{"id":12928,"date":"2020-05-07T22:19:39","date_gmt":"2020-05-07T22:19:39","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2020\/05\/07\/amazon-challenges-the-pentagons-revised-jedi-solicitation-directly-to-the-department\/"},"modified":"2026-08-08T04:35:55","modified_gmt":"2026-08-08T04:35:55","slug":"amazon-challenges-the-pentagons-revised-jedi-solicitation-directly-to-the-department","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/it-networks\/cloud\/2020\/05\/07\/amazon-challenges-the-pentagons-revised-jedi-solicitation-directly-to-the-department\/","title":{"rendered":"Amazon challenges the Pentagon\u2019s revised JEDI solicitation directly to the department"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Amazon Web Services filed a bid protest directly to the Department of Defense challenging \u201cambiguous aspects\u201d of the Pentagon\u2019s revised solicitation for its embattled enterprise cloud contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">AWS\u2019 challenge is in response to a <a href=\"https:\/\/www.federaltimes.com\/federal-oversight\/congress\/2020\/04\/17\/court-decides-pentagon-can-reevaluate-specific-aspects-of-jedi-procurement\/\" target=_blank>revised solicitation from DoD<\/a> regarding a specific technical requirement of the Joint Enterprise Defense Infrastructure cloud contract that AWS had challenged. Back in mid-April, a Court of Federal Claims judge granted the department\u2019s motion allowing DoD to \u201c<a href=\"https:\/\/www.federaltimes.com\/it-networks\/cloud\/2020\/03\/13\/the-pentagon-was-to-reconsider-its-jedi-award\/\" target=_blank>reconsider certain aspects<\/a>\u201d of the JEDI award.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAWS is committed to ensuring it receives a fair and objective review on an award decision that the court found to be flawed,&#8221; an AWS spokesperson said. &#8220;AWS repeatedly sought clarity from the DoD around ambiguous aspects of the amended solicitation and the DoD refused to answer our questions. We simply want to ensure a common understanding of the DoD\u2019s requirements and eliminate ambiguity that could impact a fair evaluation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The JEDI cloud, potentially worth $10 billion over 10 years, was <a href=\"https:\/\/www.federaltimes.com\/home\/2019\/10\/26\/amazon-or-microsoft-dod-picks-a-winner-for-its-controversial-jedi-contract\/\" target=_blank>awarded to Microsoft<\/a> in October last year. Amazon protested the award in the Court of Federal Claims in December and won a <a href=\"https:\/\/www.federaltimes.com\/it-networks\/cloud\/2020\/02\/13\/pentagon-and-microsoft-must-halt-work-on-jedi-cloud-for-now\/\" target=_blank>temporary restraining order<\/a> in March preventing the DoD and Microsoft from building out the cloud infrastructure after the court decided that AWS was <a href=\"https:\/\/www.federaltimes.com\/it-networks\/cloud\/2020\/03\/08\/why-a-federal-court-halted-work-on-the-pentagons-enterprise-cloud\/\" target=_blank>likely to show<\/a> that DoD erred in its technical evaluation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">AWS also<a href=\"https:\/\/www.federaltimes.com\/home\/2020\/03\/24\/amazon-opposes-pentagons-proposal-to-reevaluate-parts-of-its-jedi-award\/\" target=_blank> opposed<\/a> the DoD\u2019s motion to reconsider specific aspects of the JEDI award because the DoD\u2019s request didn\u2019t account for all six technical errors Amazon alleged were made during the contract\u2019s evaluation process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Even if taken at face value, DoD\u2019s proposed corrective action fails to address in any meaningful way how it would resolve the technical issues AWS has raised, or which specific technical challenges it intends to address,\u201d Amazon lawyers wrote in a March 24 court filing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In response to Amazon\u2019s protest, the content of which is not publicly available, Microsoft spokesperson Frank Shaw wrote in a blog post that the filing by AWS was \u201cdisappointing but not surprising.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe only thing that\u2019s certain about Amazon\u2019s new complaint is that it will force American war fighters to wait even longer for the 21st-century technology they need \u2013 perpetuating Amazon\u2019s record of putting its own interests ahead of theirs,\u201d Shaw wrote May 7.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A spokesperson for AWS called Shaw\u2019s post \u201cnot surprising,&#8221; and touted AWS\u2019 cloud computing capabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019re eager to see the full array of mistakes considered and assessed,\u201d the spokesperson said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lt. Col. Robert Carver, Department of Defense spokesman, said in a statement that the department is trying to get the JEDI capability to war fighters quickly. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDoD continues to execute the procedures outlined in the Motion for Voluntary Remand granted last month with the intent of delivering this critically-needed capability to our warfighters as quickly as possible,\u201d Carver said. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>This story has been updated with a comment from the Department of Defense.
