{"id":14142,"date":"2019-10-10T20:03:00","date_gmt":"2019-10-10T20:03:00","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2019\/10\/10\/homeland-security-wants-authority-to-subpoena-internet-providers\/"},"modified":"2026-08-08T17:59:00","modified_gmt":"2026-08-08T17:59:00","slug":"homeland-security-wants-authority-to-subpoena-internet-providers","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/it-networks\/2019\/10\/10\/homeland-security-wants-authority-to-subpoena-internet-providers\/","title":{"rendered":"Homeland Security wants authority to subpoena internet providers"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The cybersecurity agency within the Department of Homeland Security is seeking subpoena power to protect critical infrastructure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking at the FireEye Defense Summit Oct. 10, Chris Krebs, director of the Cybersecurity and Infrastructure Security Agency, said that his agency wants the ability to compel internet service providers to give his agency the contact information of customers who operate critical infrastructure that CISA identifies as having known vulnerabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Krebs said that CISA wants to be able to notify users running critical infrastructure systems, like industrial control systems, of vulnerabilities in their system that the agency identifies through its scanning systems. Right now, CISA can identify the user IP addresses but can\u2019t do anything about it because IP addresses don\u2019t pinpoint locations and users.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat we want to be able to do is if we can\u2019t resolve the issue through any other way, then we should be able to go to an ISP and say, \u2018We\u2019re concerned about this, can you provide us your customer contact information so we can go let them know that they have whatever [internet] port open or are running a vulnerable system,&#8217;\u201d Krebs said. &#8220;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under current law, ISPs cannot voluntarily turn over information to the government. But Krebs said there\u2019s an exception in the law that ISPs can turn information to if served with an administrative subpoena by an authorized federal agency. CISA wants to be one of those federal agencies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe need to be able to go to the ISP and say \u2018Look, we need some help getting to this person, can you help us?&#8217;\u201d said Krebs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the proposal raises privacy concerns among experts, according to <a href=\"https:\/\/techcrunch.com\/2019\/10\/09\/cisa-subpoena-powers-isp-vulnerable-systems\/\" target=_blank>TechCrunch<\/a>, which first reported the story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Krebs stressed to reporters that CISA is looking at a \u201clawful process.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis not about &#8230; the average user,\u201d Krebs said. &#8220;This is about hard critical infrastructure and known vulnerabilities and risks.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CISA is working with its oversight committees in the House and Senate on the legislation. According to the Congressional Research Service, administrative subpoenas allow for agencies to acquire documents \u201cin aid of the agencies\u2019 performance of their duties.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt will be a game-changer in terms of really taking a proactive, risk-resilience building steps,\u201d Krebs
