{"id":72584,"date":"2023-11-21T17:12:03","date_gmt":"2023-11-21T17:12:03","guid":{"rendered":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/uncategorized\/2023\/11\/21\/transgender-vets-threaten-to-sue-va-over-delay-in-surgery-options\/"},"modified":"2026-08-08T15:51:23","modified_gmt":"2026-08-08T15:51:23","slug":"transgender-vets-threaten-to-sue-va-over-delay-in-surgery-options","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/marinecorpstimes\/veterans\/2023\/11\/21\/transgender-vets-threaten-to-sue-va-over-delay-in-surgery-options\/","title":{"rendered":"Transgender vets threaten to sue VA over delay in surgery options"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Veterans advocates are threatening legal action to force <a href=\"https:\/\/www.militarytimes.com\/military-honor\/salute-veterans\/2023\/11\/08\/mcdonough-wants-va-to-reach-every-veteran-in-the-country\/\" target=\"_blank\">Veterans Affairs officials<\/a> to provide <a href=\"https:\/\/www.militarytimes.com\/veterans\/2021\/06\/19\/va-to-offer-gender-surgery-to-transgender-vets-for-the-first-time\/\" target=\"_blank\">gender-confirmation surgery options to patients<\/a>, a promise made by department leaders more than two years ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a letter to VA attorneys sent Monday, members of the <a href=\"https:\/\/www.transveteran.org\/\" target=\"_blank\">Transgender American Veterans Association<\/a> and Yale Law School Veterans Legal Services Clinic said the move may be necessary given the <a href=\"https:\/\/www.militarytimes.com\/veterans\/2023\/06\/20\/after-two-years-still-no-timeline-for-transgender-surgeries-at-va\/\" target=\"_blank\">slow pace of work on the issue <\/a>within the department. The groups said they want VA to unveil a formal rulemaking plan detailing <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/06\/17\/transgender-veterans-still-waiting-on-vas-promise-of-surgery-options\/\" target=\"_blank\">when they will begin providing the surgeries<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTransgender veterans have waited far too long for the medically necessary health care they require,\u201d said Rebekka Eshler, president of TAVA, in a statement. \u201cIt is high time that Secretary McDonough follows through on his public promises to the transgender veteran community. Statements are nothing without action.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The National Center for Transgender Equality has estimated that there are more than 134,000 transgender veterans in America today, and another 15,000 transgender individuals serving in the armed forces.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2023\/06\/20\/after-two-years-still-no-timeline-for-transgender-surgeries-at-va\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"230\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/LindsayChurch.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">After two years, still no timeline for transgender surgeries at VA<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The medical procedures have been mired in bureaucratic delays since June 2021.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In the past, VA officials have estimated that as many as 4,000 veterans nationwide would be interested in the procedures, also known as gender reassignment surgeries. The department does offer other support for transgender veterans, but those services have come under criticism from conservative lawmakers in recent months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In July 2021, McDonough announced that the department for the first time would begin offering the surgeries at some department medical centers, part of a larger effort to make VA \u201cmore welcoming\u201d to all veterans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But in the 28 months since the announcement, no formal steps have been taken to move ahead with the medical procedures. <a href=\"https:\/\/www.militarytimes.com\/military-honor\/salute-veterans\/2023\/11\/08\/mcdonough-wants-va-to-reach-every-veteran-in-the-country\/\" target=\"_blank\">In an interview with Military Times earlier this month,<\/a> McDonough acknowledged the delay, saying he was still working through how to proceed on the issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAs the person who called for this and as the person who will be defending the policy when we do it, when I\u2019m ready to move ahead, I\u2019ll do it,\u201d he said. \u201cThis is an important suite of care for vets.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But TAVA officials \u2014 who first publicly called for action on the issue nearly eight years ago \u2014 said the delay unnecessarily endangers the health of transgender veterans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cVA\u2019s failure to provide gender confirmation surgery subjects transgender veterans, including TAVA members, to increased risk of physical harm, psychological distress, and suicide,\u201d the groups wrote. \u201cForcing veterans to seek [surgery options] outside of VA facilities disrupts their continuity of care, resulting in financial, physical and emotional harm.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA officials have not said how much adding the surgeries to its available medical offerings would cost. Advocates said they plan to file legal action against the department in mid-December unless a plan forward is announced.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>VA officials announced
