{"id":108077,"date":"2015-11-09T18:02:56","date_gmt":"2015-11-09T18:02:56","guid":{"rendered":"https:\/\/one.sightlinemg.com\/militarytimes\/uncategorized\/2015\/11\/09\/common-threads-in-ta-actions-against-phoenix-globe\/"},"modified":"2026-08-08T12:21:07","modified_gmt":"2026-08-08T12:21:07","slug":"common-threads-in-ta-actions-against-phoenix-globe","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/militarytimes\/education-transition\/2015\/11\/09\/common-threads-in-ta-actions-against-phoenix-globe\/","title":{"rendered":"Common threads in TA actions against Phoenix, Globe"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The Defense Department is saying very little publicly about its newly aggressive role overseeing the military tuition assistance program, actions that have included a suspension of the University of Phoenix, one of the nation&#8217;s largest TA schools, from enrolling new students under that benefit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But from what information has come out, a couple of trends appear to be surfacing:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>DoD sanctions have been focused on the for-profit education sector, which has been under fire for years from Democrats.<\/li><li>The Pentagon has based its actions largely on other organizations\u2019 ongoing investigations and legal actions, which have yet to be resolved either for or against the schools in question.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">DoD&#8217;s moves, anchored in the latest version of the military education Memorandum of Understanding, or MOU, which schools must sign to participate in TA, have been lauded by longtime for-profit critics and Democrats, panned by for-profit schools and Republicans, and met with mixed reviews from veterans services organizations.<\/p>\n\n\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;In my opinion, until we had these MOUs &#8230; there wasn&#8217;t much oversight on both the DoD or [Department of Veterans Affairs] side on ensuring that veterans were receiving a quality education,&#8221; Ryan Gallucci, deputy veterans services director for Veterans of Foreign Wars, said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Asked whether he thought DoD&#8217;s placement of the University of Phoenix on probation was fair and justified, Gallucci said: &#8220;This is a tough one.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He questioned some aspects of DoD&#8217;s actions and praised others. He also expressed concern about the lack of information the Pentagon has provided service members, veterans and the public.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;I think that transparency in this is always important,&#8221; he said. &#8220;The more information you can put out there, the better decision a service member can make.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pentagon&#8217;s placement of the University of Phoenix on probation Oct. 7 generated shock waves still reverberating loudly in military and higher education. But it was not the first or only time that DoD took such action against a school.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Of the 2,734 schools that a DoD website listed in early November as having participated in the MOU, encompassing some 15,400 campus locations, 12 institutions listed as having 284 locations are designated as being\u00a0on probation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">All are for-profit schools, with the exception of two private nonprofit institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And nine of the schools, including both private nonprofits, also appear to have either closed or merged with another institution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Defense Department will not say when the schools were put on probation or why \u2014 even in the case of the shuttered colleges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;The department does not disclose specific information regarding a pending enforcement action for any particular institution for noncompliance with its MOU with the DoD,&#8221; the Defense Department said in a statement attributed to a voluntary education official.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The three active schools on probation with DoD are the University of Phoenix, Globe University and Minnesota School of Business, the last two of which are sister institutions affiliated with Globe Education Network.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8216;If substantiated&#8217;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While DoD is mum, copies of official communications sent to the schools and obtained by Military Times shed some light on the Defense Department&#8217;s actions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of the University of Phoenix, the Oct. 7 letter cited two MOU violations \u2014 one involving the use of official military seals and trademarks, the other concerning giving notice to the proper military officials before going on bases and installations \u2014 but acknowledged that the school &#8220;has responded to these infractions with appropriate corrective action.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition, the letter, signed by DoD Voluntary Education Chief Dawn Bilodeau, expressed concern that the Federal Trade Commission and California&#8217;s attorney general have opened inquiries into the University of Phoenix.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;The allegations associated with these inquiries, if substantiated, would violate several additional provisions of the University of Phoenix MOU with DoD,&#8221; the letter said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DoD used a similar justification and very similar language in letters to Globe Education Network leadership. In that case, the department cited a lawsuit filed against two of the company&#8217;s schools by Minnesota&#8217;s attorney general.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;If any of the allegations in the complaint against your institution [are] proven, it would represent a serious departure of the conduct required by the voluntary education partnership Memorandum of Understanding,&#8221; according to a November 2014 letter\u00a0announcing probationary status for Globe University and Minnesota School of Business, also signed by Bilodeau.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ken McCarthy, chief financial officer for the schools, said that by punishing the schools for as-yet unproven allegations, DoD is taking away their due process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Any defendant deserves a right to defend themselves,&#8221; McCarthy said. &#8220;You can make serious allegations in a complaint that don&#8217;t necessarily have to be true. &#8230; They need to be litigated.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The school also pointed out that many other institutions are under investigation by various attorneys general, yet DoD has taken no action against them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For its part, the University of Phoenix sent Military Times a statement, attributed to James &#8220;Spider&#8221; Marks, a retired Army major general who works as an executive dean for the school, praising the school&#8217;s students and vowing to answer DoD questions and concerns.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;We hope to have clarity soon on the department&#8217;s process and stand ready to respond to any further concerns from anyone at the Department of Defense,&#8221; the statement said. &#8220;We&#8217;re on the team to try and make it right.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Defense Department declined to answer questions about due process concerns or other criticism of its actions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>For-profit fight<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Asked whether it was focusing on for-profit institutions in particular, DoD&#8217;s statement said that it &#8220;follows standardized procedures&#8221; to review reports of rule violations by schools &#8220;regardless of the status of the particular institution.&#8221; The department did not elaborate on what the standardized procedures are.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Steve Gonzalez, assistant director of the American Legion&#8217;s education department, expressed deep concerns about DoD&#8217;s approach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Do not get me wrong: If an institution&#8217;s been found guilty, throw the book at them,&#8221; Gonzalez said. &#8220;But you have to wait until those outcomes are met.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Like VFW&#8217;s Gallucci, Gonzalez said he thought oversight of military education through the DoD MOU was important, but said he was concerned that rather than applying the rules equally, the department was focusing on particular for-profit institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;We want to make sure that any institution that is found to be negligent &#8230; that they&#8217;re held accountable to the same standards,&#8221; Gonzalez said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Washington, DoD&#8217;s actions have become the latest chapter in a yearslong political fight over for-profit education.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Following the move, Republican and Democratic senators sent dueling letters to Defense Secretary Ash Carter, with the former criticizing the action and the latter praising it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The office of Illinois Democratic Sen. Dick Durbin joined a raft of groups that have long opposed for-profit schools, including Iraq and Afghanistan Veterans of America, in praising the crackdown. Durbin has been a leading opponent of for-profit education, saying the for-profit &#8220;model is flawed and can&#8217;t be sustained.&#8221;<\/p>\n\n\n\n<p>Arizona Republican Sen. John McCain<span class=\"rte rte-comment\">, in whose home state of Arizona the University of Phoenix is headquartered,<\/span> criticized DoD\u2019s actions sharply on the Senate floor.
