Klein repeatedly assaulted officers, urged other rioters to join the fray and tried to stop police from shutting entrance doors, according to federal prosecutors.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/federal-oversight\/doj-fbi\/2023\/09\/20\/marine-vet-ray-epps-charged-over-capitol-riot\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP23262553712934.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Marine veteran Ray Epps pleads guilty to Capitol riot charge<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Ray Epps, who claimed in a lawsuit that Fox News made him a scapegoat for the Capitol riot, was charged with disorderly conduct on restricted grounds.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Klein \u201cwaged a relentless siege on police officers\u201d as he tried to enter the Capitol and stop Congress from certifying Joe Biden\u2019s electoral victory over Trump, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.234329\/gov.uscourts.dcd.234329.717.0.pdf\">prosecutors said in a court filing<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Klein, who didn\u2019t testify at his trial, declined to address the court before U.S. District Judge Trevor McFadden sentenced him to five years and 10 months in prison.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYour actions on January 6th were shocking and egregious,\u201d the judge told Klein.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">McFadden also ordered Klein to pay a $3,000 fine and $2,000 in restitution. (AP Photo\/Jose Luis Magana, File)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors said Klein\u2019s participation in the riot was likely motivated by a desire to keep his job as a presidential appointee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAs an employee of the federal government, Klein was endowed with the trust of the American people and to uphold the law. He violated that trust on January 6 when he attacked the very country for which he was paid to work,\u201d prosecutors wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defense attorney Stanley Woodward has accused prosecutors of exaggerating Klein\u2019s role in the riot due to his political connection to the Trump administration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAccordingly, Mr. Klein should be sentenced for his actual role in the events of the day, and not the more egregious conduct of others with which the government would have Mr. Klein be found guilty by association,\u201d <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.234329\/gov.uscourts.dcd.234329.719.0.pdf\">Woodward wrote<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors had recommended a 10-year prison sentence for Klein, an Alexandria, Virginia, resident who was 42 years old at the time of the riot. Klein was <a href=\"https:\/\/apnews.com\/article\/donald-trump-capitol-siege-3d6dbd70d3cd421663991a9287e32f12\">arrested in March 2021<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In July 2023, <a href=\"https:\/\/apnews.com\/article\/capitol-riot-trial-federico-klein-steven-cappuccio-a5393867e51072c059cf6390bb03892c\">McFadden heard trial testimony without a jury<\/a> before he convicted Klein and a co-defendant, Steven Cappuccio, of assault charges and other Capitol riot-related offenses.<\/p>\n\n\n<aside class=\"smg-interstitial-link smg-interstitial-link--fallback wp-block-smg-interstitial-link\"><a href=\"https:\/\/www.federaltimes.com\/flashpoints\/extremism-disinformation\/2023\/06\/15\/marine-veteran-pleads-guilty-to-jan-6-capitol-assault-charge\/\" class=\"smg-interstitial-link__fallback-link\">Marine veteran pleads guilty to Jan 6. Capitol assault charge<\/a><\/aside>\n\n\n<p class=\"wp-block-paragraph\">Klein and Cappuccio were among nine defendants charged in a 53-count indictment. The judge convicted Klein of 12 counts, including six assault charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">McFadden is scheduled to sentence Cappuccio later on Friday. McFadden allowed Klein to remain free under house arrest after his conviction but ordered Cappuccio to be jailed immediately after the verdict.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.234328\/gov.uscourts.dcd.234328.718.0.pdf\">Prosecutors recommended a prison sentence<\/a> of 10 years and one month for Cappuccio, who was arrested at his home in Universal City, Texas, in August 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Klein and Cappuccio separately attended Trump\u2019s \u201cStop the Steal\u201d rally on Jan. 6 before marching to the Capitol. Klein was in the first wave of rioters to enter the tunnel, according to prosecutors. They said he pushed hard against officers, telling them, \u201cYou can\u2019t stop this!\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Klein also wedged a stolen police riot shield between two doors, preventing officers from closing them, prosecutors said. Video captured Klein encouraging other rioters to attack police, repeatedly yelling, \u201cWe need fresh people!\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">McFadden told Klein on Friday that his conduct \u201cprolonged the mayhem\u201d in the tunnel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYou were front and center in that chaos,\u201d the judge said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cappuccio yelled, \u201cStorming the castle, boys!\u201d and chanted, \u201cFight for Trump!\u201d and \u201cOur house!\u201d as he reached the Lower West Terrace. In the tunnel, he joined other rioters in pushing against the police line, prosecutors said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When another rioter pinned Metropolitan Police Officer Daniel Hodges against a door, Cappuccio ripped a gas mask off the officer\u2019s face and dislodged his helmet, prosecutors said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Klein, who served in the Marine Corps for roughly nine years, was deployed to Iraq as a combat engineer in 2005. In January 2017, he went to work for the State Department as a desk officer specializing in the South American region.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Klein also worked for Trump\u2019s 2016 campaign and took time off from work after the 2020 presidential election and traveled to Nevada to help investigate the baseless claims of voter fraud promoted by Trump and his allies, prosecutors said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/interactives.ap.org\/jan-6-prosecutions\/\">Nearly 1,200 people have been charged with Capitol riot-related federal crimes<\/a>. Over 800 of them have pleaded guilty or been convicted by a jury or judge after a trial.
