{"id":33128,"date":"2022-11-08T19:05:24","date_gmt":"2022-11-08T19:05:24","guid":{"rendered":"https:\/\/one.sightlinemg.com\/federaltimes\/uncategorized\/2022\/11\/08\/senate-to-vote-on-pentagon-contract-adjustments-amid-inflation\/"},"modified":"2026-08-08T00:45:51","modified_gmt":"2026-08-08T00:45:51","slug":"senate-to-vote-on-pentagon-contract-adjustments-amid-inflation","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/federaltimes\/acquisition\/2022\/11\/08\/senate-to-vote-on-pentagon-contract-adjustments-amid-inflation\/","title":{"rendered":"Senate to vote on Pentagon contract adjustments amid inflation"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 The Senate is expected to vote on legislation that would authorize the Pentagon to modify fixed-price defense contracts when lawmakers return to Washington next week after <a href=\"https:\/\/www.militarytimes.com\/news\/election-2022\/2022\/10\/31\/what-a-gop-win-in-november-would-mean-for-defense-policy-in-2023\/\" target=\"_blank\">the midterm elections<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation marks a significant potential victory for <a href=\"https:\/\/www.defensenews.com\/pentagon\/2022\/09\/01\/defense-industry-to-launch-inflation-relief-push-in-congress\/\" target=\"_blank\">defense industry groups that had pushed Congress to authorize economic price adjustments for Pentagon contracts<\/a>, arguing that doing so is necessary to help companies cope with <a href=\"https:\/\/www.defensenews.com\/pentagon\/2022\/10\/10\/smaller-firms-at-army-trade-show-say-theyre-hard-hit-by-market-shocks\/\" target=\"_blank\">the impact of inflation and persistent supply chain issues<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cInflation hurts our national defense and is particularly damaging to the small businesses in our defense-industrial base,\u201d Kea Matory, the director of legislative policy for the National Defense Industrial Association, told Defense News. \u201cWe understand there are significant limits to what [the Department of Defense] can do on its own to address this challenge, which is why we support Congress increasing the DoD top line and providing the department additional authority so DoD can minimize the disruption and protect our national security.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2022\/06\/16\/senators-back-45-billion-boost-in-defense-spending-for-fy23\/\" target=\"_blank\">fiscal 2023 National Defense Authorization Act, which the Senate Armed Services Committee advanced in June, authorizes $847 billion in defense spending <\/a>\u2014 an 8% increase over the fiscal 2022 budget, in large part to cope with inflation. That amount includes $817 billion in Pentagon top-line funding. The amendment authorizing Pentagon contract adjustments, introduced by Sen. Kevin Cramer, R-N.D., is included as part of <a href=\"https:\/\/www.defensenews.com\/news\/pentagon-congress\/2022\/10\/11\/senators-confident-defense-budget-work-will-get-finished-this-year\/\" target=\"_blank\">a package of 75 amendments to the FY23 NDAA<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe specific amendment on inflation and contract flexibility better allows the Pentagon to tackle rising costs in the defense supply chain,\u201d Cramer said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Senate Armed Services Chairman Jack Reed, D-R.I., and ranking member James Inhofe, R-Okla., filed the 75-amendement package to the NDAA last month. The Senate is expected to begin voting on the bill \u2014 and its numerous amendments \u2014 when it reconvenes next week after more than a month of recess.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.defensenews.com\/congress\/2022\/07\/14\/house-passes-defense-authorization-with-new-arms-transfers-restrictions\/\" target=\"_blank\">House NDAA, which passed 329-101 in July,<\/a> does not authorize fixed-price contract adjustments. So if the Cramer amendment passes, it will still have to survive Senate and House negotiations in the NDAA conference committee later this year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Cramer amendment would require the undersecretary of defense for acquisition and sustainment \u2014 currently Bill LaPlante \u2014 to issue guidance on fixed-price contract adjustments within a month after Congress passes both the NDAA and defense spending legislation. LaPlante said at an event last week that, without congressional action, it appears the Pentagon cannot do more.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIntuitively, I believe people are getting hurt,\u201d LaPlante said. \u201cI believe that small businesses are getting hurt. I believe suppliers are getting hurt. Wanted to make sure that we were providing within the regs, within the law, the most flexibility to contractors.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">LaPlante provided a similar message last month in a letter to Sen. Elizabeth Warren, D-Mass., who pressed him on the Pentagon\u2019s intentions to pursue fixed-price contract adjustments at the request of defense industry groups.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Warren, in an October letter to LaPlante, argued that \u201cwell-intentioned DoD policies to support vulnerable suppliers will instead result in taxpayers underwriting defense contractors\u2019 executives\u2019 lavish compensation packages\u201d while paying for stock buybacks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI particularly urge DoD to be circumspect about the industry\u2019s claims about the impact of inflation given their second quarter profits, which show operating incomes that increased over the last quarter and average 11.7%, suggesting there was little or no adverse impact due to inflation,\u201d Warren wrote in her letter to LaPlante.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pentagon in May released inflation guidance to its acquisitions workforce, reminding them they can use economic price adjustment clauses when drafting contracts. The department then <a href=\"https:\/\/www.defensenews.com\/pentagon\/2022\/09\/12\/extraordinary-circumstances-dod-eyes-inflation-relief-for-vendors\/\" target=\"_blank\">issued an update<\/a> in September.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To sway lawmakers to allow adjustments to existing contracts without such clauses, LaPlante said he\u2019s implored the defense industry to provide data to justify the flexibility its seeking. That\u2019s been slow to come.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He also wants companies that can no longer afford to make new bids on contracts or to honor previous bids to speak up \u2014 or to include data to justify their higher bids \u2014 but none have.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPeople do grab it as a be-all; show us the data,\u201d LaPlante said. \u201cI think Congress wants to be sympathetic to it, I think they want to help, but they\u2019re in the same position that we\u2019re in &#8230; we can\u2019t do it, we have to do it based upon data.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m open-minded: On the other hand, we\u2019re not going to arbitrarily open up every contact,\u201d he added. \u201cWe can\u2019t do
