{"id":106379,"date":"2018-11-21T20:58:58","date_gmt":"2018-11-21T20:58:58","guid":{"rendered":"https:\/\/one.sightlinemg.com\/militarytimes\/uncategorized\/2018\/11\/21\/mattis-explains-new-roles-authorities-at-border\/"},"modified":"2026-08-08T12:10:40","modified_gmt":"2026-08-08T12:10:40","slug":"mattis-explains-new-roles-authorities-at-border","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2018\/11\/21\/mattis-explains-new-roles-authorities-at-border\/","title":{"rendered":"Mattis explains new roles, authorities at border"},"content":{"rendered":"<figure class=\"wp-block-smg-jwplayer-video\"><atype-video-jwplayer nostick=\"true\" playlisturl=\"https:\/\/cdn.jwplayer.com\/v2\/playlists\/fCzRqMW8?tags=a6694772-9ae6-446e-844c-17282d727e34\" poster=\"\/wp-content\/uploads\/2026\/08\/video-poster-a6694772-9ae6-446e-844c-17282d727e34.jpg\" aspectratio=\"16 \/ 9\" mute autostart=\"false\"><\/atype-video-jwplayer><figcaption class=\"wp-element-caption\">Hear Defense Secretary James Mattis tell reporters in a huddle that there has been no call for lethal force at the border.<\/figcaption><\/figure>\n\n\n<p class=\"wp-block-paragraph\">Hours after the White House<a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2018\/11\/21\/white-house-approves-use-of-force-some-law-enforcement-roles-for-border-troops\/\" target=_blank> signed a late Tuesday night directive<\/a> expanding the authorities of U.S. troops at the Mexican border, Defense Secretary Jim Mattis met with reporters at the Pentagon to explain what the new policies mean for the <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2018\/11\/20\/border-deployment-was-a-racially-motivated-stunt-new-hasc-chair-says\/\" target=_blank>domestically deployed forces<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The memo, which was signed by White House Chief of Staff John Kelly, instructs Mattis that all \u201cDepartment of Defense military personnel\u201d may \u201cperform those military protective activities that the Secretary of Defense determines are reasonably necessary to ensure the protection of federal personnel, including a show or use of force (including lethal force, where necessary), crowd control, temporary detention and cursory search. Department of Defense personnel shall not, without further direction from the President, conduct traditional civilian law enforcement activities.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><b>On what\u2019s changed: <\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mattis said Wednesday that while the authorities for U.S. troops along the border have expanded, the <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2018\/11\/02\/here-are-the-rules-of-engagement-for-troops-deploying-to-the-mexican-border\/\" target=\"_blank\">Standing Rules for the Use of Force<\/a> for troops deployed to the border have not changed \u2014 unless he decides they need to.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The memo directs Mattis to decide which authorities border troops may need to carry out their duties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf I change the mission then something like that could happen,\u201d Mattis said. \u201cWe have no intent of doing that right now.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mattis said any use of the new authorities would be shaped by what follow-on requests he gets from Department of Homeland Security Secretary Kirstjen Nielsen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI now have the authority to do more,\u201d Mattis said. \u201cNow we\u2019ll see what [Nielsen] asks me for.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2018\/11\/14\/mattis-troops-to-stop-using-the-term-secure-at-border-locations\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Still-A7-Troops-on-Border.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Mattis: Troops to stop using the term \u2018secure\u2019 at border locations<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The military will have met initial the DHS request within the next week, but forces will remain through the holidays, at least.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\"><b>On use of force: <\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the memo authorizes up to the lethal use of force, Mattis emphasized that the vast majority of forces on the border are not armed and would stay that way. Use of force would be carried out by \u201cunarmed MPs\u201d using shields and batons, he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere is no armed element going in,\u201d Mattis said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are not doing law enforcement. We do not have arrest authority,\u201d Mattis said. \u201cNow the governors could give their [National Guard] troops arrest authority \u2014 I don\u2019t think they\u2019ve done that \u2014 but there is no arrest authority under Posse Comitatus for the U.S. federal troops. Mattis said the use of forces in either role would be minimized to prevent them from crossing that line.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cDetention, I would put it in terms of minutes,&#8221; Mattis said. &#8220;In other words, if someone\u2019s beating on a border patrolman and if we were in position to have to do something about it, we could stop them from beating on them and take them over and deliver them to a border patrolman who would then arrest them for it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere\u2019s no violation of Posse Comitatus,&#8221; Mattis said. &#8220;There\u2019s no violation here, at all. We\u2019re not going to arrest, or anything else. To stop someone from beating on someone and turn them over to someone else \u2014 this is minutes, not even hours, OK?\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link what it means for when troops come home: <\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mattis said some of the troops may be extended past the current Dec. 15 orders deadline.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSome of those troops certainly will be home [by Christmas] but some troops may not be, or some new troops may be assigned to new missions,\u201d Mattis said. \u201cThis is a dynamic situation.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s mission dependent,\u201d he added. \u201cIf they [DHS] say they want additional miles of wire, that
