{"id":16522,"date":"2017-10-27T18:00:37","date_gmt":"2017-10-27T18:00:37","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2017\/10\/27\/microsoft-drops-government-gag-order-lawsuit-against-doj\/"},"modified":"2026-08-08T17:48:34","modified_gmt":"2026-08-08T17:48:34","slug":"microsoft-drops-government-gag-order-lawsuit-against-doj","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/federal-oversight\/2017\/10\/27\/microsoft-drops-government-gag-order-lawsuit-against-doj\/","title":{"rendered":"Microsoft drops government gag-order lawsuit against DOJ"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 Microsoft <a href=\"https:\/\/blogs.microsoft.com\/on-the-issues\/?p=55096\">announced <\/a>on Oct. 23 that it will drop a lawsuit against the Department of Justice involving government gag-order searches. This comes as a result of the DOJ recently reforming its gag-order policy, limiting the usage of secrecy orders and requiring the setting of end dates for them. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These gag-order searches, which are part of the 1986 Stored Communications Act (SCA), allow the government to access personal cloud data during search warrants without informing the provider or customer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Microsoft <a>had originally sued<\/a> the DOJ in April 2016 with the intent to declare the gag-order section of the SCA unconstitutional. Microsoft believed it was restricted from notifying its customers that a government search of their data had taken place. The company further argued that its customers\u2019 First and Fourth Amendment rights were being violated in the process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DOJ <a href=\"https:\/\/www.federaltimes.com\/home\/2017\/01\/23\/doj-fights-microsofts-bid-to-tell-users-when-feds-take-data\/\">subsequently requested<\/a> a dismissal of Microsoft\u2019s case, stating that the company did not have a legal right to argue for its customers\u2019 Fourth Amendment rights. However, U.S. District Judge James Robart sided with Microsoft in February 2017, allowing the case to go to a higher court <a href=\"https:\/\/www.documentcloud.org\/documents\/3457605-19717315842.html#document\/p45\/a337711\">under the grounds<\/a> that \u201cFirst Amendment rights may outweigh the government interest in secrecy.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The DOJ released a <a href=\"https:\/\/arstechnica.com\/tech-policy\/2017\/10\/doj-changes-gag-order-policy-microsoft-to-drop-lawsuit\/\">memo<\/a> Oct. 19th outlining its new gag-order policy, specifically that prosecutors \u201cconduct an individualized and meaningful assessment\u201d for the use of gag orders and to tailor said usage to \u201cinclude the available facts of the specific case and\/or concerns attendant to the particular type of investigation.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the dropped lawsuit, Microsoft Chief Legal Officer Brad Smith <a>further called<\/a> for the advancement of the Electronic Communications Privacy Act (ECPA) Modernization Act, specifically its provision to address secrecy orders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe [Microsoft] hope Congress will make this positive step forward more permanent by updating outdated laws\u201d writes Smith. \u201cTo better protect our digital rights while still enabling law enforcement to do its job.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet this is not Microsoft\u2019s only legal issue involving the SCA, as the company has a pending Supreme Court case involving the government\u2019s ability to force tech companies to hand over data stored outside the U.S. The Associated Press <a href=\"https:\/\/www.federaltimes.com\/federal-oversight\/doj-fbi\/2017\/10\/16\/justices-to-hear-governments-email-dispute-with-microsoft\/\">states<\/a> that \u201cthe case also highlights the difficulty that judges face in trying to square decades old laws with new technological developments.\u201d <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The decision comes as a result of the
