{"id":22374,"date":"2020-02-19T17:24:49","date_gmt":"2020-02-19T17:24:49","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2020\/02\/19\/federal-labor-authority-looks-to-overturn-union-dues-regulations\/"},"modified":"2026-08-08T04:57:50","modified_gmt":"2026-08-08T04:57:50","slug":"federal-labor-authority-looks-to-overturn-union-dues-regulations","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2020\/02\/19\/federal-labor-authority-looks-to-overturn-union-dues-regulations\/","title":{"rendered":"Federal labor authority looks to overturn union dues regulations"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Federal Labor Relations Authority released its decision Feb. 18 to reinterpret federal statute governing federal employee union dues, a decision that would upend nearly four decades of precedent governing the annual collection of dues contributed by feds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FLRA decision stems from an Office of Personnel Management request that the agency issue guidance regarding union dues in light of the Janus v. AFSCME Supreme Court case from 2018, which determined that the collection of union fees from non-union members in the private sector was a violation of the First Amendment right to free speech.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FLRA guidance, however, has to do with Federal Labor Relations Statute, which states that when an employee decides to contribute a certain amount of their pay as union dues to their exclusive representative, that allotment \u201cmay not be revoked for a period of one year.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2020\/02\/11\/feds-stand-up-in-silent-judgement-of-trump-policies\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AFGEprotest-Cropped.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Feds stand up in silent judgement of Trump policies<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Members of the American Federation of Government Employees stood for 20 minutes in silence at the Hart Senate Office Building to protest Trump administration workforce policies.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Previous interpretation of that statute determined that union dues could therefore only be revoked at specific, one-year intervals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the new FLRA guidance would instead instruct agencies that assigned dues could not be revoked only for the first year after they\u2019d been set aside, after which an employee could revoke them at any time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn our view, it would assure employees the fullest freedom in the exercise of their rights under the statute if, after the expiration of the initial one-year period during which an assignment may not be revoked under \u00a77115(a), an employee had the right to initiate the revocation of a previously authorized dues assignment at any time that the employee chooses,\u201d the FLRA ruling states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTherefore, in the near future, the Authority intends to commence notice-and-comment rulemaking concerning \u00a77115(a), with the aim of adopting an implementing regulation that hews more closely to the Statute\u2019s text.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FLRA guidance change was made in a two-to-one decision, and dissenting member Ernest DuBester argued that the Supreme Court decision in Janus was only ever meant to apply to union fees for non-members, and not the voluntary dues that employees elect to contribute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIndeed, the court favorably cites the \u2018federal employment experience\u2019 as \u2018illustrative\u2019 of how \u2018labor peace can readily be achieved\u2019 in the absence of \u2018agency fees,\u2019\u201d DuBester wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAnd in a particularly relevant passage, the court informs state governments that, in response to the Janus decision, they \u2018can follow the model of the federal government\u2019 by \u2018keep[ing] their labor-relations systems exactly as they are;\u2019 so long as they do not \u2018force nonmembers to subsidize public-sector unions.\u2019\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Federal employee unions also contest the logic of the decision as another attempt by the Trump administration to weaken collective bargaining.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Authority\u2019s decision is just another step toward the administration\u2019s goal of busting unions and making it even harder for rank-and-file federal employees to speak up, defend their rights and serve the American people. This meritless decision flies in the face of decades of settled and well-reasoned legal precedent in an activist effort to divide federal employees from their unions,\u201d said American Federation of Government Employees National Secretary-Treasurer Everett Kelley in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s part of a pattern of behavior by this administration that shows no respect for federal employees\u2019 voluntary choice, their union contracts, or their rights under the law.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The National Treasury Employees Union, which informed the U.S. Court of Appeals for the D.C. Circuit Feb. 18 that it plans to legally challenge the decision, noted that federal statute has long recognized unions\u2019 need for stability in collecting dues at regular intervals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe administration\u2019s concern about the full exercise of employee rights is especially galling because this administration has done nothing but attack federal employees \u2014 their pay, their benefits, their due process rights and their dedication to their jobs,\u201d NTEU National President Tony Reardon said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cUnions and our allies in Congress are the only ones blocking the administration from doing further damage to the federal workforce, which is exactly why they are targeting us.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">FLRA intends to issue a notice and comment rulemaking on the reinterpretation of the statute \u201cin the near future,\u201d according
