{"id":32873,"date":"2019-10-15T14:29:40","date_gmt":"2019-10-15T14:29:40","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2019\/10\/15\/how-night-court-will-impact-the-pentagons-acquisition-office\/"},"modified":"2026-08-08T00:18:08","modified_gmt":"2026-08-08T00:18:08","slug":"how-night-court-will-impact-the-pentagons-acquisition-office","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/acquisition\/2019\/10\/15\/how-night-court-will-impact-the-pentagons-acquisition-office\/","title":{"rendered":"How \u2018night court\u2019 will impact the Pentagon\u2019s acquisition office"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 When U.S. Defense Secretary Mark Esper launched a <a href=\"https:\/\/www.defensenews.com\/2019\/08\/30\/espers-pledge-to-trim-pointless-programs-will-test-his-political-clout\/\" target=_blank>review this summer<\/a> of the departmentwide offices known as the \u201cfourth estate,\u201d he made it clear that everything, including cuts to programs and personnel, were on the table.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two months into that review, clear themes have emerged, according to Pentagon acquisition head Ellen Lord: Esper isn\u2019t looking to cut just to cut, and if offices aren\u2019t tied directly into war-fighting needs, they may no longer belong in the Department of Defense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking on a panel at the <a href=\"https:\/\/www.defensenews.com\/digital-show-dailies\/ausa\/\" target=_blank>Association of the U.S. Army\u2019s annual conference<\/a> on Monday, Lord said several of her offices, including the Defense Threat Reduction Agency and the Defense Acquisition University, have gone through the review process.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/defensenews\/pentagon\/2019\/08\/28\/night-court-comes-to-the-pentagon\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/1000w_q95.jpg_4c4ac7.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Night court comes to the Pentagon<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">\u201cIf you want to call it that, that\u2019s fine with me,\u201d Esper said when asked if his new review was the equivalent of a Pentagon-wide night court process.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat we\u2019ve seen there is more, perhaps, a pushing back of certain functions to either services or to intel,\u201d Lord said. \u201cWhere I\u2019ve seen a question of actually cutting the workforce is non-true DoD missions. As we\u2019ve gone through a lot of the different areas, if it isn\u2019t war fighting, if it\u2019s something that one of the other agencies or the other departments across government has asked us to do, or if it\u2019s something that should be a function of another department because it\u2019s not about lethality, it will get cut.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lord does not expect to see major cuts to the acquisition workforce working in her under secretariat of acquisition and sustainment, in part because of how thin that workforce already is. Of the 175,380 individuals who work on acquisition inside the Pentagon, only 16 percent come from the fourth estate, and there are a number of open billets that Lord is struggling to fill with qualified people.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, look for cuts to \u201cnonessential\u201d benefits or programs, Lord told Defense News after the panel\u2019s conclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNothing is finalized, but for instance we don\u2019t think it\u2019s a good use of acquisition funds to have facility engineers having programs at DAU. At DTRA, we are looking at some of the functions that might better be within the intel group. We\u2019re also looking at some of the R&amp;D that might be better placed back at the Army research labs, for instance,\u201d Lord said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOverall what we keep coming back to in the department is when we have non-war-fighting functions, when states are asking us to support them or we\u2019ve been asked to [do] some counter-drug activities, things like that. We\u2019re just trying to make sure we do war fighting and we let other organizations do support functions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The so-called <a href=\"https:\/\/www.defensenews.com\/congress\/2019\/07\/22\/this-is-who-wants-to-reform-the-fourth-estate-now\/\">fourth estate<\/a> of the department includes 27 agencies, such as the Defense Intelligence Agency, the Defense Information Systems Agency and the Missile Defense Agency. A September 2018 report from the <a href=\"https:\/\/www.defensenews.com\/pentagon\/2018\/09\/11\/gao-to-dod-fix-fourth-estate-inefficiencies\/\">Government Accountability Office<\/a> estimated those agencies collectively have an annual budget of at least $106 billion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Notably, Lord said that some of the efficiencies bubbling up in the review process will require Congress to change legal requirements placed on the department.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI think one of the greatest outcomes of this process is finding out where we are being held by statute to do things that might not, today, be in our best interest, where they were five, 10, 15 years ago,\u201d Lord said. \u201cSo we will go back to Congress and ask them for relief in certain areas where we think if we do things differently, we can gain some efficiencies.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Changes from the night court process are <a href=\"https:\/\/www.defensenews.com\/pentagon\/2019\/09\/09\/program-cuts-from-espers-pentagon-wide-review-could-come-sooner-than-expected\/\" target=_blank>expected to be rolled out<\/a> as they are completed, and Lord said that it is possible some moves could begin for her office by November. But, at least so far, \u201cthere\u2019s nothing dramatic\u201d in A&amp;S coming, in part because Lord\u2019s team had already begun finding the low-hanging fruit for savings before Esper\u2019s process began.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe have effectively [before the review] been working on efficiencies to get as many dollars to actual war fighting as possible, and to look at economies of scale in terms of overhead functions like HR and IT, so forth, trying to automate as much as we can, being more efficient with databases,\u201d Lord
