{"id":13699,"date":"2020-01-17T14:54:55","date_gmt":"2020-01-17T14:54:55","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2020\/01\/17\/op-ed-a-navy-bribery-scandal-and-the-limits-of-free-speech\/"},"modified":"2026-08-08T18:41:26","modified_gmt":"2026-08-08T18:41:26","slug":"op-ed-a-navy-bribery-scandal-and-the-limits-of-free-speech","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/opinion\/commentary\/2020\/01\/17\/op-ed-a-navy-bribery-scandal-and-the-limits-of-free-speech\/","title":{"rendered":"Op-ed:  A Navy bribery scandal and the limits of free speech"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"> It seems like everyone\u2019s talking about bribery these days \u2013 but I, and anyone else who works for the federal government, have to limit what we can say about what does or does not constitute an ethical or illegal lapse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am an ethicist who teaches leadership, ethics and law, and I believe a recent bribery case in the U.S. military offers an interesting and distinctive perspective through which to consider these issues. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unfortunately, due to current restrictions on what federal employees can and can\u2019t say about political matters, I can\u2019t discuss all the ways that case might apply to a broader debate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nonetheless, there is one thing I can say without caveat or equivocation. (U.S. Navy photo)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><i><b>Trouble in the 7th Fleet<\/b><\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The so-called \u201c<a href=\"https:\/\/www.washingtonpost.com\/graphics\/investigations\/seducing-the-seventh-fleet\/\" target=\"_blank\">Fat Leonard scandal<\/a>\u201d is the <a href=\"https:\/\/medium.com\/@RPublicService\/feds-at-work-uncovered-the-largest-bribery-and-corruption-scandal-in-u-s-navy-history-450a67469f61\" target=\"_blank\">largest bribery and corruption case<\/a> in U.S. Navy history.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The key player is Leonard Glenn Francis, a Malaysian-born businessman based in Singapore who was commonly referred to as \u201cFat Leonard\u201d because of <a href=\"https:\/\/www.washingtonpost.com\/sf\/investigative\/2016\/05\/27\/the-man-who-seduced-the-7th-fleet\/\" target=\"_blank\">his 350-pound weight<\/a>. He ran a company called Glenn Defense Marine Asia that had U.S. government contracts to provide various services to Navy ships in Asian ports \u2013 <a href=\"https:\/\/news.usni.org\/2019\/01\/24\/paying-price-hidden-cost-fat-leonard-investigation\" target=\"_blank\">docking, refueling, sewage removal<\/a> and <a href=\"https:\/\/www.justice.gov\/opa\/pr\/former-employee-navy-contractor-pleads-guilty-international-navy-bribery-scandal\" target=\"_blank\">shore transportation for both cargo and personnel<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2015, Francis pleaded guilty to plying <a href=\"https:\/\/www.justice.gov\/opa\/press-release\/file\/948061\/download\" target=_blank>Navy officers<\/a> with cash and favors in exchange for their efforts to steer the Navy\u2019s Pacific fleet to ports where his company could provide services. Then, the company would fabricate bids by nonexistent companies to make its own charges look competitive, <a href=\"https:\/\/www.justice.gov\/opa\/pr\/former-employee-navy-contractor-pleads-guilty-international-navy-bribery-scandal\" target=_blank>overbill the Navy for services<\/a> and even draw up fake invoices to collect money for goods and services it never provided to the ships and crews.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case is perhaps best known for the fact that one of the most common favors Francis provided were paid sexual partners: He even <a href=\"https:\/\/www.washingtonpost.com\/sf\/investigative\/2016\/05\/27\/the-man-who-seduced-the-7th-fleet\/\" target=_blank>kept meticulous notes<\/a> about the peccadilloes of different officers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More significant for U.S. taxpayers is the fact that the decade-long scam ultimately bilked the Navy out of <a href=\"https:\/\/news.usni.org\/2019\/01\/24\/paying-price-hidden-cost-fat-leonard-investigation\">more than $35 million<\/a>.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/05\/16\/two-more-navy-officers-censured-for-fat-leonard-related-infractions\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Heedong-Choi.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Two more Navy officers censured for Fat Leonard-related infractions<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">At least 10 officers have been issued reprimands for their purported roles in the public corruption scandal.