{"id":23453,"date":"2020-03-13T02:06:32","date_gmt":"2020-03-13T02:06:32","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2020\/03\/13\/the-pentagon-was-to-reconsider-its-jedi-award\/"},"modified":"2026-08-08T04:54:09","modified_gmt":"2026-08-08T04:54:09","slug":"the-pentagon-was-to-reconsider-its-jedi-award","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/it-networks\/cloud\/2020\/03\/13\/the-pentagon-was-to-reconsider-its-jedi-award\/","title":{"rendered":"The Pentagon wants to \u2018reconsider\u2019 its JEDI award decision"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Department of Defense requested 120 days to \u201creconsider certain aspects\u201d of its decision to award its controversial enterprise <a href=\"https:\/\/www.federaltimes.com\/home\/2019\/10\/26\/amazon-or-microsoft-dod-picks-a-winner-for-its-controversial-jedi-contract\/\" target=_blank>contract to Microsoft<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The request from the DoD in a March 12 court filing comes after Court of Federal Claims Judge Patricia Campbell-Smith issued a temporary restraining order directing the Pentagon to stop all work on its Joint Enterprise Defense Infrastructure cloud contract,<a href=\"https:\/\/www.federaltimes.com\/it-networks\/cloud\/2020\/01\/14\/amazon-will-seek-to-halt-work-on-dods-jedi-cloud\/\" target=_blank> after AWS alleged<\/a> that the DoD made mistakes in its source selection process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court granted Amazon\u2019s request for an injunction <a href=\"https:\/\/www.federaltimes.com\/it-networks\/cloud\/2020\/03\/08\/why-a-federal-court-halted-work-on-the-pentagons-enterprise-cloud\/\" target=_blank>Feb. 13<\/a>. While Amazon <a href=\"https:\/\/www.federaltimes.com\/it-networks\/cloud\/2019\/11\/14\/amazon-will-protest-pentagons-jedi-to-dod\/\" target=_blank>challenged <\/a>both the technical evaluation and <a href=\"https:\/\/www.federaltimes.com\/it-networks\/cloud\/2019\/11\/25\/here-are-the-trump-statements-amazon-cites-in-its-jedi-protest\/\" target=_blank>political interference<\/a>, the court\u2019s decision to <a href=\"https:\/\/www.federaltimes.com\/it-networks\/cloud\/2020\/02\/13\/pentagon-and-microsoft-must-halt-work-on-jedi-cloud-for-now\/\" target=_blank>impose the injunction<\/a> rested on AWS\u2019 technical challenges to the DoD selection, which included issues with how the Pentagon considered data storage capabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDoD wishes to reconsider its evaluation of the technical aspects of Price Scenario 6, and intends to issue a solicitation amendment and to accept limited proposal revisions addressing the offerors\u2019 technical approach to that price scenario,\u201d Defense Department lawyers wrote in the document.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/govcon\/contracting\/2019\/10\/30\/so-what-problems-does-jedi-solve-really\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Cloud-Computing.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">So what problems does JEDI solve, really?<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Industry leaders say that the DoD&#039;s enterprise cloud will allow the warfighter to access data quicker, consolidate data and develop artificial intelligence.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In the court filing, the DoD also said it wants to reconsider its evaluation of Microsoft and AWS\u2019 online marketplace offerings and \u201cmay conduct\u201d clarifications with the two tech giants. The DoD will reconsider other technical challenges presented by AWS, but \u201cdoes not intend to conduct discussions with offerors or to accept proposal revisions with respect to any aspect of the solicitation,\u201d other than price scenario six of the RFP, which deals with storage capabilities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement, Microsoft spokesperson Frank Shaw said the DoD made the \u201ccorrect decision.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHowever, we support their decision to reconsider a small number of factors as it is likely the fastest way to resolve all issues and quickly provide the needed modern technology to people across our armed forces. Throughout this process, we\u2019ve focused on listening to the needs of the DoD, delivering the best product, and making sure nothing we did delayed the procurement process. We are not going to change this approach now,&#8221; Shaw said. \u201cOver two years the DoD reviewed dozens of factors and sub factors and found Microsoft equal or superior to AWS on every factor. We remain confident that Microsoft\u2019s proposal was technologically superior, continues to offer the best value, and is the right choice for the DoD.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The JEDI cloud contract is potentially worth $10 billion over 10 years. This court filing is another significant setback for the DoD, even after the <a href=\"https:\/\/www.navytimes.com\/it-networks\/cloud\/2019\/08\/13\/its-official-dods-jedi-contract-is-being-reviewed-again\/\" target=\"_blank\">continuous challenges the contract has faced for about two years<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier in the court battle, Amazon sought to depose President Donald Trump, Secretary of Defense Mark Esper, former Secretary of Defense Jim Mattis, DoD CIO Dana Deasy and several other DoD officials involved in the in the final decision. An Amazon spokesperson said the company was \u201cpleased\u201d with the decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;We are pleased that the DoD has acknowledged \u2018substantial and legitimate\u2019 issues that affected the JEDI award decision, and that corrective action is necessary,\u201d a spokesperson said. &#8220;We look forward to complete, fair, and effective corrective action that fully insulates the re-evaluation from political influence and corrects the many issues affecting the initial flawed award.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A DoD
