{"id":69215,"date":"2022-12-14T18:07:02","date_gmt":"2022-12-14T18:07:02","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2022\/12\/14\/va-employee-sues-department-over-new-abortion-policy\/"},"modified":"2026-08-08T14:20:53","modified_gmt":"2026-08-08T14:20:53","slug":"va-employee-sues-department-over-new-abortion-policy","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/veterans\/2022\/12\/14\/va-employee-sues-department-over-new-abortion-policy\/","title":{"rendered":"VA employee sues department over new abortion policy"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A Veterans Affairs health care employee working in Texas sued the department Wednesday over its <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/\" target=\"_blank\">new abortion policy<\/a>, saying the change violates her religious beliefs as well as state law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit is the first of <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/11\/22\/va-stands-by-abortion-policy-after-legal-threats-from-state-leaders\/\" target=\"_blank\">numerous expected legal challenges<\/a> to <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/12\/09\/va-plans-week-of-action-to-highlight-new-toxic-exposure-benefits\/\" target=\"_blank\">VA officials\u2019<\/a> announcement in September that they would offer <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/09\/15\/republicans-threaten-lawsuits-budget-penalties-over-va-abortion-move\/\" target=\"_blank\">abortion access<\/a> to veterans and eligible dependents in cases of rape, incest and pregnancies that endanger the life or health of an individual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA facilities began performing some abortions in the weeks after the policy change, although officials have not released numbers on how many of the procedures have been carried out.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1242677087.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">VA to provide abortions in cases of rape, danger to veteran\u2019s health<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Abortions could be conducted at VA medical centers, even in states where the procedure is outlawed.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Department officials have also insisted that because they are on federal property, their operations are not bound by state laws. Republican attorneys general in multiple states have vowed to challenge that claim and prosecute physicians who perform abortions at VA facilities in states where the practice is outlawed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiff in the Texas lawsuit \u2014 Stephanie Carter, a nurse practitioner at the Olin E. Teague Veterans\u2019 Center in Temple \u2014 is a 23-year VA employee and Army veteran who says in legal filings that she cannot \u201cwork in a facility that performs abortion services for reasons other than to save the life of the mother because \u2026 unborn babies are created in the image of God and should be protected.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit was filed on Carter\u2019s behalf by First Liberty Institute, a nonprofit Christian conservative legal group based in Texas. In a statement, officials said the new policy violates a host of religious liberty protections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is unconscionable that the Biden administration would force health care workers at VA facilities to violate their consciences,\u201d said Danielle Runyan, senior counsel for the institute. \u201cThe VA should be focused on caring for the men and women who bravely served to protect our country, not on performing illegal abortions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement, VA Press Secretary Terrence Hayes said he would not directly comment on the ongoing litigation, but said that supervisors are working with staff who object to the abortion decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFrom the moment VA announced this new rule, Secretary [Denis] McDonough has made clear to all employees that their religious beliefs are protected here at VA,\u201d he said. \u201cWe are currently honoring exemption requests that come through VA supervisors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe have provided all VA health care employees with this information \u2026 and have encouraged employees to inform their supervisors of any requests for exemptions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit (filed in the U.S. District Court for the Western District of Texas) alleges that allowing abortions at VA facilities \u201csubstantially burdens Ms. Carter\u2019s sincerely held religious beliefs and forces her to choose between her job and her religious convictions.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/09\/15\/republicans-threaten-lawsuits-budget-penalties-over-va-abortion-move\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1241943815.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Republicans threaten lawsuits, budget penalties over VA abortion move<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The department has said it will offer abortions in cases of rape, incest and threats to a veterans&#039; life or health.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">It also states that Carter was denied accommodations by her supervisor to opt out of handling and distributing medications that could be used to end a pregnancy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit asks for the court to block all abortions at the Texas VA facility. Department officials have said the policy change was needed because of the growing number of states looking to block access to abortions in the wake of last summer\u2019s Supreme Court ruling overturning Roe v.
