{"id":20031,"date":"2016-05-13T17:02:49","date_gmt":"2016-05-13T17:02:49","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2016\/05\/13\/house-oversight-weighs-social-media-for-background-checks\/"},"modified":"2026-08-08T04:51:57","modified_gmt":"2026-08-08T04:51:57","slug":"house-oversight-weighs-social-media-for-background-checks","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/federal-oversight\/2016\/05\/13\/house-oversight-weighs-social-media-for-background-checks\/","title":{"rendered":"House Oversight weighs social media for background checks"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Those compromising\u00a0spring break photos on your social media accounts may not keep from getting a security clearance, but they will soon be under the purview of the National Background Investigations Bureau.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The House Oversight &#038; Government Reform Committee examined how the new background investigations unit would incorporate the social media accounts of those applying for a security clearance in a May 13 subcommittee hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Today, with more than a billion individuals on Facebook, what a person says and does on social media can often give a better insight on who they really are,&#8221; said Rep. Mark Meadows, R-N.C.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;This issue now facing the federal government is how to use social media information while respecting the legitimate privacy concerns that are often brought forth.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The NBIB, which the Obama administration said in January will replace Federal Investigation Service, will be run by the Office of Personnel Management\u2014with IT security handled by the Department of Defense.<\/p>\n\n\n\n\n\n<p class=\"wp-block-paragraph\">To address NBIB&#8217;s role in using social media as part of a background investigation, the Office of the Director National Intelligence has crafted a policy strictly for the use of social media networks in the investigations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Acting OPM director Beth Cobert said the official policy is still being finalized and was being coordinated with a request-for-information for a pilot program to automate social media searches.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cobert said that once the policy is complete, OPM and the Performance Accountability Council, which is heading up the NBIB transition, will test how to best apply social media information to the investigations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;The PAC will make recommendations for changes to Executive Branch-wide guidance and authorities and will also develop, implement, and continuously re-evaluate and revise outcome-based metrics that help measure the effectiveness of the vetting processes, including the use and benefits of social media,&#8221; she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So while the policy is not complete, what is known is:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Anonymous social media identities are not included, for now<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Rep. Ron DeSantis, R-Fla., in inquiring about the reach of the social media investigations, noted that Edward Snowden had previously commented about government surveillance in online forums with the same username. DeSantis asked if the investigations would include such social media aliases in addition to the Facebook and Twitter accounts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">William Evanina, director of the National Counterintelligence and Security Center, said the Snowden posts would not be detected under the current pilots because the alias wasn&#8217;t public-facing and that ODNI had not presently required alternative identities in the investigation disclosures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He went on to say that such disclosures on the Standard Form 86 for background investigations could be a privacy violation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;I think when you get past the public-facing interface of social media, you get to the border of privacy and civil liberties of social media in terms of what are your practices beyond what you would do in the course your daily lives.&#8221;<\/p>\n\n\n\n\n\n<p class=\"wp-block-paragraph\">Meadows took issue with that, seeing it as a potential loophole and asked the Evanina to look into the possibility of requiring the disclosure of other online personas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;I actually have Twitter accounts that don&#8217;t have my name associated with them,&#8221; he said. &#8220;And yet, I would tweet out things based on that. Is there any reason why we wouldn&#8217;t ask for those types of things?&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Evanina went on to say he would examine whether the policy could include online identities under the alias disclosures in SF-86.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Automation software will be key<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. Chief Information Officer Tony Scott said that automation software would play a large role in the NBIB efforts to search social media, especially since cost estimates for social media screenings run from $500-$800 per person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Clearly one of the things that will have to happen, and I think the pilots will inform this, is some greater level of automation,&#8221; he said. &#8220;As you can probably appreciate, when you do a search, you get a ton of data that has to be sifted through and adjudicated. Some degree of automation is ultimately going to have to help bring the costs down.&#8221;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>NBIB will only retain information related to the investigation<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Evanina said that the investigations will not hold onto information from the social media accounts that was not directly related to obtaining a security clearance, but that was seen with some skepticism by committee members.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;What do you do with the information you have on me after you have it,&#8221; said Rep. Mick Mulvaney, R-S.C. &#8220;Because while I consent to let you go and get it, I certainly don&#8217;t consent with you giving it to other people.&#8221;<\/p>\n\n\n\n\n\n<p class=\"wp-block-paragraph\">Evanina reiterated that only relevant information would be retained, but Mulvaney pressed the issue, especially in the wake of the OPM hack. Cobert said that the policy has distinct rules governing who has access to the information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;A core element in the cybersecurity design of our systems, particularly as we go forward, is how do we make sure we have the appropriate protections in place for all of that information,&#8221; she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NBIB is expect to be initially operational by October 2016, with further implementation to follow.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Your social media
