{"id":49862,"date":"2020-12-23T20:15:59","date_gmt":"2020-12-23T20:15:59","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2020\/12\/23\/judge-premature-to-block-midshipmans-expulsion-over-tweets\/"},"modified":"2026-08-08T09:49:46","modified_gmt":"2026-08-08T09:49:46","slug":"judge-premature-to-block-midshipmans-expulsion-over-tweets","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/news\/2020\/12\/23\/judge-premature-to-block-midshipmans-expulsion-over-tweets\/","title":{"rendered":"Judge: Premature to block midshipman\u2019s expulsion over tweets"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">COLLEGE PARK, Md. \u2014 A federal <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/11\/01\/naval-academy-midshipman-asks-judge-to-block-his-removal-over-tweets\/\" target=_blank>judge in Baltimore has ruled<\/a> that it is premature for her to decide whether to block the U.S. Naval Academy from expelling a midshipman for posting social media messages deemed to be crude, noting a senior Navy official has not made a final disciplinary decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. District Judge Ellen Hollander agreed Tuesday to dismiss <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/10\/02\/midshipman-sues-naval-academy-over-discipline-for-tweets\/\" target=_blank>Chase Standage\u2019s lawsuit<\/a> and denied the 21-year-old midshipman\u2019s request for a preliminary injunction allowing him to graduate from the academy. She dismissed the case \u201cwithout prejudice,\u201d which means Standage can try to revive his claims after a later stage in his disciplinary proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The academy\u2019s superintendent recommended disenrolling the white midshipman <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/06\/18\/naval-academy-opens-investigation-into-midshipmans-social-media-posts\/\" target=_blank>over a string of tweets<\/a>, including one in which he said Breonna Taylor received \u201cjustice\u201d on the day police in Louisville, Kentucky, killed the Black woman during a drug raid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standage sued to block his separation from the academy, claiming it violated his First Amendment right to freely express his views. But the judge concluded Standage\u2019s claims are not \u201cripe\u201d because his case has not been decided yet by a more senior official: Catherine Kessmeier, Assistant Secretary of the Navy for Manpower and Reserve Affairs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAnd, it is pure conjecture as to whether the Assistant Secretary will accept, reject, or modify the Superintendent\u2019s determination that plaintiff\u2019s tweets constitute unsatisfactory conduct warranting his discharge from the Academy,\u201d Hollander wrote in her 59-page ruling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standage\u2019s lawsuit also claims academy leaders violated his Fifth Amendment right to due process, denying him a fair and impartial disciplinary hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He is accused of violating academy rules governing political activity and of engaging in conduct unbecoming a midshipman. The academy\u2019s superintendent, Vice Adm. Sean Buck, determined that plaintiff\u2019s tweets constituted \u201cunsatisfactory conduct\u201d and recommended his discharge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a hearing in October, the judge said Standage\u2019s posts were \u201cdistasteful at best\u201d and demonstrated poor judgment, but she questioned why he faces \u201cthe most draconian sanction he could get\u201d when the academy explicitly permits midshipmen to express their personal opinions on social media.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt appears that people in charge didn\u2019t like his point of view. Not the way he said it but what he said,\u201d Hollander said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standage, a California native, is the son of two Los Angeles Police Department officers. He says he feared for their safety during the week in June when he posted the tweets in question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhy is it taking so long for Breonna Taylor to receive her justice?\u201d a Twitter user posted in June.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHer justice was received on March 13, 2020,\u201d Standage replied, referring to the day of the deadly raid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Academy investigators also singled out several other tweets in which Standage advocated using lethal force against civilians.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAll it takes is one drone strike,\u201d he tweeted in response to another user\u2019s post about \u201cantifa extremists\u201d in Seattle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standage posted under the username \u201cCheese Sandwich\u201d and did not identify himself as a midshipman in the posts, but his Twitter handle was @ChaseStandage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cmdr.
