{"id":28064,"date":"2023-09-21T19:31:19","date_gmt":"2023-09-21T19:31:19","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2023\/09\/21\/government-shutdowns-getting-more-lengthy-damaging-history-shows\/"},"modified":"2026-08-08T05:09:12","modified_gmt":"2026-08-08T05:09:12","slug":"government-shutdowns-getting-more-lengthy-damaging-history-shows","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/congress\/2023\/09\/21\/government-shutdowns-getting-more-lengthy-damaging-history-shows\/","title":{"rendered":"Government shutdowns become more lengthy, costly, history shows"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Americans, federal employees and politicians know budget shutdowns to be a near annual fixture of governance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The threat of one, at least, has become standard operating procedure, and agencies by now are used to expending more effort than they\u2019d like planning for a lapse in appropriations, whether it happens or not. <a href=\"https:\/\/www.spglobal.com\/en\/research-insights\/articles\/with-a-us-government-shutdown-there-will-be-blood#:~:text=Ironically%2C%20a%20possible%20shutdown%20will%20add%20to%20the%20budget%20deficit%2C%20because%20it%27s%20costly%20to%20stop%20and%20start%20programs.\" target=\"_blank\">Data from 2013 <\/a>shows at least $2 billion worth of work-hours were lost during a two-week shutdown.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To prepare for what is often an up-to-the minute change, agencies are expected by the White House to have <a href=\"https:\/\/www.federaltimes.com\/federal-oversight\/congress\/2023\/09\/05\/federal-agency-contingency-plans-lay-in-wait-for-shutdown-notices\/\" target=\"_blank\">shutdown contingency plans at the ready<\/a> that are updated regularly, not just when a funding gap seems imminent. Even short-term continuing resolutions require agencies to divert attention from their normal business and have a predetermination of what, and who, is affected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt requires a lot of manpower and hours and time to actually prepare for either the possibility of a shutdown or the likelihood, based on recent historical experience of a CR,\u201d said Andrew Lautz, a senior analyst at the Bipartisan Policy Center. \u201cThere\u2019s an opportunity cost to that, too, in the weeks and months leading up to Oct. 1.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That said, federal agencies have good practice operating under CRs at this point, Lautz added, and so the planning that goes into this time of year is not paranoia, but preparedness.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/fedlife\/financial-planning\/2023\/09\/11\/tips-for-stretching-dollars-saving-money-during-a-government-shutdown\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1392590443.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Federal, military credit unions offer shutdown financial assistance<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Senate Democratic leaders and House Speaker Kevin McCarthy, R-Calif., face a looming Oct. 1 deadline to avoid a government shutdown<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">For one, the more extreme shutdowns since the 1990s have lasted several weeks and were damaging to the federal workforce, the contracting industry and the taxpayer, numerous watchdog reports have said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet for those who remember, there was a time when shutdowns <a href=\"https:\/\/en.wikipedia.org\/wiki\/Government_shutdowns_in_the_United_States\" target=\"_blank\">spanned less than a week, <\/a>sometimes just a few hours, if they even happened at all.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And when it did happen, there was still political infighting and dogma underlying it as there is today, though now it feels more poignant, experts said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn my whole career, most of the things that happened in the government were essentially uncomplicated,\u201d said Reg Jones, a retirement expert for Federal Times and assistant director of the U.S. Office of Personnel Management from 1979 to 1995. \u201cThere were debates at the Bureau of the Budget &#8230; trying to balance out income versus outgo, and so forth. Of course, you\u2019ll have to remember, too, that in those older days, many in the House and the Senate were overwhelmingly run by one party.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today, in a divided government with Republicans controlling the House against a democratic executive branch, that balance point teeters back and forth, Jones said, \u201callowing for more carrying on and foolishness.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe real question is why most Republicans will not jettison a hard line from the Freedom Caucus that almost all Republicans know will hurt the party?