an employee it does not trust if the employee&#8217;s &#8220;<span style=\"color: #252525;\">future work and would be subjected to the added burden of oversight not required for the other employees,&#8221; the MSPB found in <i><a href=\"http:\/\/www.mspb.gov\/netsearch\/viewdocs.aspx?docnumber=255419&amp;version=255707&amp;application=ACROBAT\">Rhodes v. Department of the Treasury<\/a><\/i><\/span>(1982).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>If an employee already holds a security clearance or works in a sensitive position, his or her
