{"id":28605,"date":"2022-11-10T00:52:10","date_gmt":"2022-11-10T00:52:10","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2022\/11\/10\/navy-engineer-wife-sentenced-in-submarine-spy-case\/"},"modified":"2026-08-08T19:44:40","modified_gmt":"2026-08-08T19:44:40","slug":"navy-engineer-wife-sentenced-in-submarine-spy-case","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/federal-oversight\/2022\/11\/10\/navy-engineer-wife-sentenced-in-submarine-spy-case\/","title":{"rendered":"Navy engineer, wife sentenced in submarine spy case"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">CHARLESTON, W.Va. \u2014 Citing the \u201cgreat danger\u201d that a Navy engineer and his wife posed to U.S. security, a federal judge gave both of them lengthy prison terms Wednesday for a <a href=\"https:\/\/www.navytimes.com\/news\/your-military\/2021\/10\/10\/navy-nuclear-engineer-charged-with-trying-to-pass-secrets\/\" target=\"_blank\">plot to sell secrets about nuclear submarines<\/a> to what they thought was a representative of a foreign government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. District Judge Gina Groh, who in August <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2022\/08\/16\/judge-rejects-navy-engineers-plea-agreement-in-submarine-spy-case\/\" target=\"_blank\">rejected earlier plea agreements that had called for reduced sentencing guidelines<\/a>, sentenced Jonathan Toebbe to more than 19 years and his wife, Diana Toebbe, to nearly 22 years. The sentences were handed down on Jonathan Toebbe\u2019s 44th birthday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Annapolis, Maryland, couple and their attorneys described the defendants\u2019 struggles with mental health issues and alcohol and said they were <a href=\"https:\/\/www.militarytimes.com\/news\/2021\/12\/08\/couple-accused-in-navy-submarine-spy-case-wanted-to-leave-us-because-of-trump-lawyer-says\/\" target=\"_blank\">anxious about the nation\u2019s political climate<\/a> when they <a href=\"https:\/\/www.navytimes.com\/news\/2021\/10\/19\/us-couple-accused-in-submarine-espionage-case-indicted\/\" target=\"_blank\">sold secrets in exchange for $100,000 in cryptocurrency<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Groh said their tale \u201creads like a crime novel or a movie script\u201d and that Jonathan Toebbe\u2019s \u201cactions and greedy self-serving intentions placed military service members at sea and every citizen of this country in a vulnerable position and at risk of harm from adversaries.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Diana Toebbe, who admitted acting as a lookout for her husband, received an enhanced sentence after the judge disclosed during the couple\u2019s combined five-hour sentencing hearing that Diana Toebbe tried to send her husband two letters from jail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The letters, which were read in court, were intercepted before they could be delivered. In one of them, Diana Toebbe told her husband to flush the letter down a toilet after reading it. She encouraged him to lie about her involvement in the scheme and say she \u201cdidn\u2019t know anything about any of this.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge said she lacked genuine remorse and didn\u2019t take responsibility for her actions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is an exceptional story, right out of the movies,\u201d Groh said.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/07\/27\/coast-guard-veteran-wife-charged-with-stealing-ids-of-dead-kids\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-174197278.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Coast Guard veteran, wife charged with stealing IDs of dead kids<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Federal prosecutors said old photos show the couple wearing uniforms of the KGB, the former Russian spy agency.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Prior to sentencing, Jonathan Toebbe described his battles with stress in taking on additional duties and his own battle with alcohol. He said he experienced warning signs of a nervous breakdown over 18 months that he failed to recognize.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI believed that my family was in dire threat, that democracy itself was under collapse,\u201d he said. That belief overwhelmed him, he said, and led him to believe he had to take \u201cprecipitous action to try to save them from grave harm.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors said Toebbe abused his access to top-secret government information and repeatedly sold details about the design and performance of Virginia-class submarines to someone he believed was a representative of a foreign government but who was actually an undercover FBI agent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Diana Toebbe, 46, who was teaching at a private school in Maryland at the time of the couple\u2019s arrest last October, admitted she acted as a lookout at several prearranged \u201cdead-drop\u201d locations where memory cards containing the secret information were left behind.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The memory cards were devices concealed in objects such as a chewing gum wrapper and a peanut butter sandwich. The couple was arrested in October 2021 after Jonathan Toebbe placed a card in Jefferson County, West Virginia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">None of the information was classified as top secret or secret, falling into a third category considered confidential, according to previous testimony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The couple was sentenced for their <a href=\"https:\/\/apnews.com\/article\/maryland-sentencing-west-virginia-us-navy-c23a41c31f9a0953827b4af3acf5468d\" target=\"_blank\">guilty pleas in September<\/a> in federal court in Martinsburg, West Virginia, to one felony count each of conspiracy to communicate restricted data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In August, Groh <a href=\"https:\/\/apnews.com\/article\/maryland-sentencing-west-virginia-government-and-politics-ca52ad2e6a53af0cc68fb3aeeebc07ea\" target=\"_blank\">rejected their initial guilty pleas<\/a> to the same charges, saying the sentencing options were \u201cstrikingly deficient\u201d considering the seriousness of the case. The previous sentencing range agreed to by lawyers for Jonathan Toebbe had called for a potential punishment of up to 17 years in prison. Prosecutors had sought three years for Diana Toebbe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a hearing last December, Diana Toebbe\u2019s attorney, Barry Beck, asserted that the couple was looking to <a href=\"https:\/\/apnews.com\/article\/arrests-donald-trump-united-states-maryland-37d7a79ba37561f992ef152949c45044\" target=\"_blank\">flee the United States<\/a> due to their contempt for then-President Donald Trump.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a search of the couple\u2019s home, FBI agents found a trash bag of shredded documents, thousands of dollars in cash, valid children\u2019s passports and a \u201cgo-bag\u201d containing a USB flash drive and latex gloves, according to previous testimony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She said her decision to participate in the scheme was \u201ccatastrophic,\u201d as she is the mother of children ages 12 and 16, and that she should have tried to talk her husband out of it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI didn\u2019t think of my children, who have suffered the most,\u201d she said. \u201cTheir lives will forever be marked by the decision that I made.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Groh said that choice was \u201cdeliberate and calculated.\u201d She admonished Beck, who had labeled his client as merely an accomplice in seeking a lesser sentence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYour client put this country in great danger,\u201d Groh told Beck. \u201cNo matter what you call it, the harm to this nation was great.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FBI has said the scheme began in April 2020, when Jonathan Toebbe sent a package of Navy documents to a foreign government and expressed interest in selling operations manuals, performance reports and other sensitive information. That package was obtained by the FBI in December 2020 through its legal attach\u00e9 office in an unspecified foreign country, setting off a months-long undercover operation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An FBI agent posing as a foreign government\u2019s representative made contact with Toebbe, ultimately paying in cryptocurrency for the information Toebbe was offering.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Groh said about $54,000 of the cryptocurrency has been recovered.
