{"id":27040,"date":"2023-10-05T14:52:21","date_gmt":"2023-10-05T14:52:21","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2023\/10\/05\/high-court-seems-likely-to-back-consumer-financial-protection-bureau\/"},"modified":"2026-08-08T05:05:40","modified_gmt":"2026-08-08T05:05:40","slug":"high-court-seems-likely-to-back-consumer-financial-protection-bureau","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/congress\/2023\/10\/05\/high-court-seems-likely-to-back-consumer-financial-protection-bureau\/","title":{"rendered":"High court seems likely to back Consumer Financial Protection Bureau"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/apnews.com\/hub\/us-supreme-court\">Supreme Court<\/a> on Tuesday seemed likely to preserve the work of <a href=\"https:\/\/apnews.com\/article\/us-supreme-court-politics-massachusetts-state-government-business-1b5e1539c2c5f95254d7e11475abd40a\">the Consumer Financial Protection Bureau<\/a> against a conservative-led challenge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even some conservative justices sounded skeptical of arguments that the agency, created after the 2008 financial crisis to regulate mortgages, car loans and other consumer finance, violates the Constitution in the way it is funded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CFPB case is one of several major challenges to federal regulatory agencies on the docket this term for a court that has for more than a decade been open to limits on their operations. The CFPB, the brainchild of Democratic Sen. Elizabeth Warren of Massachusetts, has long been opposed by Republicans and their financial backers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a majority of the court appeared ready to reject the sweeping arguments made by the lawyer for payday lenders whose challenge to a CFPB rule spawned the Supreme Court case. A ruling for the agency also would quiet concerns about the validity of the CFPB\u2019s actions since its creation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unlike most federal agencies, the consumer bureau does not rely on the annual budget process in Congress. Instead, it is funded directly by the Federal Reserve, with a current annual limit of around $600 million.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The federal appeals court in New Orleans, in a novel ruling, held that the funding violated the Constitution\u2019s appropriations clause because it improperly insulates the CFPB from congressional supervision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Embracing that ruling, lawyer Noel Francisco said on behalf of the lenders Tuesday that Congress can\u2019t hand so much power to an executive branch agency. \u201cThis is a perpetual delegation to pick your own number,\u201d said Francisco, who served as the Trump administration\u2019s top Supreme Court lawyer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But several justices pushed back against his arguments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCongress could change it tomorrow. There\u2019s nothing permanent or perpetual about this,\u201d Justice Brett Kavanaugh said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Elena Kagan said that Francisco\u2019s arguments were \u201cflying in the face of 250 years of history.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Samuel Alito was the most aggressive questioner when Solicitor General Elizabeth Prelogar, the Biden administration\u2019s top lawyer, defended the CFPB.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the U.S. Chamber of Commerce and some other business interests backed the payday lenders, mortgage bankers and other sectors regulated by the CFPB cautioned the court to avoid a broad ruling that could unsettle the markets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Three years ago, the court decided another CFPB case, <a href=\"https:\/\/apnews.com\/article\/us-news-us-supreme-court-laws-supreme-courts-courts-bb8cf3f7f3cde783f6131da014cb13b7\">ruling<\/a> that Congress had improperly insulated the head of the bureau from removal.
