{"id":66153,"date":"2020-03-13T08:00:23","date_gmt":"2020-03-13T08:00:23","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2020\/03\/13\/trump-administration-right-to-proceed-cautiously-with-agent-orange-benefit-expansion\/"},"modified":"2026-08-08T14:38:07","modified_gmt":"2026-08-08T14:38:07","slug":"trump-administration-right-to-proceed-cautiously-with-agent-orange-benefit-expansion","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/opinion\/commentary\/2020\/03\/13\/trump-administration-right-to-proceed-cautiously-with-agent-orange-benefit-expansion\/","title":{"rendered":"Trump administration right to proceed cautiously with Agent Orange benefit expansion"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Trump administration \u2014 specifically the <a href=\"https:\/\/www.veterans.senate.gov\/newsroom\/minority-news\/stop-turning-your-backs-on-vietnam-vets-who-are-suffering-tester-colleagues-slam-acting-white-house-chief-mulvaney-\" target=\"_blank\">Office of Management and Budget<\/a> (OMB) and <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2020\/02\/12\/agent-orange-decision-delay-draws-criticism\/\" target=\"_blank\">Department of Veterans Affairs<\/a> (VA) \u2014 has been criticized for not rushing to expand the number of medical conditions \u201cpresumed\u201d to be caused by <a href=\"https:\/\/www.publichealth.va.gov\/exposures\/agentorange\/\" target=\"_blank\">exposure to Agent Orange<\/a>, an herbicide used during the Vietnam War.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The administration is wise to proceed with caution. Expanding the list of diseases presumed to have been caused by exposure to Agent Orange should be dictated by science, not politics. If the list is expanded in a haphazard or rushed manner, veterans will be hurt in the long run. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.duckworth.senate.gov\/news\/press-releases\/duckworth-durbin-slam-trump-administration-for-stonewalling-veterans-suffering-from-agent-orange\" target=\"_blank\">Some lawmakers<\/a> in Washington would have you believe the administration is casting Vietnam veterans aside, denying them care and ignoring their ailments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That could not be further from the truth. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Based on <a href=\"https:\/\/www.va.gov\/health-care\/eligibility\/priority-groups\/\" target=_blank>the VA\u2019s current health care eligibility rules<\/a>, Vietnam veterans have access to VA care, and all enrolled veterans can be treated for health conditions that aren\u2019t service connected. As a result, the VA is already providing medical treatment for enrolled Vietnam veterans suffering from hypertension, hypothyroidism, bladder cancer, and Parkinsonism \u2014 the four conditions that are under consideration for Agent Orange presumption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current debate around Agent Orange presumption is centered on disability benefits \u2014 the rating and subsequent compensation given to veterans by the VA upon review of their service-connected health issues. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After evaluation, the VA assigns a disability rating to a veteran with an injury or illness related to their military service. Sometimes that rating is easy to determine because there is a direct link between an event and the resulting health issue. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But in the case of Agent Orange exposure, the link is often not so clear. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Studies completed in 2016 and 2018 by <a href=\"http:\/\/www.nationalacademies.org\/hmd\/Reports\/2016\/Veterans-and-Agent-Orange-Update-2014.aspx\" target=_blank>the National Academies of Sciences<\/a>, Engineering and Medicine are often cited to justify expansion of Agent Orange presumption, but they are not as conclusive as some claim. The studies found \u201climited or suggestive evidence\u201d and failed to establish <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2020\/01\/28\/va-disputes-science-panels-findings-on-proposed-agent-orange-diseases-decision-not-expected-until-late-2020\/\" target=_blank>direct, causal links <\/a>between Agent Orange exposure and the four conditions under consideration for presumption. Furthermore, occurrences of hypertension and bladder cancer are heavily impacted by lifestyle choices, such as tobacco use and diet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Expanding benefits for Agent Orange exposure despite continued gaps in research sets a bad precedent. If benefits are determined based on incomplete science, those with an illness or injury definitively caused by their service may suffer. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the Obama administration, the VA expanded the list of illnesses presumed to be caused by Agent Orange. This decision contributed to <a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/despite-backlogs-va-disability-claims-processors-get-bonuses\/2013\/08\/25\/1be00a28-0cea-11e3-9941-6711ed662e71_story.html\" target=_blank>a massive backlog of disability claims<\/a> that overwhelmed the VA. Hundreds of thousands of veterans \u2014 including many wounded during the height of the wars in Iraq and Afghanistan \u2014 waited years to have their claims adjudicated. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adding new diseases to the list of Agent Orange-related illnesses, even though those conditions can\u2019t be definitively linked to exposure at this time, would almost certainly create another backlog of claims. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not only would expanding benefits possibly crowd out other veterans from timely claims processing, there is also the cost to consider.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The recent expansion of Agent Orange benefits to Blue Water Navy veterans is estimated by the Congressional Budget Office to potentially cost between <a href=\"https:\/\/about.bgov.com\/news\/costs-of-expanding-agent-orange-vet-benefits-perplexing-congress\/\" target=\"_blank\">$1.4 billion to $4.2 billion over 10 years<\/a>. An expansion of Agent Orange presumption could cost upwards of $15 billion more \u2014 a fact that cannot be ignored in an era of trillion-dollar deficits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Holding off expanding presumption until we have more complete information on the link between Agent Orange and certain diseases is the responsible thing to do. <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2020\/01\/06\/study-results-on-new-agent-orange-diseases-not-expected-until-late-2020-says-va-secretary\/\" target=_blank>More data will be available<\/a> with the release of the Vietnam-Era Mortality Study and Vietnam-Era Health Retrospective Observational Study later this year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vietnam veterans will not be denied care. They already qualify for VA health care and a delay in a decision on presumption won\u2019t change that. Additionally, if a disease is found to be caused by Agent Orange exposure, those affected will retroactively be compensated from the date they first filed a disability claim. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To do right by our veterans, we must listen to science and make rational decisions based on proven practices that ensure veterans who were harmed during their service get the compensation they deserve. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>Darin Selnick served as veteran affairs adviser on President Trump\u2019s Domestic Policy Council and as senior adviser to the VA secretary.
