Bryan J. Baltierra, who was just 18 when he died.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/marinecorpstimes\/news\/your-marine-corps\/2021\/12\/15\/marine-amphibious-assault-vehicles-permanently-pulled-from-deployments\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/6681483.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Marine amphibious assault vehicles permanently pulled from deployments<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Only 10 of 3rd Assault Amphibian Battalion\u2019s nearly 200 vehicles passed the more intense inspection.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">On July 30, 2020, an Marine Corps AAV with the 15th Marine Expeditionary Unit sank of the coast of California as it was participating in waterborne training.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The incident resulted in the deaths of eight Marines and one sailor. The Marine Corps and Navy launched multiple investigations into the sinking and determined it happened in part because the Marines onboard the AAV were not properly trained, and partly due to serious maintenance issues with the vehicle itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Several Marines have been relieved from command due to the accident, including Maj. Gen. Robert Castellvi, who was the commander of the 1st Marine Division during the unit\u2019s predeployment training cycle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The former 3rd Assault Amphibian battalion commander,<a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/12\/10\/board-to-determinate-fate-of-marine-assault-amphibian-battalion-commander-during-deadly-2020-sinking\/\" target=\"_blank\"> Lt. Col. Keith Brenize, <\/a>is currently facing a board of inquiry, which will determine his future in the Marine Corps.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Case prosecutors maintain that Brenize failed to ensure maintenance and training were properly performed prior to attaching an AAV platoon to the MEU.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, the defense maintains that the entirety of the Marine Corps\u2019 AAV fleet faced daunting maintenance issues that went well beyond the scope of Brenize\u2019s position as battalion commander.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese are old vehicles,\u201d Lt. Col. Matthew Hohl, the executive officer for 3rd AA Battalion, testified on Dec. 10.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAs a community, AAVs are extremely maintenance heavy,\u201d the defense witness added, noting that an AAV typically requires eight hours of maintenance for every hour of operation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Marine Corps announced its decision to pull the AAVs from deployments and waterborne training on Dec. 15, citing the \u201cstate of the amphibious vehicle program,\u201d which includes both AAVs and the amphibious combat vehicle scheduled to replace the AAV.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Commandant of the Marine Corps has decided the AAV will no longer serve as part of regularly scheduled deployments or train in the water during military exercises; AAVs will only return to operating in the water if needed for crisis response,\u201d Maj. Jim Stenger, a Marine Corps spokesman, told Marine Corps Times in an email.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Peter Ostrovsky, the father of Pfc. Jack Ryan Ostrovsky, who was 20 when the AAV sank, said that pulling the vehicle from the water was the right move made by the Marine Corps.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt all appears logical that the Marine Corps would transition to exclusive use of the ACV for amphibious forced entry during deployments as more ACVs come on line,\u201d the grieving father said in a statement to Marine Corps Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn light of the catastrophe that resulted in the death of our son and the other Marines and Sailor along with the reported current state of the AAV fleet and the available parts inventory, it\u2019s the right thing to do to avoid the possibility of further loss of life during AAV waterborne operations,\u201d he added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His sentiment was echoed by Aleta Bath, the mother of Pfc. Evan A. Bath, 19 when he died, who said she was \u201cextremely happy\u201d the decision was finally made to pull those vehicles out of the water.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bath said she was concerned that the Marine Corps said the AAVs would still be available in case of a \u201ccrisis.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI want to make sure that if they are in use for water, that the emergency is a true emergency,\u201d she added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Questions remained for Baltierra.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI wish this was done back in 2016 \u2026 to pull these AAVs out of the water,\u201d Baltierra said. \u201cI am curious \u2026 what was it that made them finally say, \u2018no more?\u2019\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/marinecorpstimes\/news\/your-marine-corps\/2021\/03\/31\/its-your-date-of-death-just-finish-this-mission-families-of-fallen-marines-sailor-react-to-investigation-of-tragic-aav-sinking\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"165\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/B200812-M-JX780-1239.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">\u2018It\u2019s your date of death, just finish this mission\u2019: Heartbroken families of fallen Marines, sailor react to failures exposed in tragic AAV sinking investigation<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Anger, disgust and unimaginable grief were some of the words used to describe the emotions felt by some of the families of the nine service members who didn\u2019t survive that day.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">A<a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/07\/29\/families-of-service-members-killed-in-2020-marine-corps-aav-accident-sue-manufacturer\/\" target=\"_blank\"> lawsuit <\/a>filed against BAE Systems claims that the mechanical failures that doomed their sons were defects known by the manufacturer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe only reason that nobody lived, was they couldn\u2019t get out the door, the door just wouldn\u2019t open,\u201d Eric Dubin, one of the lawyers representing the families, told Marine Corps Times. \u201cAnd we believe that was a manufacturing defect that was known about which puts BAE on the hook.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tim Paynter, a spokesman for BAE Systems, said the company will not comment on the specifics of the legal action against them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe extend our deepest condolences to the families of the nine service members who were killed in this tragic accident,\u201d Paynter said in a written statement before pointing to the multiple investigations conducted by the military into the incident. \u201cWe\u2019re not in a position to comment on ongoing litigation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe findings of those investigations have consistently identified issues other than the vehicle design as causes,\u201d Paynter said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawyers for the families said they hope to sit down with BAE Systems to talk about issues they see with the ACV to ensure there is no future tragic loss of life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe frustration we have right now \u2026 is that BAE won\u2019t even come to the table,\u201d Annee Della Donna, another lawyer representing the families, told Marine Corps Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Paynter told Marine Corps that BAE continues to ensure, \u201cthat every vehicle we produce meets the highest standards of quality, meets our customer\u2019s requirements, and lives up to our mission of protecting our military service members. We would refer you to the U.S. Marine Corps for any additional information.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dubin said the lawyers have made it clear to BAE Systems, \u201cthat this is not about money and that we want to get past the money issues and work together on safety modifications.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Though questions remain, lawsuits are still being sought and boards of inquiry are still to take place, the pulling of the AAVs has been a small win for the families, they say.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019re happy that the AAVs are beached, it\u2019s a great day for our clients and for a little bit of justice,\u201d Della Donna said.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u201cWe left our boys to (the Marine Corps) in hopes that (the Marine Corps) would care for them well.
