{"id":67196,"date":"2023-01-24T02:24:13","date_gmt":"2023-01-24T02:24:13","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2023\/01\/24\/four-more-oath-keepers-including-army-vet-convicted-in-jan-6-riot\/"},"modified":"2026-08-08T14:46:40","modified_gmt":"2026-08-08T14:46:40","slug":"four-more-oath-keepers-including-army-vet-convicted-in-jan-6-riot","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/veterans\/2023\/01\/24\/four-more-oath-keepers-including-army-vet-convicted-in-jan-6-riot\/","title":{"rendered":"Four more Oath Keepers, including Army vet, convicted in Jan. 6 riot"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Four members of the Oath Keepers were convicted Monday of seditious conspiracy in&nbsp;<a href=\"https:\/\/apnews.com\/hub\/capitol-siege\" target=\"_blank\">the Jan. 6, 2021, Capitol attack<\/a>&nbsp;in the second major trial of far-right extremists accused of plotting to forcibly keep President Donald Trump in power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The verdict against Joseph Hackett of Sarasota, Florida; Roberto Minuta of Prosper, Texas; David Moerschel of Punta Gorda, Florida; and Edward Vallejo of Phoenix comes weeks after after a different jury&nbsp;<a href=\"https:\/\/www.militarytimes.com\/news\/2022\/11\/30\/oath-keepers-rhodes-guilty-of-jan-6-seditious-conspiracy\/\" target=\"_blank\">convicted the group\u2019s leader, Stewart Rhodes, in the mob\u2019s attack<\/a>&nbsp;that halted the certification of President Joe Biden\u2019s electoral victory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s another major victory for the Justice Department, which is also trying to secure sedition convictions against the former leader of the Proud Boys and four associates.&nbsp;<a href=\"https:\/\/apnews.com\/article\/biden-politics-violence-proud-boys-donald-trump-9db4507b29d7102e40f24af7262ae7d2\" target=\"_blank\">The trial against Enrique Tarrio and his lieutenants<\/a>&nbsp;opened earlier this month in Washington and is expected to last several weeks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Washington jury deliberated for about 12 hours over three days before delivering their guilty verdict on the rarely used charge, which carries up to 20 years in prison. The four were also convicted of two other conspiracy charges as well as obstructing an official proceeding: Congress\u2019 certification of the 2020 election. Minuta, Hackett and Moerschel were acquitted of lesser charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge didn\u2019t immediately set a date for sentencing. The judge denied prosecutors\u2019 bid to lock up the men while they await sentencing, finding them not to be a risk of flight. They were ordered to remain in home detention with electronic monitoring.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2022\/09\/07\/military-personnel-among-names-in-leaked-oath-keepers-membership-list\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"162\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/oathkeeper.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Military personnel among names in leaked Oath Keepers membership list<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Those named in the report ranged from junior personnel to officers and senior enlisted.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">It was one of the most serious cases brought so far in the sweeping Jan. 6 investigation,&nbsp;<a href=\"https:\/\/apnews.com\/article\/politics-legal-proceedings-crime-new-york-city-donald-trump-7aae07e782e884167579dc9d4b7a4100\" target=\"_blank\">which continues to grow two years after the riot<\/a>. The Justice Department has charged nearly 1,000 people in the riot and the tally increases by the week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Attorney General Merrick Garland told reporters after the verdict that he is \u201cgrateful to the prosecutors, agents and staff for their outstanding work.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Oath Keepers leader Rhodes and Florida chapter leader Kelly Meggs were convicted of seditious conspiracy in the previous trial that ended in November. They were the first people in decades found guilty at trial of the Civil War-era charge. Three other Oath Keepers were cleared of the charge in that case but were found guilty of other serious crimes. They are all awaiting sentencing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawyers for Moerschel and Minuta suggested after the verdict that their clients were hurt by not being able to stand trial alongside Rhodes because the judge split the case into two groups. Moerchel\u2019s lawyer, Scott Weinberg, said he could have pointed to Rhodes as the \u201creal bad guy.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI think it would be easier to be a low-level person in the same case as Stewart Rhodes, who is basically the figurehead of of this organization,\u201d Weinberg said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">William Shipley Jr., Minuta\u2019s attorney, said he was disappointed and \u201csomewhat puzzled\u201d by the verdict. He said the government\u2019s witnesses didn\u2019t stand up to scrutiny and there were gaps in the evidence presented.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe didn\u2019t really think that in the 15 days of trial testimony the government really had a good day,\u201d Shipley said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vallejo left the courthouse without speaking to reporters. Joseph Hackett\u2019s attorney, Angela Halim, declined to comment after the verdict.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe got a trial by residents of a small judicial district who in one way or another were almost all impacted by the events of January 6th,\u201d Shipley said. \u201cI think that raises some real troubling issues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors told jurors that Rhodes and his band of extremists began shortly after the 2020 election to prepare an armed rebellion to keep Trump in power. The weapons were never used.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Defense attorneys sought to downplay violent messages as mere bluster and said the Oath Keepers came to Washington to provide security at events before the riot. They seized on prosecutors\u2019 lack of evidence that the Oath Keepers had an explicit plan to storm the Capitol before Jan. 6 and told jurors that the extremists who attacked the Capitol acted spontaneously like thousands of other rioters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey left evidence out and they picked and chose what they wanted,\u201d said William Lee Shipley, an attorney for Minuta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors argued that while there is not evidence specifically spelling out a plan to attack the Capitol, the Oath Keepers saw the riot as a means to an end and sprung into action at an apparent opportunity to help keep Trump in power.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hackett, Moerschel and other Oath Keepers approached the Capitol in a military-style stack formation before they entered the building, according to prosecutors. Minuta and his group from a second stack of Oath Keepers clashed with police after heeding Rhodes\u2019 call to race to the Capitol, according to court documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors said that Vallejo, a U.S. Army veteran and Rhodes ally, drove from Arizona to prepare with the \u201cQRF\u201d \u2014 the quick reaction force \u2014 at the hotel outside Washington. Jurors heard an audio recording of Vallejo talking about a \u201cdeclaration of a guerilla war\u201d on the morning of Jan. 6.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Three other Oath Keepers have pleaded guilty to seditious conspiracy and agreed to cooperate with prosecutors in the hopes of getting a lighter sentence. They are among about 500 people who have pleaded guilty to riot-related charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>Richer reported from Boston.
