{"id":13131,"date":"2021-04-29T22:19:15","date_gmt":"2021-04-29T22:19:15","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2021\/04\/29\/us-will-pay-44-million-in-age-bias-case-by-ex-faa-workers\/"},"modified":"2026-08-08T04:35:20","modified_gmt":"2026-08-08T04:35:20","slug":"us-will-pay-44-million-in-age-bias-case-by-ex-faa-workers","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2021\/04\/29\/us-will-pay-44-million-in-age-bias-case-by-ex-faa-workers\/","title":{"rendered":"US will pay $44 million in age-bias case by ex-FAA workers"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The U.S. government will pay nearly $44 million to settle an age-discrimination case filed 16 years ago on behalf of hundreds of workers who missed out on federal pensions after their jobs were outsourced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawyers for the 761 workers say <a href=\"https:\/\/www.federaltimes.com\/management\/2017\/05\/18\/7-faa-employee-groups-warn-against-privatizing-air-traffic-control\/\" target=_blank>the Federal Aviation Administration<\/a> and the Transportation Department decided to outsource the jobs because many of the employees were older than 40 and were, or soon would, become eligible to retire with full federal retirement benefits.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2017\/05\/18\/7-faa-employee-groups-warn-against-privatizing-air-traffic-control\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/635888036418015967-fed-air-traffic-controller-1jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">7 FAA employee groups warn against privatizing air traffic control<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Seven employee organizations representing Federal Aviation Administration members have sent a joint letter to the House Transportation and Infrastructure Committee sating that they oppose privatizing the air traffic control system based on the negative impact it would have on the deficit, the military and public safety.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">They worked as flight service specialists \u2014 air traffic controllers who give pilots of private planes information about weather, routes and emergency help. In 2005, the FAA gave Lockheed Martin a contract to run the specialists\u2019 flight service stations in every state except Alaska. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By an act of Congress, about 100 specialists who were within two years of retirement were allowed to stay at FAA and keep their pensions, but 1,900 others, most of them over the age of 40, moved to Lockheed. Some of them sued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a $43.8 million settlement announced Wednesday, 25 individuals will get enough service credit to qualify for an air traffic controller\u2019s retirement. The others will get enough to cover lost retirement benefits from 2016 through 2020, according to the agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe hope this will be a cautionary reminder to federal employers and other employers that, as we have an increasingly aged workforce, employers should be extra careful to avoid making personnel decisions like layoffs because of age,\u201d said Joseph Sellers, lead attorney for the workers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FAA declined to comment beyond the agreement, in which the FAA and Transportation Department did not acknowledge any wrongdoing. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FAA also pointed to a 2016 inspector general\u2019s report that found the agency mostly achieved the savings it forecast by outsourcing the work. Lockheed Martin consolidated offices and cut the number of specialists by more than half over 10 years, according to the report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kate Breen was 45 and president of the union when the flight service specialists\u2019 work was sent to Lockheed, where there were no pensions, just a 401(k) savings plan, and where their service time in the government didn\u2019t count. She said she quit Lockheed after a year and a half and took part-time jobs at the postal service and the Transportation Security Administration before landing a different job back at FAA. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Breen will retire for good this week, but figures she lost $20,000 a year in retirement benefits with all the moving around. Some former colleagues fared far worse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis settlement helps to ease some of the pain &#8230; (but) it\u2019s still not making everybody whole,\u201d she said. \u201cThey deserve much better than what they got.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">___<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The story has been corrected to note that
