{"id":35677,"date":"2024-05-28T17:14:37","date_gmt":"2024-05-28T17:14:37","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2024\/05\/28\/marine-veteran-sentenced-to-2-years-for-storming-capitol-on-jan-6\/"},"modified":"2026-08-08T21:08:54","modified_gmt":"2026-08-08T21:08:54","slug":"marine-veteran-sentenced-to-2-years-for-storming-capitol-on-jan-6","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/veterans\/2024\/05\/28\/marine-veteran-sentenced-to-2-years-for-storming-capitol-on-jan-6\/","title":{"rendered":"Marine veteran sentenced to 2 years for storming Capitol on Jan. 6"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A federal judge recently sentenced a Marine Corps veteran who breached the United States Capitol on Jan. 6, 2021, <a href=\"https:\/\/www.justice.gov\/usao-dc\/pr\/texas-man-sentenced-prison-actions-during-jan-6-capitol-breach\" target=\"_blank\">to two years in prison<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Marine veteran Alex Kirk Harkrider, 36, <a href=\"https:\/\/www.justice.gov\/usao-dc\/pr\/texas-man-found-guilty-felony-and-misdemeanor-charges-actions-during-jan-6-capitol\" target=\"_blank\">was convicted in a bench trial<\/a> on Jan. 2 of felony charges of civil disorder and entering a restricted building with a deadly weapon, and misdemeanor charges of theft of government property, disorderly conduct in a Capitol building, and parading or picketing in a Capitol building, according to a Department of Justice release. His sentencing took place on May 23.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Harkrider wore body armor and carried a tactical tomahawk on<b> <\/b>Jan. 6, 2021, as he and Ryan Taylor Nichols entered the Capitol through a broken window.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nichols, 32, was<a href=\"https:\/\/www.justice.gov\/usao-dc\/pr\/texas-man-sentenced-prison-assaulting-law-enforcement-during-jan-6-capitol-breach-1\" target=\"_blank\"> sentenced on May 2<\/a> to more than five years in prison for <a href=\"https:\/\/www.justice.gov\/usao-dc\/pr\/texas-man-sentenced-prison-assaulting-law-enforcement-during-jan-6-capitol-breach-1\" target=\"_blank\">assaulting a law enforcement officer<\/a> during the breach.<\/p>\n\n\n<aside class=\"smg-interstitial-link smg-interstitial-link--fallback wp-block-smg-interstitial-link\"><a href=\"https:\/\/www.armytimes.com\/flashpoints\/extremism-disinformation\/2023\/10\/06\/marine-veteran-agrees-to-plea-deal-in-january-6-capitol-riot-case\/?contentQuery=%7B%22includeSections%22%3A%22%2Fhome%22%2C%22excludeSections%22%3A%22%22%2C%22feedSize%22%3A10%2C%22feedOffset%22%3A605%7D&#038;contentFeatureId=f0fmoahPVC2AbfL-2-1-8\" class=\"smg-interstitial-link__fallback-link\">Marine veteran agrees to plea deal in January 6 Capitol riot case<\/a><\/aside>\n\n\n<p class=\"wp-block-paragraph\">Harkrider traveled from his home of Carthage, Texas, to Washington, D.C., with Nichols in a show of solidarity for former President Donald Trump, according to court documents. They both believed that Trump won the 2020 election despite President Joe Biden\u2019s victory. According to court documents, Harkrider thought \u201cthe election was rigged.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By Jan. 6, 2021, the former president had filed 62 lawsuits in state and federal courts in the aftermath of his 2020 defeat, alleging widespread voter fraud, according to <a href=\"https:\/\/www.usatoday.com\/in-depth\/news\/politics\/elections\/2021\/01\/06\/trumps-failed-efforts-overturn-election-numbers\/4130307001\/\" target=\"_blank\">USA Today<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite his attempts to overturn the election results, out of those 62 lawsuits, Trump only won one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A full list of all <a href=\"https:\/\/electioncases.osu.edu\/case-tracker\/?sortby=filing_date_desc&#038;keywords=&#038;status=all&#038;state=all&#038;topic=25\" target=\"_blank\">cases<\/a> involving the 2020 presidential election results can be found at Ohio State University\u2019s Major Pending Election Cases database, which provides case summaries for election law cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Harkrider and Nichols planned for combat in the days leading up to Jan. 6, 2021, according to the justice department release, with Nichols sending Harkrider a text message about the importance of body armor for protection from bullets.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"992\" height=\"890\" src=\"\/wp-content\/uploads\/2026\/08\/harkriderkilledsc.png.png\" alt=\"\" class=\"wp-image-70782\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/harkriderkilledsc.png.png 992w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/harkriderkilledsc.png.png?resize=300,269 300w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/harkriderkilledsc.png.png?resize=768,689 768w\" sizes=\"auto, (max-width: 992px) 100vw, 992px\" \/><figcaption class=\"wp-element-caption\">A Snapchat photo Harkrider allegedly uploaded during the Capitol breach. (Department of Justice)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">When Nichols texted Harkrider that he had intelligence that Washington would be a \u201cwar zone\u201d and that a battle would ensue, Harkrider said he was looking forward to it and would bring every \u201cfreedom blaster\u201d he owned, according to court documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same documents show they both brought two firearms with them to Washington.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Harkrider and Nichols arrived on Jan. 5, 2021, to protest the election results as Congress sought to verify the vote count for the Electoral College of the 2020 presidential election the following day.