{"id":10719,"date":"2019-09-25T16:50:37","date_gmt":"2019-09-25T16:50:37","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2019\/09\/25\/court-denies-rehearing-request-on-anti-union-executive-orders\/"},"modified":"2026-08-08T04:32:11","modified_gmt":"2026-08-08T04:32:11","slug":"court-denies-rehearing-request-on-anti-union-executive-orders","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2019\/09\/25\/court-denies-rehearing-request-on-anti-union-executive-orders\/","title":{"rendered":"Court denies rehearing request on anti-union executive orders"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Federal employee unions were dealt a blow Sept. 25 in their attempts to overturn provisions of <a href=\"https:\/\/www.federaltimes.com\/management\/2018\/05\/25\/trump-targets-feds-in-latest-series-of-executive-orders\/\" target=_blank>three executive orders<\/a> that would curtail the operating ability of union representatives and make it easier to fire federal employees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The full panel of judges at the U.S. Court of Appeals for the District of Colombia denied the unions\u2019 joint request for a rehearing of their lawsuit that claimed President Donald Trump\u2019s three May 2018 executive orders violated legal statute and the intention of Congress.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2019\/09\/06\/union-takes-on-trump-executive-orders-through-an-agency-lawsuit\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/635695463470389701-photo-gaveljpeg.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Union takes on Trump executive orders through an agency lawsuit<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The lawsuit targets the orders based on one agency&#039;s interpretation and the Federal Service Impasses Panel&#039;s subsequent interpretation of their requirements.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The unions\u2019 lawsuit met with<a href=\"https:\/\/www.federaltimes.com\/management\/2018\/08\/26\/judge-rules-trump-overstepped-with-union-executive-orders\/\" target=\"_blank\"> early success in the courts<\/a>, after a D.C Circuit Court judge ruled that significant provisions of the orders went beyond executive authority. But the appeals court later determined that the district court <a href=\"https:\/\/www.federaltimes.com\/management\/2019\/07\/16\/appeals-court-reverses-ruling-on-trumps-union-executive-orders\/\" target=\"_blank\">did not have the jurisdiction<\/a> to rule on the case, and the unions should have gone through the Federal Labor Relations Authority for an opinion on federal agency enactment of the orders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe court\u2019s decision not to grant an en banc rehearing of this vitally important case with far-reaching effects across the federal government is a sad day for the country. While we review our options, hundreds of thousands of federal government workers will suffer as their access to union representation at the worksite is stripped away by the implementation of President Trump\u2019s union-busting executive orders,&#8221; said American Federation of Government Employees National President J. David Cox Sr. in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now that the application for a rehearing has been denied, the <a href=\"https:\/\/www.federaltimes.com\/management\/2019\/08\/14\/block-on-trumps-union-targeting-orders-to-remain-for-now\/\" target=\"_blank\">injunction preventing significant sections of those executive orders<\/a> from being enacted will lift in one week, enabling the Trump administration to proceed with its planned workforce changes. The unions, meanwhile, have 90 days to decide whether they will pursue the case with the Supreme Court.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2019\/09\/24\/feds-demand-an-end-to-trumps-anti-union-policies\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Union-Protest-5.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Feds demand an end to Trump\u2019s anti-union policies<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Federal employees and members of Congress gathered outside the U.S. Capitol building Sept. 24 to protest the Trump administration&#039;s workforce policies.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Should that case fail, or the unions choose not to pursue it, opposition to the orders will have to proceed through the FLRA, which could prove challenging, as the authority lacks a general counsel and its chairman has been <a href=\"https:\/\/www.federaltimes.com\/management\/2019\/06\/05\/was-flras-union-removal-biased-or-legally-necessary\/\" target=_blank>accused of anti-union bias<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are, of course, disappointed that the full court of appeals declined the request to rehear our case against the president\u2019s 2018 executive orders affecting the civil service. We are consulting with other unions who are involved in the case to decide next steps. Unfortunately, this decision sets the table for years of chaos in the federal sector as we have to take our issues, piecemeal, through the Federal Labor Relations Authority,&#8221; National Treasury Employee Union National President Tony Reardon said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;It is important to remember that the appellate court did not rule on the merits of our case against the executive orders, only jurisdiction. We still believe that these orders violate existing federal law and we will not relent on that argument, either at the FLRA or subsequently back in the courts. In the meantime, we are alarmed that the court-ordered injunction against many provisions of those orders may soon be lifted, subjecting federal employees to even more harmful actions by this administration.
