{"id":31882,"date":"2023-06-28T18:37:16","date_gmt":"2023-06-28T18:37:16","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2023\/06\/28\/marine-vet-pleads-not-guilty-to-revised-charges-in-nyc-subway-death\/"},"modified":"2026-08-08T21:13:21","modified_gmt":"2026-08-08T21:13:21","slug":"marine-vet-pleads-not-guilty-to-revised-charges-in-nyc-subway-death","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/veterans\/2023\/06\/28\/marine-vet-pleads-not-guilty-to-revised-charges-in-nyc-subway-death\/","title":{"rendered":"Marine vet pleads not guilty to revised charges in NYC subway death"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">NEW YORK \u2014 A U.S. Marine veteran who placed a homeless man in a fatal <a href=\"https:\/\/www.marinecorpstimes.com\/veterans\/2023\/05\/06\/marine-vet-accused-of-putting-man-in-deadly-chokehold-on-subway\/\" target=\"_blank\">chokehold aboard a New York City subway<\/a> train last month pleaded not guilty on Wednesday to revised charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Daniel Penny, 24, pleaded not guilty to second-degree manslaughter and criminally negligent homicide in the May 1 death of Jordan Neely, a former Michael Jackson impersonator who was shouting and begging for money on the Manhattan train, according to witnesses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Penny pinned him to the ground with the help of two other passengers and held him in a chokehold for more than three minutes. Neely, 30, lost consciousness during the struggle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The chokehold death, which was caught on bystander video,&nbsp;<a href=\"https:\/\/www.marinecorpstimes.com\/veterans\/2023\/05\/22\/republican-hopefuls-defend-marine-who-put-homeless-man-in-a-chokehold\/\" target=\"_blank\">has prompted fierce debate<\/a>, with some praising Penny as a good Samaritan and others accusing him of racist vigilantism. Penny is white and Neely was Black.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At a brief arraignment on Wednesday, Penny, who is free on bond, uttered only the words \u201cnot guilty\u201d before leaving the courtroom with his lawyers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Penny was initially&nbsp;<a href=\"https:\/\/www.militarytimes.com\/news\/2023\/05\/12\/marine-vet-who-choked-nyc-subway-rider-to-death-will-face-manslaughter\/\" target=\"_blank\">arrested on the manslaughter charge<\/a>&nbsp;in May, but a&nbsp;<a href=\"https:\/\/www.marinecorpstimes.com\/veterans\/2023\/06\/14\/grand-jury-indicts-marine-veteran-in-nyc-subway-chokehold-death\/\" target=\"_blank\">grand jury earlier this month<\/a>&nbsp;added the negligent homicide count, potentially giving a trial jury the option of finding him guilty of the lesser charge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To get a manslaughter conviction, which carries a prison sentence of up to 15 years, prosecutors would have to prove Penny recklessly caused Neely\u2019s death while being aware of the risk of serious harm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A conviction for criminally negligent homicide would require the jury to find that Penny unjustifiably put Neely at risk of death, but failed to perceive that risk. The maximum penalty would be four years in prison.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Penny,&nbsp;who served in the Marines&nbsp;for four years and was discharged in 2021, has said he acted to protect himself and others from Neely, who allegedly shouted \u201cI\u2019m gonna\u2019 kill you\u201d and said he was \u201cready to die\u201d or go to jail for life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Following the arraignment, an attorney for Penny, Steven Raiser, predicted that a Manhattan jury would empathize with the experience of confronting erratic subway behavior while \u201cconfined underground.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDanny isn\u2019t the only one on trial,\u201d he said. \u201cThe rights of people to defend one another will be on a trial too.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neely\u2019s family members and their supporters have said Neely, who struggled with mental illness and homelessness, was crying out for help and was met with violence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neely\u2019s father, Andre Zachery, was in attendance for the arraignment on Wednesday. At a brief press conference, an attorney for the Neely family, Donte Mills, sought to paint Penny as a vigilante killer who hasn\u2019t taken responsibility for his actions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDaniel Penny did not have the courage to look Jordan\u2019s father Andre in the eyes,\u201d Mills said. \u201cBut from now on, don\u2019t be shocked when justice happens for Jordan, for you or for anyone.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neely\u2019s death aboard an F train in Manhattan quickly became a flashpoint in the nation\u2019s debates over racial justice and crime. Republican politicians like&nbsp;<a href=\"https:\/\/apnews.com\/article\/2024-republicans-subway-chokehold-death-be39b29eef4529bf996c13ec5bcd22ef\" target=\"_blank\">Florida Gov. Ron DeSantis<\/a>&nbsp;have hailed Penny as a hero, helping him to raise more than $3 million in legal expenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Meanwhile, civil rights leaders, including Rev. Al Sharpton, have compared the killing to the 1984 subway shooting of four Black men by Bernhard Goetz, a white man dubbed the \u201csubway vigilante\u201d who was eventually acquitted of charges in the shooting except for carrying an unlicensed gun.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cA good Samaritan helps those in trouble.
