Rylee McCollum<\/a>, said he\u2019ll meet a Sept. 12 deadline set by the judge to renew allegations that <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/09\/17\/you-brought-the-world-together-somehow-daughter-born-to-widow-of-marine-lost-in-bombing\/\" target=\"_blank\">Baldwin subjected family members<\/a> to online threats and harassment after he posted and commented on a photo shared online by one of McCollum\u2019s sisters, Roice McCollum, who had been in Washington during the Jan. 6, 2021, insurrection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lance Cpl. Rylee McCollum was killed at age 20 during a suicide attack at the <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-military\/2021\/09\/10\/wyoming-troop-deaths-20-years-apart-bookend-afghanistan-war\/\">Hamid Karzai International Airport in Kabul<\/a> on Aug. 26, 2021. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier this week, Judge Edgardo Ramos in Manhattan dismissed the family\u2019s defamation lawsuit, which sought $25 million in damages, but he invited a refiling of the lawsuit to correct deficiencies and renew claims of defamation and intentional infliction of emotional distress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In tossing out the original lawsuit, Ramos made various conclusions in Baldwin\u2019s favor, including that his comments were protected by the First Amendment, that actual malice was not sufficiently alleged and that private messages, comments and social media posts did not support defamation claims.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/marinecorpstimes\/news\/your-marine-corps\/2021\/09\/17\/you-brought-the-world-together-somehow-daughter-born-to-widow-of-marine-lost-in-bombing\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Lance-Cpl.-Rylee-McCollum_web.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Daughter born to widow of Marine killed in Afghanistan bombing<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">An 8-pound, 10-ounce Levi Rylee Rose McCollum arrived on Monday.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Postiglione said in an email that a rewritten lawsuit will be filed by the deadline that will address issues the judge raised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He added, \u201cWithout getting into specifics, we disagree with the analysis by the Court but believe an amended Complaint will address the issues presented.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Baldwin had donated $5,000 to the family after learning of the death of Rylee McCollum in Afghanistan, just weeks before his daughter was born. Baldwin had contacted Roice McCollum via Instagram, according to the lawsuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In January 2022, Baldwin saw that Roice McCollum posted a picture of demonstrators from former President Donald Trump\u2019s rally taken on the day Congress counted the Electoral College votes from the 2020 presidential election, the lawsuit said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Baldwin told Roice McCollum he would share her photo with his 2.4 million Instagram followers and wrote: \u201cGood luck,\u201d according to the lawsuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Roice McCollum said in the lawsuit that she \u201cdid not take part in, nor did she support or condone the rioting that erupted\u201d at the Capitol, and was cleared of any wrongdoing after meeting with the FBI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A lawyer for Baldwin did not immediately respond to a request for comment.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lance Cpl.
