She said she would adopt the official\u2019s proposed findings as final, though would fix a typographical error.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy didn\u2019t immediately respond to a request for comment on Tsuji\u2019s decision. Hawaii law allows parties to appeal such decisions in the court system.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/2021\/12\/16\/top-dod-official-visits-hawaii-base-amid-contaminated-water-crisis\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"158\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Aliamanu_water-distribution.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Top DoD official visits Hawaii base amid contaminated water crisis<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Deputy Secretary of Defense Kathleen Hicks visited the Red Hill Bulk Fuel Storage Facility Dec. 14, speaking with military families and facility workers about the water issue.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The department\u2019s hearings officer for the case, Deputy Attorney General David Day, concluded the tanks were a \u201cticking time bomb\u201d that threaten the water supply on the state\u2019s populous island.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said they posed \u201can imminent threat to human health and safety or the environment\u201d and agreed with the governor\u2019s order to defuel the tanks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy objected to Day\u2019s findings last week, saying he used an \u201coverbroad\u201d interpretation of the Department of Health\u2019s emergency authority to regulate underground fuel storage tanks. The Navy argued the tanks didn\u2019t currently pose an \u201cimminent\u201d threat to human health and the environment.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Navy didn\u2019t
