Hutchins, 23, has pleaded not guilty.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/c4isrnet\/home\/2018\/04\/19\/cybersecurity-experts-case-delayed-as-new-details-emerge\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP_17215670099306.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Cybersecurity expert\u2019s case delayed as new details emerge<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The case of British cybersecurity expert once heralded as a hero for stopping the WannaCry worldwide computer virus was delayed Thursday to allow his attorneys more time to prepare arguments on why a judge should suppress statements he made after his arrest for allegedly creating software to steal banking passwords.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">FBI agents detained him in Las Vegas on Aug. 2 before he boarded a flight home to England and interrogated him for nearly two hours. The two FBI agents who arrested him testified Wednesday that he was properly mirandized and that he spoke to them voluntarily.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, one of Hutchins\u2019 attorneys argued the agents weren\u2019t completely truthful with Hutchins and didn\u2019t show him the indictment and charges he faced until an hour into the interrogation, which was recorded.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/c4isrnet\/newsletters\/2017\/08\/03\/wannacry-hero-indicted-on-six-hacking-related-charges\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"202\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP17135781773450.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">WannaCry hero indicted on six hacking-related charges<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Marcus Hutchins, UK native who successfully found the kill-switch for the WannaCry ransomware has been arrested in the U.S. for his alleged role in creating and distributing a banking trojan.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">\u201cThat\u2019s hiding the ball. You can\u2019t waive rights if you hide the ball,\u201d attorney Brian Klein said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His attorneys have argued Hutchins didn\u2019t fully understand Miranda warnings because he\u2019s a foreigner and was also sleep-deprived after a week partying in Vegas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A judge will issue a ruling on the defense\u2019s request in a couple of weeks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During testimony, the FBI agents contradicted themselves about when Hutchins was shown the indictment. One said it was before the interview, but another testified it was much later in the interrogation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although the interrogation was recorded, it doesn\u2019t include the portion at the beginning when the agents say they advised Hutchins of his rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the prosecutors in the case said it\u2019s clear Hutchins knew why he was being detained and pointed to a transcript of a jailhouse interview with an unidentified person who Hutchins tells, \u201cI knew it was always going to come back,\u201d referring to the Kronos malware he\u2019s accused of creating.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe knows deep down what\u2019s going on and why he\u2019s there,\u201d said Michael Chmelar, an assistant U.S. attorney.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the same call, Hutchins also relays part of what he told the FBI agents, according to the transcript:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSo I wrote code for a guy a while back who then incorporated it into a banking malware, so they have logs of that, and essentially they want to know my part of the banking operation or if I just sold the code onto some guy then they wanted me to, once then found I sold the code to someone, they wanted me to give them his name, and I don\u2019t actually know anything about him.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hutchins\u2019 arrest last August came as a shock because only four months earlier he was lauded as a cybercrime-fighting hero for finding a \u201ckill switch\u201d to slow the outbreak of the WannaCry virus, which crippled computers worldwide, encrypting files and making them inaccessible unless people paid a ransom ranging from $300 to $600.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The indictment said the crimes happened between July 2014 and July 2015, but prosecutors have not offered any details about the number of victims. Prosecutors also said in recent court filings that Hutchins is suspected to have sold the Kronos software to someone in Wisconsin and that he \u201cpersonally delivered\u201d the software to someone in California.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Robert Graham, a computer security expert not connected to the case, warned against concluding that Hutchins had done something wrong simply because his code wound up in malware.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m not saying he didn\u2019t cross a legal line somewhere, but the quotes (in the filing) are still consistent with somebody who is a security researcher rather than a malware kingpin,\u201d Graham said in a text to The Associated Press.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition to computer fraud, the indictment lists five other charges, including attempting to intercept electronic communications and trying to access a computer without authorization. Hutchins faces decades in prison if convicted of all the charges. He has been barred from returning home and has been living in California, where he works as a cybersecurity consultant while awaiting
