Josh Negron and Danny Draher <\/a>of one charge: violation of a lawful general order, for drinking alcohol while deployed in Iraq.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The two Marines \u201cnever said that they didn\u2019t drink,\u201d Phillip Stackhouse, Draher\u2019s civilian attorney and a Marine veteran, told Marine Corps Times on Thursday morning. In fact, Draher testified on the stand that both he and Negron had been drinking the night of the altercation with 45-year-old <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2019\/01\/10\/american-contractor-and-former-green-beret-killed-in-iraq-fight-had-five-bronze-stars-and-multiple-deployments\/\" target=\"_blank\">Army veteran and contractor Rick Rodriguez<\/a>, according to Stackhouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecutors had argued that the two Marine Raiders, part of a trio of accused men colloquially known as the MARSOC 3, were responsible for Rodriguez\u2019s death.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At a bar in Irbil, Iraq, in the early hours of Jan. 1, 2019, Rodriguez had started an argument with Chief Petty Officer Eric Gilmet, a friend of Draher and Negron, witnesses and security footage indicated. Later, on the street outside the bar, Rodriguez became aggressive with Draher, who pushed him backward. Draher testified that Rodriguez had punched him, Stackhouse said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then Negron stepped in and punched Rodriguez, sending him to the ground, according to witnesses and security footage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI think they acted in self-defense,\u201d Stackhouse told Marine Corps Times after the verdict. \u201cI think that the evidence was overwhelming that Mr. Rodriguez initiated the contact.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/marinecorpstimes\/news\/your-marine-corps\/2023\/01\/24\/at-marine-raiders-homicide-trial-questions-center-on-security-video\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"155\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/MARSOC-3.png.png?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">At Marine Raiders\u2019 homicide trial, questions center on security video<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The two sides differed about whether it looked like the contractor or the Marines instigated the violence.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">By the time the jury began deliberations on Wednesday, Negron and Draher were facing fewer charges than when the trial had started. On Jan. 26, the judge agreed to dismiss obstruction of justice charges against the pair based on a lack of evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Tuesday, the convening authority, Maj. Gen. Matthew Trollinger of Marine Corps Forces Special Operations Command, withdrew one of the involuntary manslaughter specifications, or descriptions of alleged acts, against Draher, according to MARSOC spokesman Maj. Matthew Finnerty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It had alleged that Draher killed Rodriguez \u201cby unlawfully striking him with his fist, causing him to fall and hit his head on the ground,\u201d according to the charge sheet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But even the prosecution\u2019s witnesses said at trial that it was Negron who punched Rodriguez, knocking him down. The defense maintained that Negron acted to defend Draher from Rodriguez\u2019s drunken aggression.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The remaining specification<b> <\/b>of the involuntary manslaughter charge alleged that Negron and Draher had negligently killed Rodriguez by failing to take him to a hospital in a timely manner. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the fight, Draher and Negron had left him with Gilmet, a corpsman.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defense argued, contrary to <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2023\/01\/28\/prosecution-experts-in-marsoc-3-trial-say-fistfight-killed-army-vet\/\" target=\"_blank\">testimony by some prosecution expert<\/a><a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2023\/01\/28\/prosecution-experts-in-marsoc-3-trial-say-fistfight-killed-army-vet\/\" target=\"_blank\">s<\/a><a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2023\/01\/28\/prosecution-experts-in-marsoc-3-trial-say-fistfight-killed-army-vet\/\" target=\"_blank\">,<\/a> that Rodriguez may not have died from injuries he sustained from the fight, and that Gilmet was a trusted, experienced corpsman. Stackhouse said that Gilmet testified, <a href=\"https:\/\/www.marinecorpstimes.com\/news\/2023\/01\/17\/as-2-of-the-marsoc-3-go-on-trial-for-homicide-the-3rd-gets-immunity\/\" target=\"_blank\">under immunity<\/a>, that he carefully assessed Rodriguez and treated him to the best of his ability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gilmet also has been charged with homicide, but wasn\u2019t being tried as part of this case. He previously had asked the Court of Appeals for the Armed Forces to dismiss the charges against him and is awaiting a decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe persecution of these three stellar servicemembers has been marked by a lack of evidence, unlawful command influence, and faulty legal analysis,\u201d Colby Vokey, Gilmet\u2019s lawyer, told Marine Corps Times on Thursday. \u201cGiven the result in the current case, the government should dismiss the case against Chief Gilmet now. &#8230; it\u2019s time to stop this madness and end it once and for all.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Negron and Draher also had faced a dereliction in the performance of duties charge for breaking curfew; the jury also acquitted them of this charge on Wednesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The jury deliberated for a little more than two hours before returning a verdict on Wednesday night, Stackhouse said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Joseph Low IV, Negron\u2019s civilian lawyer, didn\u2019t provide comment to Marine Corps Times by time of publication. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Marine Corps Times was unable to get any comments from family members by time of publication. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The eight-member jury is likely to determine a sentence on Thursday, according to Stackhouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The maximum sentence for violation of a lawful general order is two years\u2019 confinement, a dishonorable discharge and forfeiture of all pay and allowances, according to the courts-martial manual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The maximum for an involuntary manslaughter charge alone would have been much steeper: 10 years\u2019 confinement, a dishonorable discharge and forfeiture of all pay and allowances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution on Thursday declined to comment on the verdict to Marine Corps Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wednesday\u2019s verdict was a \u201chuge relief\u201d for the defense, Stackhouse said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSo much has happened in the last four years,\u201d Stackhouse said. \u201cIt\u2019s hard to understand that it\u2019s over \u2014 and right now it\u2019s not, because there was a finding of guilty on one of the charges. But it\u2019s one of those things where you\u2019ve been living with it, it\u2019s become such a part of you for four years, it\u2019s hard to understand that it\u2019s over.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A military contractor at the time of his death, Rodriguez had earned five Bronze Stars, including one for valor, and five Army Commendation Medals, one for valor, during more than 20 years in the Army. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Draher enlisted in 2001, and his personal decorations include the Purple Heart Medal, Joint Service Commendation Medal, Navy and Marine Commendation with Valor, Joint Service Achievement Medal, Navy Achievement Medal and the Combat Action Ribbon with one gold star, according to the website of advocacy group United American Patriots. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Negron enlisted in 2000; among his decorations are the Bronze Star Medal with Combat Distinguishing Device, Joint Service Commendation Medal, Navy Marine Corps Achievement Medal and three Combat Action Ribbons, according to United American Patriots. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gunnery Sgts.
