Last year after the trial, Sammartino had ruled the lead federal prosecutor committed \u201cflagrant misconduct\u201d by withholding information from defense lawyers but said at the time that it was not enough to dismiss the case.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2022\/09\/26\/fat-leonard-fugitive-in-navy-bribery-case-seeks-venezuelan-asylum\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Fat-Leonard-1.jpg-1.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Fat Leonard, fugitive in Navy bribery case, seeks Venezuelan asylum<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The fugitive defense contractor nicknamed \u201cFat Leonard\u201d has requested asylum in Venezuela, a law enforcement official said Monday.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The surprising turn came at a sentencing hearing in federal court in San Diego.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Assistant U.S. Attorney Peter Ko, who was brought on after the trial last year, admitted to \u201cserious issues\u201d and asked the judge to vacate the officers\u2019 felony convictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said his office does not agree with all of the allegations but said errors were made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere were pretty obviously serious issues that affect our ability to go forward\u201d defending the convictions or seeking a new trial, Ko told the judge, according&nbsp;<a href=\"https:\/\/www.sandiegouniontribune.com\/news\/courts\/story\/2023-09-06\/federal-prosecutors-admit-misconduct-in-fat-leonard-trial-of-4-naval-officers\">to the San Diego Union-Tribune<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Andrew Haden, acting U.S. Attorney for the Southern California District, reiterated that in a statement after the hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAs stated in court, we do not agree with all the allegations or characterizations in the motions or in court,\u201d Haden said. \u201cWe recognize and regret, however, that errors were made, and we have an obligation to ensure fairness and justice. The resolutions of these defendants\u2019 cases reflect that.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Haden added that it \u201cis also significant that the four officers who stood before the court today admitted for the first time, under oath, that they broke the law and are guilty of crimes related to their official duties.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The officers \u2014 former Capts. David Newland, James Dolan and David Lausman and former Cmdr. Mario Herrera \u2014 <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2022\/06\/29\/four-former-navy-officers-convicted-in-fat-leonard-bribery-trial\/\" target=\"_blank\">were previously convicted by a federal jury on various counts of accepting bribes<\/a> from <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2017\/03\/14\/navy-bribery-scandal-widens-as-more-sordid-details-emerge-in-fat-leonard-case\/\" target=\"_blank\">foreign defense contractor Leonard Francis<\/a>, and his company, Glenn Defense Marine Asia, or GDMA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Wednesday three of them pleaded guilty to one count each of disclosing information to Francis, and Lausman pleaded guilty to a charge of destruction of government property, for smashing a hard drive with a hammer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defense attorney Todd Burns, who represented Dolan, said his client was relieved to have this behind him. He and defense attorneys for the three other men had filed hundreds of pages outlining how the monthslong trial was rife with misconduct from prosecutors hiding evidence, ignoring false testimony and concealing facts that questioned the credibility of key witnesses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe government has a massive amount of power to coerce things, and that power is still evident in this context,\u201d Burns said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said his client agreed to plead guilty to a misdemeanor after a decade of fighting the allegations against him, \u201cbleeding legal fees\u201d and enduring stress on his family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese four guys were facing what was going to be sentences by the original prosecutors that were going to be absolutely devastating financially and custody-wise,\u201d he said. \u201cThen they were offered a deal to plead to a misdemeanor and a $100 fine to walk away and end this brutal chapter.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The men spent more than a year asking for a retrial. Theirs was the only case to go to trial out of the more than two dozen defendants charged. The jury deadlocked and reached no verdict on charges against a fifth defendant, retired Rear Adm. Bruce Loveless, and prosecutors later dropped those charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nearly two dozen Navy officials, defense contractors and others have been convicted and sentenced on various fraud and corruption charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Several others are awaiting sentencing next month. It\u2019s not clear if this could jeopardize those cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Francis admitted to buying off dozens of top-ranking officers with booze, sex, lavish parties and other gifts. Prosecutors say he bilked the Navy out of more than $35 million.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Three weeks before the Malaysian defense contractor faced sentencing last year, Francis made a stunning escape, snipping off his ankle monitor and fleeing the San Diego residence where he had been under house arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The escape was also seen by some as a misstep by the prosecution for allowing him to not be held behind bars. He was later captured in Venezuela, where he remains.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The four former officers had served in the Navy\u2019s 7th Fleet in the Eastern Pacific, where Francis\u2019 company supplied ships for decades.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Francis was arrested in a San Diego hotel in September 2013 as part of a federal sting. Investigators say he and his company, Glenn Defense Marine Asia, bribed officers so he could overcharge for supplying ships or charge for fake services at ports he controlled in Southeast Asia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case, which delved into salacious details about service members cheating on their wives and seeking out prostitutes, was an embarrassment to the Pentagon. The U.S. attorney\u2019s office handled the prosecution, offering independence from the military justice system.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Felony convictions have been
