{"id":65974,"date":"2022-11-22T17:24:52","date_gmt":"2022-11-22T17:24:52","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2022\/11\/22\/va-stands-by-abortion-policy-after-legal-threats-from-state-leaders\/"},"modified":"2026-08-08T14:33:35","modified_gmt":"2026-08-08T14:33:35","slug":"va-stands-by-abortion-policy-after-legal-threats-from-state-leaders","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/veterans\/2022\/11\/22\/va-stands-by-abortion-policy-after-legal-threats-from-state-leaders\/","title":{"rendered":"VA stands by abortion policy after legal threats from state leaders"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Veterans Affairs leaders aren\u2019t planning any changes in their <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/\" target=\"_blank\">abortion access rules<\/a> in the wake of warnings from 15 Republican attorneys general that they plan to <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/09\/07\/advocates-draw-battle-lines-ahead-of-looming-va-abortion-fight\/\" target=\"_blank\">fight those policies<\/a> in court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last week, the coalition of state officials sent a letter to <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/11\/14\/va-secretary-makes-promise-we-will-be-vets-best-advocates\/\" target=\"_blank\">VA Secretary Denis McDonough<\/a> blasting the administration\u2019s \u201clawless and hasty executive actions taken at the behest of its political base\u201d concerning abortion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe will not allow you to use this rule to erect a regime of elective abortions that defy state laws,\u201d <a href=\"https:\/\/files.constantcontact.com\/6b6ea99f701\/b8bc7f90-39b4-4085-bc66-64b3fa5ae8a7.pdf\" target=\"_blank\">the group wrote<\/a>. \u201cAnd we will enforce our duly enacted state laws and hold you accountable for violations of federal law. Those who perform abortions based on the [new] rule \u2014 and in defiance of state or federal laws \u2014 do so at their own risk.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1242677087.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">VA to provide abortions in cases of rape, danger to veteran\u2019s health<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Abortions could be conducted at VA medical centers, even in states where the procedure is outlawed.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The letter was sent from the office of Mississippi Attorney General Lynn Fitch but also includes signers from Texas and Florida, two states with the largest veteran populations in America. Officials from Arizona, Ohio, Arkansas, Georgia, Indiana, Kentucky, Nebraska, North Dakota, South Carolina, Tennessee, Utah and West Virginia also signed on.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In September, VA officials announced that department physicians would offer abortion access to veterans and eligible dependents in cases of rape, incest and pregnancies that endanger the life or health of an individual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That move came in response to the June Supreme Court ruling overturning the 1973 Roe v. Wade decision that legalized abortion nationwide. Since then, multiple states have banned or limited the procedure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA officials said the new rule means that staff can help veterans get an abortion at an outside health care facility or perform abortions on federal property, even in states where the procedure has been outlawed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The department has conducted several abortions since the decision, although officials did not provide specific numbers or locations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement in response to the attorneys general letter, VA Press Secretary Terrence Hayes said the department remains \u201ccommitted to providing veterans the full range of reproductive health services to ensure their health and well-being.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those services include not only abortion procedures but also fertility services, contraceptives and menopause care, he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cVA provides access to abortion counseling and abortions when the life or health of the pregnant veteran would be endangered if the pregnancy were carried to term or when the pregnancy is the result of rape or incest,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAs VA Secretary Denis McDonough has said, \u2018pregnant veterans and VA beneficiaries deserve to have access to world-class reproductive care when they need it most..\u2019\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/09\/07\/advocates-draw-battle-lines-ahead-of-looming-va-abortion-fight\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"225\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/IMG_7688.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Advocates draw battle lines ahead of looming VA abortion fight<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Department hospitals are set to begin offering abortions in coming weeks.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">VA officials have said the new rule will not allow \u201celective\u201d abortions, but the language allows abortion procedures to be considered when a veteran\u2019s health is endangered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Multiple Republican lawmakers have threatened to impose financial sanctions against the department when they take control of the House majority next year.