\u201d said Roy Meyers, a professor in the Department of Political Science at the University of Maryland, Baltimore County. \u201cAnd why won\u2019t they deal with Democrats to pass a bipartisan appropriations bill? If policy was the only issue, rather than partisan conflict, I think there\u2019d be a lot of Republicans that would be willing to deal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the \u201cmust-pass\u201d nature of fiscal policy can make it even more difficult for budgets to be reconciled in a divided government, wrote <a href=\"https:\/\/www.brookings.edu\/articles\/how-does-a-divided-government-impact-the-congressional-budget-process\/\" target=\"_blank\">Molly Reynolds of the Brookings Institute <\/a>in 2019.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, the Pew Research Center shows in a September report that <a href=\"https:\/\/www.pewresearch.org\/politics\/2023\/09\/19\/public-trust-in-government-1958-2023\/\" target=\"_blank\">public trust in government<\/a> has fallen once again to near-record lows. (Graph courtesy of the Pew Research Center).<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The other historical difference accounting for perhaps a \u201cnew age\u201d of shutdowns is the major legislative reforms that shaped the budget process, and congressional proceedings, that hum in Congress today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Generally, prior to 1980, the government continued operations through funding lapses, according to the Committee for a Responsible Federal Budget. It found that since 1981, 10 funding gaps of three days or fewer have occurred.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c[Congress] just kept appropriating possibly year-round, and there was no schedule for doing it, and so you didn\u2019t really have to worry about government shutdowns,\u201d said Carl Cavalli, a political science professor at the University of North Georgia. \u201cThere may have been arguments over individual appropriations bills and things like that, but you didn\u2019t have this everything coming to a head every September and October like you do now.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Begging the question: how did we get here?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Congress <a href=\"https:\/\/ung.edu\/university-press\/_uploads\/files\/basics-govt-4.pdf?t=1663105043728\" target=\"_blank\">changed the budget process in the 1970s<\/a> with the Congressional Budget and Impoundment Control Act and other reforms that added structure, deadlines and lines of authority over the federal purse. It established the House and Senate budget committees and the Congressional Budget Office, which added organization but also complexity and urgency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThose rule changes, plus the growing power of the Republican Party, which means the two parties are more evenly divided and much more likely to trade off control every now and then, is why we almost never finish the budget process on time [nowadays],\u201d Cavalli said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">President Jimmy Carter\u2019s attorney general also had a lot to do with the way the executive branch responds to Congress\u2019 inability to pass a budget.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYou have asked my opinion concerning the scope of currently existing legal and constitutional authorities for the continuance of government functions during a temporary lapse in appropriations, such as the government sustained on Oct. 1, 1980,\u201d Benjamin Civiletti <a href=\"https:\/\/www.energy.gov\/sites\/prod\/files\/2013\/10\/f3\/Shutdown.OLC_.1981.general.pdf\" target=\"_blank\">wrote to his president <\/a>three months later.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/smr\/50-years-federal-times\/2015\/12\/03\/government-shutdowns-of-1990s-partisan-politics-reaches-dysfunctional-heights\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"239\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/635840683194590454-1995-shutdownjpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Government shutdowns of 1990s: Partisan politics reaches dysfunctional heights<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The longest government shutdown in U.S. history made shutdown threats a common feature of budget negotiations.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The c<a href=\"https:\/\/www.natlawreview.com\/article\/introduction-impacts-government-shutdown\" target=\"_blank\">onclusion he came to <\/a>was agencies could avoid spending money they didn\u2019t have and running afoul of the Antideficiency Act by suspending agency operations until appropriations are made. He was careful to carve out an exception for agency functions that affect \u201cthe safety of human life or the protection of property,\u201d offering a yardstick for deciding which agency employees are considered \u201cessential\u201d during a lapse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today, that decisionmaking is still a part of agencies\u2019 contingency plans on file with the Office of Management and Budget.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat happens is that the essential things that are necessary for the government to continue in operation will continue,\u201d said Jones. \u201cThey may be restricted. They may be minimal, but they will be there because there\u2019s no way they <i>can\u2019t<\/i> be there.