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\"><i><b>Whistleblowers and corruption<\/b><\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In some ways the Fat Leonard scandal is a textbook bribery scheme, with clandestine meetings, envelopes full of cash, and explicit arrangements to perform clearly illegal acts. In fact, one of the biggest questions raised when <a href=\"https:\/\/www.nytimes.com\/2013\/11\/21\/us\/navy-was-warned-of-contractor-in-bribery-scandal.html\" target=_blank>Leonard was finally arrested in 2013<\/a> was how his company had been able to get away with the scheme for almost a decade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There were, in fact, several whistleblowers along the way, but as is often the case when corruption is widespread, those in on the scheme were <a href=\"https:\/\/www.washingtonpost.com\/investigations\/navy-repeatedly-dismissed-evidence-that-fat-leonard-was-cheating-the-7th-fleet\/2016\/12\/27\/0afb2738-c5ab-11e6-85b5-76616a33048d_story.html\" target=\"_blank\">notified<\/a> of the complaints before word got to those who would hold them responsible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So rather than being lauded, whistleblowers were instead widely <a href=\"https:\/\/www.stripes.com\/news\/us\/navy-repeatedly-dismissed-evidence-that-fat-leonard-was-cheating-the-7th-fleet-1.446333\" target=\"_blank\">vilified<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nonetheless, the truth was eventually brought to light. To date, <a href=\"https:\/\/www.washingtonpost.com\/graphics\/investigations\/seducing-the-seventh-fleet\/\" target=\"_blank\">more than 20 people have pleaded guilty<\/a> to federal crimes, including the first-ever <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2017\/05\/17\/us-navy-admiral-sentenced-to-18-months-in-fat-leonard-bribery-scandal\/\" target=\"_blank\">conviction of an admiral for a felony<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Significantly, however, the scope of the scandal is even more far-reaching. Dozens of officers, including several admirals, <a href=\"https:\/\/www.washingtonpost.com\/graphics\/investigations\/seducing-the-seventh-fleet\/\" target=\"_blank\">have been reprimanded and removed from office<\/a> for more minor related violations, without going to jail.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2020\/01\/11\/stung-by-string-of-scandals-sea-service-urges-legal-reforms\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Gallagher-sentence-2.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Stung by string of scandals, the sea service urges legal reforms<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The Navy will launch an oversight committee to make sure the changes are carried out.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\"><i><b>Reciprocity and bribery<\/b><\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These last cases are particularly interesting, because they help demonstrate not only the high standards of military, but also the ways that bribery schemes often don\u2019t conform to common, stereotypical, preconceived notions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.washingtonpost.com\/graphics\/investigations\/seducing-the-seventh-fleet\/\" target=\"_blank\">Many of the officers<\/a> charged <a href=\"https:\/\/www.sandiegouniontribune.com\/news\/courts\/sd-me-amundson-sentence-20181019-story.html\" target=\"_blank\">didn\u2019t accept cash payments<\/a>, but rather the kind of favors that they couldn\u2019t or wouldn\u2019t be able to obtain for themselves: travel, champagne, scotch, luxury hotel rooms, <a href=\"https:\/\/www.latimes.com\/local\/lanow\/la-me-ln-navy-captain-bribery-20150115-story.html\" target=\"_blank\">ornamental swords, handmade ship models<\/a>, <a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/navy-captain-enters-guilty-plea-in-massive-bribery-case\/2015\/01\/15\/b09688ba-9ced-11e4-a7ee-526210d665b4_story.html\" target=\"_blank\">spa treatments, Cuban cigars, Kobe beef, Spanish suckling pigs<\/a>, <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/02\/09\/navy-captain-who-moonlighted-as-fat-leonards-pr-man-is-headed-to-prison\/\" target=\"_blank\">concert tickets<\/a> and even a <a href=\"https:\/\/www.justice.gov\/opa\/press-release\/file\/948061\/download\" target=\"_blank\">culinary internship<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ultimately, it shouldn\u2019t be surprising that bribery often begins with small favors rather than thick envelopes of cash. Human beings are social creatures; favors <a href=\"https:\/\/doi.org\/10.1177%2F001872676902200407\" target=_blank>strengthen people\u2019s social bonds<\/a> and make them <a href=\"https:\/\/doi.org\/10.1177%2F0146167200261008\" target=_blank>more likely to reciprocate in turn<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s why federal ethics rules regarding favors are generally <a href=\"https:\/\/ask.fedweek.com\/federal-government-policies\/rules-gifts\/\" target=\"_blank\">so strict<\/a>, <a href=\"https:\/\/www.stripes.com\/news\/us\/navy-repeatedly-dismissed-evidence-that-fat-leonard-was-cheating-the-7th-fleet-1.446333\" target=\"_blank\">prohibiting<\/a> government employees from accepting all but the most minimal gifts (even modest meals) from contractors and foreign agents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those prohibitions have obvious exceptions, but the principle behind the general rules is all the more important in their exceptions: Official actions are meant to serve public, rather than private, interests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the Fat Leonard cases, the evidence is clear: Even in the cases in which leaders have been merely reprimanded and removed from office, the kinds of favors the officers accepted demonstrate they were acting for their own benefits \u2013 not those of the nation.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2018\/09\/13\/retired-master-chief-pleads-guilty-to-role-in-fat-leonard-scandal\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/essex.jpg_610ff1.