Dan Sullivan plans to introduce legislation capping <a href=\"https:\/\/www.marinecorpstimes.com\/news\/pentagon-congress\/2022\/08\/18\/dont-expect-quick-payouts-from-camp-lejeune-water-lawsuits\/\" target=\"_blank\">attorneys\u2019 fees for claims <\/a>related to injuries from water contamination at <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2022\/11\/03\/feds-to-vets-beware-of-scammers-charging-you-to-file-for-benefits\/\" target=\"_blank\">Marine Corps Base Camp Lejeune<\/a>, North Carolina, saying veterans and their families need to be protected from \u201cblood suckers\u201d and predatory lawyers looking to take advantage of them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYou can\u2019t turn on any TV station in America without seeing these ads,\u201d said Sullivan, R-Alaska, during an emotional speech at the Senate Veterans\u2019 Affairs Committee hearing on Wednesday. \u201cI\u2019m hearing they\u2019re charging 40 to 50 percent contingency fees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSo sick Marines get nothing, and trial lawyers get rich.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At issue is a provision signed into law in August as part of the <a href=\"https:\/\/www.militarytimes.com\/news\/burn-pits\/2022\/09\/01\/vets-can-apply-for-all-pact-act-benefits-now-after-va-speeds-up-law\/\" target=\"_blank\">Promise to Address Comprehensive Toxics Act<\/a>, better known as the <a href=\"https:\/\/www.militarytimes.com\/news\/burn-pits\/2022\/10\/25\/nearly-113k-claims-already-filed-for-pact-act-benefits\/\" target=\"_blank\">PACT Act<\/a>.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/marinecorpstimes\/news\/pentagon-congress\/2022\/08\/18\/dont-expect-quick-payouts-from-camp-lejeune-water-lawsuits\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"225\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/IMG_1644.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Don\u2019t expect quick payouts from Camp Lejeune toxic water lawsuits<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Simply serving at Camp Lejeune, North Carolina, during the 25-year eligibility period isn\u2019t enough to guarantee a cash settlement.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The measure includes almost $300 billion in new financial benefits for veterans suffering from illnesses caused by<a href=\"https:\/\/www.militarytimes.com\/news\/burn-pits\/2022\/03\/29\/what-are-military-burn-pits-and-why-are-veterans-worried-about-them\/\" target=\"_blank\"> burn pit smoke <\/a>in Iraq and Afghanistan, Agent Orange spraying in Vietnam, and several other military toxic exposure events.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the legislation also included provisions dubbed the \u201c<a href=\"https:\/\/www.marinecorpstimes.com\/opinion\/commentary\/2022\/08\/10\/camp-lejeune-toxic-water-victims-families-are-now-closer-to-justice\/\" target=\"_blank\">Camp Lejeune Justice Act<\/a>,\u201d which allows civil suits against the government for injuries related to water contamination at the Marine Corps base from August 1953 to December 1987.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the past, Congress adopted legislation easing rules for veterans and their family members who developed rare cancers and other sicknesses to receive health care through the Department of Veterans Affairs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But for families that did not qualify for those benefits \u2014 or for individuals who feel those benefits don\u2019t go far enough \u2014 the Camp Lejeune Justice Act allows them to file civil suits against the government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both Veterans Affairs officials and veterans service organizations have warned in recent months that many lawyers filing suit against the government may not have veterans\u2019 best interest in mind, and that veterans could lose money by suing the government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s because potential cash awards may be offset by benefits already given to the veterans, VA officials said. Attorneys could end up collecting significant fees while veterans see monthly payouts slashed to offset the court judgements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Veterans Affairs officials have worked in recent weeks to encourage veterans to contact the department first to see what benefits they may be eligible for, before signing any agreements with law firms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m certainly not here to disparage any organization or certainly any law firm in terms of them engaging with veterans,\u201d said Charles Tapp, chief financial officer at the Veterans Benefits Administration. \u201cBut veterans have the opportunity to get the support and help they need with filing an initial claim free of charge by reaching out to VA.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sullivan said those public education campaigns aren\u2019t enough, however. He wants lawmakers to fast-track legislation before the end of this year, which would place a 2% cap on filing fees for lawsuits related to the new law and a 10% cap on contingency fees for trial lawyers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf you don\u2019t cap the contingency fees on these unscrupulous lawyers, they\u2019re going to get all the money,\u201d he said. \u201cThere\u2019s going to be billions of dollars going to these predatory law firms at the expense of the United States Marines.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similar legislation was introduced earlier this year, but not included in the final PACT Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sullivan called the plan an urgent need, but several colleagues on the committee were skeptical of his proposed fix, saying the legislation was already approved with bipartisan support.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhen this [provision] was debated, this issue was not brought up at all,\u201d said committee Chairman Jon Tester, D-Mont. \u201cIn the end, it\u2019s the Marine\u2019s choice. And if [a senator] wants to deny them that choice, then, wow.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a making millions off of our veterans.&#039;<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Tester said he is pressing VA officials to step up their outreach efforts to veterans to better educate them on the law and the potential financial problems. \u201cAnd if there are scammers out there, we need to have those folks held accountable.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Committee ranking member Jerry Moran, R-Kansas, said he planned to look into Sullivan\u2019s proposal but stopped short of endorsing the idea.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe next step for me is getting more acquainted with the nature of these claims and finding out whether an attorney is an essential or useful ingredient in getting a result,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA officials are encouraging all veterans and families with questions regarding the Camp Lejeune lawsuits to call their information line at 1-800-827-1000 or <a href=\"https:\/\/www.va.gov\/disability\/eligibility\/hazardous-materials-exposure\/camp-lejeune-water-contamination\/\" target=\"_blank\">visit their web page on the issue<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Individuals can also talk to Department of Justice staffers about cases of false advertising or fraud by calling