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They attended Trump\u2019s speech during the Jan. 6, 2021, \u201cSave America\u201d rally at the Ellipse, a park south of the White House fence, then began their march to the Capitol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After Nichols gave a long impassioned speech about dragging politicians through the streets, Harkrider chimed in, according to court documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCut their freaking head off! You can do it,\u201d said Harkrider, according to court documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Harkrider appeared to be doing a Cajun accent in reference to Rob Schneider\u2019s character in the 1998 film \u201cThe Waterboy\u201d starring Adam Sandler, according to court documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They joined rioters in front of the Lower West Terrace doors, an area where the \u201cmost violent assaults on law enforcement officers\u201d took place, according to the DOJ press release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They then illegally entered the Capitol building, according to court documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A court affidavit alleges that Harkrider shared a photograph on Snapchat of himself while inside the Capitol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019re in. 2 people killed already. We need all the patriots of this country to rally the fuck up and fight for our freedom or it\u2019s gone forever,\u201d read the caption for the photograph provided in the affidavit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Twenty minutes later, they both left the building.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On his way out, Harkrider took a wooden arm from a piece of government furniture,<b> <\/b>according to court documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He kept the souvenir in his nightstand back home.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">FBI agents arrested Harkrider nearly two weeks later on Jan. 18, 2021, in Carthage, Texas.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"612\" height=\"792\" src=\"\/wp-content\/uploads\/2026\/08\/Harkrider.jpg.jpg\" alt=\"\" class=\"wp-image-70786\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Harkrider.jpg.jpg 612w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Harkrider.jpg.jpg?resize=232,300 232w\" sizes=\"auto, (max-width: 612px) 100vw, 612px\" \/><figcaption class=\"wp-element-caption\">A booking photo of Alex K. (Gregg County Sheriff&#8217;s Office)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Harkrider was a veteran at the time of his arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He served as a rifleman from 2008 to 2012 and deployed twice, according to his service record. His awards included the Combat Action Ribbon, National Defense Service Medal, and Global War on Terrorism Service Medal, among others. He also was a two-time recipient of the Navy Unit Commendation and Sea Service Deployment Ribbon.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He was last assigned to the 3rd Battalion, 9th Marine Regiment, 2nd Marine Division at Camp Lejeune, North Carolina.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An estimated 1,424 individuals have been charged for their part in the Jan. 6, 2021, Capitol breach, according to the justice department. Five hundred of those individuals have been charged with assault of a law enforcement officer. The investigation into \u201cJanuary 6 violence at the U.S. Capitol\u201d is ongoing, according to the FBI website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Harkrider\u2019s defense attorney, Kira Anne West, argued during the District Court for the District of Columbia trial<b> <\/b>that Harkrider was unaware of a march to the Capitol until the very moment Trump encouraged attendees at the Ellipse rally to do so. She said Harkrider\u2019s tomahawk was for self-defense against Antifa and Black Lives Matter protesters that reports informed him would be there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">West argued that Harkrider only entered the Capitol at the behest of individuals behind him who yelled for him to jump in to avoid tear gas from canisters that were set off.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She said her client and Nichols only stayed inside the Capitol for a few minutes, then walked to their Uber pick-up zone, got in a car, and returned to their hotel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere was a great deal of confusion that day,\u201d said West in court documents, defending Harkrider\u2019s actions as those of a patriot protesting for his county.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMr. Harkrider\u2019s taken responsibility for his actions and that\u2019s it,\u201d West told Marine Corps Times<b> <\/b>on May 24 in a phone interview.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She commended him for being a great American and said the judge acknowledged it in the sentencing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Harkrider suffers from post-traumatic stress disorder, anxiety, and depression because, West said, he served the country in Afghanistan and Iraq.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Overall, she was proud of her time defending Harkrider.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt was an honor and pleasure to represent a native Texan and a U.S. Marine,\u201d said West.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Marine vet Alex Harkrider wore body armor and carried a tactical tomahawk on Jan. 6, 2021, as he and a friend entered the Capitol through a broken window.<\/p>\n","protected":false},"author":7,"featured_media":70779,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_yoast_wpseo_meta-robots-noindex":"","_yoast_wpseo_meta-robots-nofollow":"","_yoast_wpseo_canonical":"","_acf":"","_yoast_wpseo_primary_category":19,"_jetpack_feature_clip_id":0,"_jetpack_memberships_contains_paid_content":false,"footnotes":"","_smg_distribution_targets":{"2":{"categories":["veterans","disaster","your-military","news"],"primary_category":"veterans"}}},"categories":[22,12,19,69],"tags":[],"coauthors":[3408],"class_list":["post-35677","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-disaster","category-news","category-veterans","category-your-marine-corps"],"acf":{"subheadline":"Alex Kirk Harkrider will serve two years in prison for multiple felony and misdemeanor charges.