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Corrupt retired master chief pleads guilty in \u2018Fat Leonard\u2019 scandal<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Ricarte I. David could face up to 20 years in prison for his offenses.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\"><i><b>Why I can\u2019t say more<\/b><\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There may well be lessons the Fat Leonard saga has for other cases in which the alleged exchange of official acts for something of personal value is a key element of the crime. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those considerations might seem even more relevant given that in 1998, Mississippi Republican lawmaker Roger Wicker took to the House floor and declared \u201cthe rule of law means that the commander-in-chief of our armed forces could not be held to a lower standard than are his subordinates.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More than two decades later Wicker, now a senator, has <a href=\"https:\/\/www.youtube.com\/watch?v=y2xK9YcT56c&#038;t=6m5s\" target=_blank>recently reaffirmed<\/a> that standard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, I am a federal employee, and the U.S. Office of Special Counsel has issued <a href=\"https:\/\/web.archive.org\/web\/20200106212710\/https:\/\/osc.gov\/Documents\/Hatch%20Act\/Advisory%20Opinions\/Federal\/Current%20Guidance%20on%20President%20Trump%27s%20Reelection%20Status.pdf\" target=_blank>unusually broad guidance<\/a> about the <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2010-title5\/html\/USCODE-2010-title5-partIII-subpartF-chap73-subchapIII.htm\" target=_blank>Hatch Act\u2019s<\/a> limits on federal workers\u2019 partisan political activities. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law generally bars federal employees from advocating in favor of or against the election of a particular candidate, as well from participating in other partisan political activities in an election. Yet the current guidance \u2013 which itself <a href=\"https:\/\/www.washingtonpost.com\/outlook\/2019\/12\/14\/impeachment-is-law-saying-political-process-only-helps-trumps-narrative\/\" target=\"_blank\">has been criticized for taking sides on a political divide<\/a> \u2013 has been taken by some to apply to any <a href=\"https:\/\/int.nyt.com\/data\/documenthelper\/500-osc-hatch-act-advisory-novembe\/6255daba98ab1a42d079\/optimized\/full.pdf#page=1\" target=\"_blank\">analysis of<\/a> any aspects of <a href=\"https:\/\/cdn.govexec.com\/media\/gbc\/docs\/pdfs_edit\/osc_november_27_2018_guidance_extension_and_clarification.pdf\" target=\"_blank\">the president\u2019s impeachment<\/a> and trial.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/12\/03\/at-the-end-of-a-scandal-plagued-year-navys-top-officer-urges-integrity\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/gilday.JPG_465532.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">At the end of a scandal-plagued year, Navy\u2019s top officer urges integrity<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Reflecting his thoughts after three months as chief of naval operations, Adm. Mike Gilday\u2019s brief broadside fired at the fleet on Monday asked sailors &quot;to think about who we are as a Navy and the constitutional oath we commit ourselves to.&quot;<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\"><i><b>Limiting public discourse<\/b><\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a <a href=\"https:\/\/www.govexec.com\/oversight\/2019\/08\/union-sues-give-federal-employees-right-talk-impeachment-and-resistance\/159151\/\" target=_blank>free-speech problem<\/a>, but it\u2019s more than that. When federal and state governments hire experts and researchers as, in effect, public servants, I believe that expertise <a href=\"https:\/\/www.nytimes.com\/2019\/04\/02\/opinion\/government-censorship.html\" target=_blank>should be welcome in the public sphere<\/a>, helping to inform the people we work for.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I work at a federally run university, which is why I come under these particular government rules. There are <a href=\"https:\/\/en.wikipedia.org\/wiki\/United_States_federal_academies\" target=_blank>relatively few institutions<\/a> like mine, so it might seem a minor issue. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, <a href=\"https:\/\/my.wlu.edu\/general-counsel\/answer-center\/political-activity\/statement-concerning-political-activity\" target=\"_blank\">numerous<\/a> <a href=\"https:\/\/policies.utexas.edu\/policies\/prohibitions-political-activity\" target=\"_blank\">states<\/a> <a href=\"https:\/\/www.president.iastate.edu\/federal\/guidelines\" target=\"_blank\">have<\/a> <a href=\"https:\/\/district.maricopa.edu\/legal\/student-faculty-resources\/political-activity-on-campus\">laws<\/a> similar to the Hatch Act, at least some of <a href=\"https:\/\/www.uky.edu\/hr\/policies\/political-activities-and-public-office\" target=\"_blank\">which<\/a> <a href=\"https:\/\/www.ohsu.edu\/government-relations\/political-activity-notice\" target=\"_blank\">apply to employees<\/a> <a href=\"https:\/\/www.lsu.edu\/govrelations\/state\/ethics.php\" target=\"_blank\">of<\/a> <a href=\"https:\/\/www.umsystem.edu\/ums\/rules\/collected_rules\/personnel\/ch330\/330.050_political_activities\" target=\"_blank\">those states\u2019<\/a><a href=\"https:\/\/www.k-state.edu\/govrelations\/university\/PAP.html\" target=\"_blank\">public<\/a> <a href=\"https:\/\/www.usu.edu\/policies\/333\/\">universities<\/a>.
