Patrick Leahy, D-Vt.; Chuck Grassley, R-Iowa; Dianne Feinstein, D-Calif.; and John Cornyn, R-Texas, expresses \u201csignificant concerns\u201d that the rule changes \u201cappear to run contrary to the letter and spirit of FOIA.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2019\/06\/27\/union-files-unfair-labor-charges-against-new-epa-contract\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-676529814-Cropped.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Union files unfair labor charges against new EPA contract<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The charge is the latest in a prolonged and contentious contract negotiation between the Environmental Protection Agency and the American Federation of Government Employees.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The policy makes four changes to EPA\u2019s FOIA process:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Political appointees at the agency have authority under the new rule to issue final determinations in whether to release or withhold documents requested under FOIA. While this is not expressly against FOIA, the senators worried that such an addition could increase delays in responses and could embolden political appointees to potentially delay or impact FOIA responses for political reasons.<\/li><li>The rule changes where FOIA requests must be received, limiting their filing to the Washington, D.C., location of the agency, rather than any field offices. Because there is no notification process for individuals that file a FOIA request at the incorrect location, the senators worried that the public may not actually know that their request was rejected for location purposes.<\/li><li>The rule authorizes agency officials to withhold a portion of information based on responsiveness to a FOIA request, meaning that the agency could redact documents provided under a FOIA request that does not directly relate to the reason for the request. But a D.C. Circuit decision from 2016 found that just such behavior violates the spirit of FOIA, and agencies cannot redact information provided in a FOIA document just because it does not specifically relate to a particular request.<\/li><li>Finally, the agency released the changes without a public comment period, citing the \u201cgood cause\u201d exception that allows agencies to forego public comment if the changes have insignificant impact or are inconsequential to the public. But the senators questioned how a rule that changed the request location and contents of FOIA submissions would not have a significant impact on the public.<\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cGiven the potentially serious issues identified above, we urge you to reconsider your implementation of \u2014 or provide sufficient opportunity for public comment on \u2014 the \u2018FOIA Regulations Update\u2019 final rule,\u201d the senators wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAt minimum, we urge you to at least provide additional
