{"id":22279,"date":"2019-08-14T19:20:19","date_gmt":"2019-08-14T19:20:19","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2019\/08\/14\/block-on-trumps-union-targeting-orders-to-remain-for-now\/"},"modified":"2026-08-08T04:56:47","modified_gmt":"2026-08-08T04:56:47","slug":"block-on-trumps-union-targeting-orders-to-remain-for-now","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2019\/08\/14\/block-on-trumps-union-targeting-orders-to-remain-for-now\/","title":{"rendered":"Trump\u2019s union-targeting orders remain blocked, for now"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A court order preventing provisions of <a href=\"https:\/\/www.federaltimes.com\/management\/2018\/05\/25\/trump-targets-feds-in-latest-series-of-executive-orders\/\" target=_blank>three workforce executive orders<\/a> signed in May 2018 by President Donald Trump will remain in effect until additional court proceedings take place, a panel of judges ruled Aug. 14.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The three executive orders, which target collective bargaining and the ability to fire federal employees, were <a href=\"https:\/\/www.federaltimes.com\/management\/2018\/08\/26\/judge-rules-trump-overstepped-with-union-executive-orders\/\" target=_blank>ruled an overstep in presidential power<\/a> by a District Court judge in August 2018, establishing the initial injunction against significant parts of those orders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a July 2019 decision by a three-judge panel on the U.S. Court of Appeals determined that the District Court <a href=\"https:\/\/www.federaltimes.com\/management\/2019\/07\/16\/appeals-court-reverses-ruling-on-trumps-union-executive-orders\/\" target=\"_blank\">didn\u2019t have the authority to rule<\/a> on the case in the first place and that the unions should have taken their case to the Federal Labor Relations Authority.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2019\/05\/24\/the-anti-union-executive-order-fight-continues-one-year-later\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-676529814-Cropped.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">The anti-union executive order fight continues one year later<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Federal employee unions and the White House have clashed repeatedly over the last year over the line between collective bargaining rights and management overhaul.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Though this ruling was ultimately a victory for the new Trump administration orders, agencies were not immediately able to act on the orders, as the injunction remained in effect until a petition for a rehearing on the case is filed and decided.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Administration lawyers filed for a premature lifting of the injunction, but the Aug. 14 decision denied that application, keeping the injunction in effect for at least as long as the additional court proceedings take.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are pleased that the federal court\u2019s injunction of major provisions in the president\u2019s executive orders trampling the rights of federal employees will remain in place under the U.S. Court of Appeals order issued today,\u201d National Treasury Employee Union President Tony Reardon said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe opposed the administration\u2019s effort to prematurely lift the injunction because the government offered no basis for the appellate court to deviate from its normal process.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The unions involved in the case, NTEU and the American Federation of Government Employees, have 45 days from the date of the Court of Appeals\u2019 initial decision to file a request for a rehearing on the case, giving them until Aug. 30 to file the application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDenying the government\u2019s motion was the right call. The government provided no good reason for the court to dissolve the injunction prematurely and speed up the administration\u2019s efforts to violate the law and send the federal workforce into disarray. This is a vitally important case that the court should rehear,\u201d said AFGE National President J. David Cox Sr. in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once the application for a rehearing is filed, it is in the court\u2019s hands to determine how long their decision on such an application will take.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNTEU looks forward to seeking rehearing of last month\u2019s three-judge panel decision. The administration should not be allowed to ignore Congress and no president should be able to single-handedly flout federal civil service laws and weaken the collective bargaining rights of our nation\u2019s civil servants,\u201d said Reardon.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the request for a rehearing is granted, the injunction remains in place for at least as long as the new court proceedings take, according to an NTEU spokesperson. If the request is denied, the injunction would be lifted one week later and the unions would have 90 days to take the case to the Supreme
