Maj. Damien Rodriguez is accused of attacking the staff at DarSalam restaurant in Portland, Oregon, in April. <br\/><br\/>At the time of the alleged assault, Rodriguez was serving as the battalion sergeant major for 1st\u00a0Battalion, 11th\u00a0Marines at Camp Pendleton,\u00a01st\u00a0Lt. Paul Gainey, a Marine spokesman, told Marine Corps Times. <br\/><br\/> Rodriguez was caught\u00a0<a class=\"\" href=\"http:\/\/www.nydailynews.com\/news\/national\/marine-recorded-throwing-chair-man-iraqi-restaurant-article-1.3102583\" target=\"_blank\" title=\"Link: http:\/\/www.nydailynews.com\/news\/national\/marine-recorded-throwing-chair-man-iraqi-restaurant-article-1.3102583\">on video<\/a> at the restaurant shouting racial slurs at the staff of the Iraqi restaurant. At one point, Rodriguez can be seen in the video swinging a chair, allegedly striking one of the employees. <br\/><br\/> He was indicted in early July on one count of assault in the second degree, one count of disorderly conduct in the second degree and two counts of intimidation in the second degree,\u00a0Multnomah County\u00a0Deputy District Attorney Chris Ramras told Marine Corps Times. Ramras noted that the intimidation charge is commonly referred to as a hate crime. <br\/><br\/>If convicted,\u00a0Rodriguez\u00a0could face more than 10 years in prison.\u00a0<br\/><br\/>Immediately following the incident, the 1st Marine Division removed Rodriguez from his position as the 1st Battalion, 11th Marines battalion sergeant major.<br\/><br\/>&#8220;The 1st Marine Division will continue to assist the Portland District Attorney with this\u00a0matter,&#8221;\u00a0Gainey said.\u00a0&#8220;The Marine Corps does not tolerate disorderly conduct or bad behavior from its Marines or senior leaders and expects all Marines to uphold the highest of principles and ethical behavior, both on and off duty.&#8221;\u00a0<br\/><br\/>The owner of the Portland restaurant,\u00a0Ghaith Sahib, survived a car bomb attack in Baghdad in 2005, according to <a class=\"\" href=\"http:\/\/www.oregonlive.com\/portland\/index.ssf\/2017\/04\/marine_suffering_from_ptsd_cha.html\" target=\"_blank\" title=\"Link: http:\/\/www.oregonlive.com\/portland\/index.ssf\/2017\/04\/marine_suffering_from_ptsd_cha.html\">Oreganlive.com<\/a>.\u00a0<br\/><br\/> Rodriguez was previously charged with harassment and disorderly conduct, but the District Attorney&#8217;s Office dropped\u00a0misdemeanor charges and decided to pursue felony charges, according to Ramras.
