But as federal agencies look to have the most disruptive impact possible on cyber crime, FBI officials are thinking carefully about how best to time an indictment, or whether an indictment is even the best action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019re just much more mature in the space of working with our interagency partners, and really keeping an eye down the road in terms of how we have the biggest impact,\u201d Vorndran said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FBI, he said, is now \u201cvery open to being told\u201d that when it comes to an adversary, \u2018You know what, as a team member, it may not be the right time to deploy an indictment, but it very much may be the right time to deploy\u201d an action from U.S. Cyber Command.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The evolution reflects that multiple government agencies share responsibility for, and have unique roles in, countering a cyber threat that has only deepened over the last decade. The Justice Department has long regarded indictments of foreign hackers as a way to \u201cname-and-shame\u201d them and deter the hostile governments that employ them. Other government agencies, though, are bringing their own powers to the table that may trump the use of criminal charges or impose greater costs or deterrence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cyber Command, an arm of the Defense Department established in 2010, has grown aggressive in its pursuit of hackers,&nbsp;<a href=\"https:\/\/apnews.com\/article\/technology-europe-national-security-c4c8dace4708035d059be0fcd10e9e18\">conducting more than two dozen operations&nbsp;<\/a>intended to thwart interference in the 2020 presidential election and more recently against ransomware gangs. The White House has shared information about Russian hackers with the Kremlin for it to take action. Last week, Russia\u2019s Federal Security Service, or FSB,&nbsp;<a href=\"https:\/\/apnews.com\/article\/technology-europe-ukraine-hacking-106e5948eb4e313c7eba53d714cb7533\">announced the detention<\/a>&nbsp;of members of the REvil ransomware gang.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FBI itself has used actions other than indictments. In June, it recovered most of a&nbsp;<a href=\"https:\/\/apnews.com\/article\/technology-business-government-and-politics-8e7f5b297012333480d5e9153f40bd52\">roughly $4.4 million ransom<\/a>&nbsp;that Colonial Pipeline paid to hackers that carried out a ransomware attack. It secured a&nbsp;<a href=\"https:\/\/apnews.com\/article\/hacking-business-technology-government-and-politics-263a097228e99798ce283dcd5062b517\">court warrant in April<\/a>&nbsp;that gave it remote access to hundreds of computers to counter a massive hack of Microsoft Exchange email server software.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vorndran spoke to the AP after participating last week in a Silverado Policy Accelerator discussion in which he said the FBI was moving away from \u201can indictment and arrest first model, and to the totality of imposing costs on our adversaries.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThat probably is a simple way of saying we\u2019re really trying to work with everybody, public and private sector partners, to understand the totality of the capabilities and the authorities that exist &#8230; so that we have the biggest impact at the moment in matters,\u201d he said in the interview.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indictments, a bread-and-butter tactic of law enforcement, can lock accused hackers inside their home countries and put adversaries on notice that their actions have been detected. But their practical impact is often limited since there\u2019s generally minimal chance of a defendant being brought to the U.S. for trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perhaps the first prominent example was a 2014 case against five Chinese military hackers accused of siphoning secrets from major American corporations. In the years since, federal prosecutors have charged&nbsp;<a href=\"https:\/\/apnews.com\/article\/us-charges-north-korea-global-hacks-3c8145431462830e8f80e1576f731577\">North Korean computer programmers<\/a>&nbsp;in hacks of Sony Pictures Entertainment;&nbsp;<a href=\"https:\/\/apnews.com\/article\/technology-russia-business-ap-top-news-ca-state-wire-c78cb2fdff194169951dd768bb1d3dfd\">Russian intelligence agents<\/a>&nbsp;in a breach of Yahoo;&nbsp;<a href=\"https:\/\/apnews.com\/article\/1db343da098540c1a31b13be032df263\">Iranian hackers<\/a>&nbsp;in an attack on a small dam outside New York City;&nbsp;<a href=\"https:\/\/apnews.com\/article\/technology-7aa7a893d0dc15da21a5920ab7d9f221\">and Chinese operatives<\/a>&nbsp;with targeting firms developing vaccines for the coronavirus.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The cases have all generated publicity splashes, though they\u2019ve hardly curbed hacking from foreign countries. And given the absence of extradition treaties with countries the U.S. regards as the biggest cyber offenders, arrests of indicted hackers are exceedingly rare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There have, however, been isolated exceptions when hackers wanted by the U.S. have traveled from their home countries and been arrested. That happened last fall when the Justice Department unsealed an indictment charging Yaroslav Vasinskyi in the Kaseya ransomware attack after the suspected Ukrainian hacker traveled to Poland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The arrest produced a&nbsp;<a href=\"https:\/\/apnews.com\/article\/technology-crime-arrests-hacking-cybercrime-ab4fe21487943f21bdae6dc769ece60a\">Justice Department press conference<\/a>&nbsp;with Attorney General Merrick Garland, a sure sign that prosecutors won\u2019t abandon their pursuit of indictments when they think it makes sense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThat\u2019s certainly a tool that the interagency and the FBI are prepared to use and are working towards,\u201d Vorndran said of indictments, \u201cbut it\u2019s not the only
