{"id":29211,"date":"2022-01-27T17:20:13","date_gmt":"2022-01-27T17:20:13","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2022\/01\/27\/dod-is-pausing-civilian-covid-vaccine-mandate-after-court-ruling\/"},"modified":"2026-08-08T07:22:44","modified_gmt":"2026-08-08T07:22:44","slug":"dod-is-pausing-civilian-covid-vaccine-mandate-after-court-ruling","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/management\/2022\/01\/27\/dod-is-pausing-civilian-covid-vaccine-mandate-after-court-ruling\/","title":{"rendered":"DoD is pausing civilian COVID vaccine mandate after court ruling"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Defense Department is pausing its processing of exemption requests or disciplinary actions for civilian employees who are still not <a href=\"https:\/\/www.federaltimes.com\/management\/2021\/12\/09\/feds-vaccination-numbers-climb-ahead-of-stricter-enforcement\/\" target=\"_blank\">vaccinated against COVID-19<\/a>, the Pentagon has confirmed, as <a href=\"https:\/\/www.federaltimes.com\/management\/2022\/01\/21\/trump-appointee-blocks-biden-federal-worker-vaccine-mandate\/\" target=\"_blank\">a federal lawsuit <\/a>continues to play out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A federal judge ruled Friday that the Biden administration doesn\u2019t have legal standing to <a href=\"https:\/\/www.federaltimes.com\/management\/2021\/09\/17\/how-the-federal-vaccine-mandate-will-be-enforced\/\" target=\"_blank\">enforce a mandate<\/a> for federal employees, which could include firings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis case is not about whether folks should get vaccinated against COVID-19 \u2014 the court believes they should,\u201d Texas district Judge Jeffrey Brown wrote. \u201cIt is not even about the federal government\u2019s power, exercised properly, to mandate vaccination of its employees. It is instead about whether the president can, with the stroke of a pen and without the input of Congress, require millions of federal employees to undergo a medical procedure as a condition of their employment. That, under the current state of the law as just recently expressed by the Supreme Court, is a bridge too far.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DoD has not yet released its policy for firing or otherwise disciplining any of its 950,000 civilian employees who refuse to be vaccinated, though exemption requests have been processed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pentagon has not released its numbers of unvaccinated civilians, but <a href=\"https:\/\/www.defense.gov\/Spotlights\/Coronavirus-DOD-Response\/\" target=\"_blank\">DoD data<\/a> shows that more than 340,000 have been vaccinated through the department.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2022\/01\/21\/it-cost-millions-to-recruit-train-new-troops-being-booted-for-vaccine-refusal\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"158\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Marine-Introduction.jpeg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">It cost millions to recruit, train new troops being booted for vaccine refusal<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Hundreds of trainees shipped to basic training unvaccinated and continue to refuse, flagging them for discharge.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">\u201cTo ensure compliance with the preliminary nationwide injunction issued on January 21, the Department of Defense is not taking any further actions to implement or enforce the civilian employee vaccination as required by Executive Order 14043 at this time,\u201d spokeswoman Lisa Lawrence told Military Times on Thursday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The military departments began notifying their employees earlier this week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">President Joe Biden\u2019s executive order dropped Sept. 14, requiring all federal employees to get vaccination, secure an exemption or risk disciplinary action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pentagon has not explicitly said that employees would be fired if they did not complete the vaccination requirement.
