Gavin Newsom and as U.S. deputy labor secretary under the outgoing Marty Walsh.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cJulie knows in her bones &#8230; the people who get up every morning and go to work and bust their necks just to make an honest living deserve something \u2014 someone to fight on their side to give them an even shot,\u201d Biden said in remarks on March 1.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Democratic lawmakers and labor unions have expressed their support for Su, saying she is a \u201ca fierce champion for unions\u201d and her installation, if approved, would be \u201ca huge victory for America\u2019s Asian and Pacific Islander communities and working families,\u201d <a href=\"https:\/\/twitter.com\/SenCortezMasto\/status\/1630638417129160711\" target=\"_blank\">tweeted<\/a> New Mexico Sen. Catherine Cortez Masto.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Su is likely to, and has already, faced opposition by Republicans who have qualms about her continuing the Biden administration\u2019s \u201cweaponized bureaucracy at the Department of Labor,\u201d as Sen. John Barrasso (R-Wyo.) said in comments Tuesday. Su was confirmed in 2021 as deputy by<a href=\"https:\/\/www.senate.gov\/legislative\/LIS\/roll_call_votes\/vote1171\/vote_117_1_00256.htm#position\" target=\"_blank\"> a 50 to 47 vote<\/a>, with no Republicans voting to approve her.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/acquisition\/regulations\/2023\/01\/17\/white-house-memo-establishes-labor-advisors-on-federal-contracts\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP22340824546810.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">White House memo establishes labor advisers on federal contracts<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The goal is for labor advisers to help agencies avoid employment violations.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">She came under fire during her nomination for her California AB5 law, which required companies that hire <a href=\"https:\/\/www.investopedia.com\/terms\/i\/independent-contractor.asp\">independent contractors<\/a> to reclassify them as employees, and for her oversight of the state unemployment insurance system, which is being reamed by <a href=\"https:\/\/waysandmeans.house.gov\/ways-and-means-approves-plan-to-recover-hundreds-of-billions-in-misspent-stolen-unemployment-benefits\/\" target=\"_blank\">Congress<\/a> for potentially billions of dollars in fraudulent payments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is disappointing that the President welcomes this record of failure to his cabinet and seeks to promote such broken policies at the federal level that have resulted in disaster for workers and our economy,\u201d said Rep. Michelle Steel of California in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, from an inside-the-cabinet perspective, her transition to secretary is likely to be smooth given the predictability of her nomination; she was second-in-command under Walsh, is already vetted and has been involved in policymaking thus far that\u2019s likely to continue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI think for the administration, this move makes a lot of sense,\u201d said Jim Plunkett, a partner at Ogletree Deakins and the former director for labor policy at the U.S. Chamber of Commerce, in an interview. \u201cA lot of people saw this coming as soon as that news broke about Secretary Walsh leaving for the NHL Players Association.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOne, you know, politically, this administration likes to pat itself on the back for a diverse cabinet,\u201d he added. \u201cThis is another win for them in that arena, but even more so, she\u2019s been there for two years. Not only does she have this experience with the substantive legal and policy issues, but she knows how things work in the Francis Perkins building for the last two years under under this administration.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Everett Kelley, president of the largest federal employee union, the <a href=\"https:\/\/www.federaltimes.com\/federal-oversight\/congress\/2023\/02\/14\/what-afge-federal-government-union-leaders-want-from-congress\/\" target=\"_blank\">American Federation for Government Employees,<\/a> said Su is \u201cpreeminently qualified to lead the Department of Labor.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In her current role, Su serves as the de-facto chief operating officer for the department, overseeing its workforce, managing its budget and executing priorities of the secretary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Her influence is likely to be felt in the way she finishes policies that are still half-baked, Plunkett said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One such area of pending regulation for the department is determination of employee or independent contractor classification under the Fair Labor Standards Act, which was open for feedback until December and is expected to be finalized in May, according to the agency\u2019s<a href=\"https:\/\/www.reginfo.gov\/public\/do\/eAgendaViewRule?pubId=202210&#038;RIN=1235-AA43\" target=\"_blank\"> regulatory agenda.<\/a><\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/management\/pay-benefits\/2023\/02\/02\/biden-urges-agencies-to-support-family-leave-for-new-employees\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"228\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP060615052564.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Biden urges agencies to support family leave for new employees<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Biden\u2019s announcement comes days before the 30-year anniversary of the Family and Medical Leave Act of 1993.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Plunkett said he expects a continuation of policy that\u2019s already in the works under Su, at least initially, which the Biden administration is likely to benefit from in terms of a unified, continuous front on issues like independent contractors, overtime, paid time off and the Family and Medical Leave Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Su is also well-known for her strong litigation and enforcement of minimum wage and occupational safety standards during her tenure in California\u2019s state government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A <a href=\"https:\/\/www.dir.ca.gov\/DLSE\/Publications\/DLSE_Report2013.pdf\" target=\"_blank\">May 2013 report <\/a>of her leadership there as labor commissioner found that \u201cthe last two years of enforcement activity have been the most robust by almost every measure in the division\u2019s history.\u2019<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Su developed a criminal investigation unit to go after unscrupulous labor practices and through various initiatives charted the highest number of civil penalties assessed in a decade. Her goal, she said was to increase compliance with labor laws, not indiscriminately target employers already following them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, Republicans may be wary of Su flexing an enforcement arm in the department, especially after rumors circled about the <a href=\"https:\/\/www.federaltimes.com\/federal-oversight\/doj-fbi\/2022\/11\/04\/irs-crime-fighting-arm-takes-on-new-tasks-during-ukraine-war\/\" target=\"_blank\">IRS arming up its agents <\/a>as law enforcers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTo say that Su failed in her previous role as labor secretary in California is an extreme understatement,\u201d said California Congressman <a href=\"https:\/\/kiley.house.gov\/posts\/rep-kiley-makes-comprehensive-case-against-su-for-labor-secretary\" target=\"_blank\">Kevin Kiley, <\/a>who chairs the Subcommittee on Workforce Protections. \u201cThe amount of suffering Su\u2019s Labor Department inflicted on my constituents and millions of Californians should entirely disqualify Su from consideration.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As agencies head into the budget process for fiscal 2024, if Su wants to put money where her priorities lie, she\u2019ll be up against House Republicans who may want more answers about them, Plunkett said. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe broader discussion about the state of the economy, people working from home, people wanting to work differently in non-traditional ways, that could be a line of inquiry from the Republicans, like, \u2018Are your policy preferences right for employers and employees and workers in this economy at this
