{"id":133538,"date":"2026-02-24T16:37:24","date_gmt":"2026-02-24T16:37:24","guid":{"rendered":"https:\/\/one.sightlinemg.com\/militarytimes\/uncategorized\/2026\/02\/24\/insect-shield-to-pay-14m-to-settle-army-uniform-testing-lawsuit\/"},"modified":"2026-08-08T17:30:32","modified_gmt":"2026-08-08T17:30:32","slug":"insect-shield-to-pay-14m-to-settle-army-uniform-testing-lawsuit","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2026\/02\/24\/insect-shield-to-pay-14m-to-settle-army-uniform-testing-lawsuit\/","title":{"rendered":"Insect Shield to pay $1.4M to settle Army uniform testing lawsuit"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A North Carolina-based company providing insect-prevention treatment to Army combat uniforms settled a lawsuit alleging it had manipulated and failed to perform proper testing on garments. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.militarytimes.com\/off-duty\/gearscout\/2015\/10\/25\/insect-shield-clothing-started-as-a-west-point-tick-deterrent\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/off-duty\/gearscout\/2015\/10\/25\/insect-shield-clothing-started-as-a-west-point-tick-deterrent\/\">Insect Shield<\/a> and the estate of its co-founder, Richard Lane, who died in 2022, agreed to pay $1.4 million to resolve the case, the Justice Department <a href=\"https:\/\/www.justice.gov\/opa\/pr\/insect-shield-llc-and-co-founders-estate-agree-pay-14m-settle-allegations-false-claims\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.justice.gov\/opa\/pr\/insect-shield-llc-and-co-founders-estate-agree-pay-14m-settle-allegations-false-claims\">announced<\/a> earlier this month. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the lawsuit, the government claimed that Insect Shield failed to follow the Army\u2019s permethrin testing requirements between 2015 and 2021. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the <a href=\"https:\/\/www.insectshield.com\/pages\/insect-shield-your-clothes\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.insectshield.com\/pages\/insect-shield-your-clothes\">company\u2019s website<\/a>, permethrin is an insect repellent treatment that helps protect against mosquitoes, ticks, ants, flies, chiggers and midges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government alleged that the company inappropriately combined results from different rounds of testing, relabeled test samples to hide the sample\u2019s origin, violated its contract by excessively retesting and concealed failed test results. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Brett A. Shumate, assistant attorney general of the Justice Department\u2019s civil division, described the settlement as part of their effort to \u201caggressively pursue those who defraud the American taxpayers by failing to properly perform required testing on goods supplied to our soldiers.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Christopher Dillard, special agent in charge of the Mid-Atlantic Field Office for the Defense Criminal Investigative Service, added that \u201cmanipulating and failing to perform contractually required testing is not only fraudulent, but compromises military readiness.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, under the settlement agreement, the allegations remain unresolved as the document \u201cis neither an admission of liability by the Estate nor a concession by the United States that its claims are not well founded.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the settlement agreements, Insect Shield will pay $875,000 of the $1.4 million and Lane\u2019s estate will pay $525,000. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agreements come as a result of a complaint-in-intervention the government filed in December 2023. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The original case was brought in 2019 under whistleblower provisions in the False Claims Act, which allow private parties to sue on behalf of the government. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a result, the original plaintiff, Emelia Downs, a former Insect Shield employee, will receive $315,000 as part of the settlement. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the <a href=\"https:\/\/drive.google.com\/file\/d\/1blUsFfXKaZuh-mrug-ievI3OdRhM2_Hj\/view?usp=sharing\" target=\"_blank\" rel=\"\" title=\"https:\/\/drive.google.com\/file\/d\/1blUsFfXKaZuh-mrug-ievI3OdRhM2_Hj\/view?usp=sharing\">complaint-in-intervention<\/a>, the government could only approve and receive Army Combat Uniforms, or ACUs, after \u201cpermethrin verification testing\u201d had been completed. In other words, if testing wasn\u2019t completed, Insect Shield would not get paid. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAccordingly, there was pressure for Insect Shield to expedite the test process,\u201d the lawsuit said. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the requirements, the lawsuit said Insect Shield and its late co-founder Lane were aware of \u201cerratic\u201d test results and even included receiving \u201cfailing [test] results\u201d in an internal workflow diagram, but chose not to disclose this information to the government. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government alleged that Lane and other Insect Shield employees thought the contractual requirements were \u201ctoo rigorous\u201d and \u201ctime-consuming.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In response to the settlement agreement, Insect Shield\u2019s attorney, D.J. O\u2019Brien III, told <a href=\"https:\/\/www.bizjournals.com\/triad\/news\/2026\/02\/06\/insect-shield-us-army-uniforms-whistleblower-case.html\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.bizjournals.com\/triad\/news\/2026\/02\/06\/insect-shield-us-army-uniforms-whistleblower-case.html\">The Triad Business Journal<\/a> that the company has \u201cconsistently disputed the allegations\u201d and is \u201cproud of its decades-long, uninterrupted partnership with the U.S. Army.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company added that it is \u201cpleased that it has resolved the distraction and expense of the lawsuit so that it can focus on \u2026 protecting military personnel and other customers from insect-borne
