WASHINGTON \u2014 The U.S. government acknowledging Thursday that it has detained an American citizen accused of fighting with the Islamic State for more than two months without fulfilling his request to see a lawyer.<\/p>\n\n\n\n
Responding to a court order, the government said the man picked up on the Syrian battlefield indicated he was willing to talk to FBI agents but \u201cfelt he should have an attorney present.\u201d<\/p>\n\n\n\n
The unidentified American, who has not been charged, surrendered to U.S.-backed fighters in Syria around Sept. 12 and is currently being held in Iraq as an unlawful enemy combatant.<\/p>\n\n\n\n
The American Civil Liberties Union recently filed a court petition challenging his detention and asking to act on his behalf to provide him access to legal counsel.<\/p>\n\n\n\n
The detainee was in a legal \u201cblack hole,\u201d Jonathan Hafetz, a senior staff attorney with the ACLU in New York, told U.S. District Judge Tanya Chutkan.<\/p>\n\n\n\n
The judge repeatedly asked Kathryn Wyer, an attorney in the Justice Department\u2019s civil division, whether the detainee had requested an attorney or had been advised of his constitutional rights. When Wyer wouldn\u2019t answer the questions, the judge ordered the government to respond by 5 p.m.<\/p>\n\n\n\n
The government met the deadline with a two-page response.<\/p>\n\n\n\n
It said that during questioning, FBI special agents advised the detainee of his right to remain silent even though he might have spoken earlier to other interrogators. That was an apparent reference to intelligence agents who are believed to have questioned the detainee first.<\/p>\n\n\n\n
The government said the detainee also was advised of his right to an attorney.<\/p>\n\n\n\n
\u201cThe individual stated he understood his rights and said he was willing to talk to the agents, but also stated that since he was in a new phase (of questioning), he felt he should have an attorney present,\u201d the government said.<\/p>\n\n\n\n
When the agents told the detainee it was unclear when he would be able to get an attorney, he \u201cstated that it was OK and that he is a patient man,\u201d the government said.<\/p>\n\n\n\n
The detainee later said he \u201cdid not wish to speak with agents of the FBI\u201d at all, the government said. No further questioning for law enforcement purposes has occurred.<\/p>\n\n\n\n
\u201cThis admission by the government reinforces our demand that the citizen be given access to a lawyer, which is his fundamental right under the Constitution,\u201d Hafetz said. \u201cThe Trump administration\u2019s position that it can lock up an American in secret without charges or the ability to challenge the detention in court is not how our legal system works.\u201d<\/p>\n\n\n\n
During the morning court hearing, Wyer told the court that the U.S. military was working \u201cdiligently\u201d on the matter, but had not yet decided what to do with the detainee. Wyer cited case law stating the executive branch should be given a reasonable period of time to determine a detained individual\u2019s status.<\/p>\n\n\n\n
\u201cTwo and a half months?\u201d the judge asked, before giving her until 5 p.m. to provide the answers.<\/p>\n\n\n\n
The judge asked how long the government thought it should be able to hold someone without a lawyer. That kind of \u201cunchecked power\u201d is \u201cquite frankly, frightening,\u201d Chutkan said.<\/p>\n\n\n\n
The International Committee of the Red Cross visited the detainee on Sept. 29 and Oct. 23, but has not disclosed details of those contacts. Hafetz said the Red Cross\u2019 mission is not to obtain legal counsel for detainees it meets. He also said there is no indication the detainee wants to or could contact relatives or whether they would be willing to risk reprisal by seeking a lawyer for him.<\/p>\n\n\n\n
Stephen Vladeck, a law professor at the University of Texas at Austin, said the case has created a quandary for American officials.<\/p>\n\n\n\n
\u201cThe Pentagon wants the Justice Department to prosecute him, but Justice officials have been reluctant to take custody of him without more evidence,\u201d Vladeck said in an op-ed published Thursday in The New York Times. \u201cThe man, meantime, has languished in an Iraqi jail … but with no contact with the outside world beyond two visits from the Red Cross.\u201d<\/p>\n\n\n\n
