{"id":44739,"date":"2022-01-06T21:34:32","date_gmt":"2022-01-06T21:34:32","guid":{"rendered":"https:\/\/one.sightlinemg.com\/militarytimes\/uncategorized\/2022\/01\/06\/panel-hears-dueling-versions-of-deadly-marine-aav-sinking\/"},"modified":"2026-08-08T20:49:57","modified_gmt":"2026-08-08T20:49:57","slug":"panel-hears-dueling-versions-of-deadly-marine-aav-sinking","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2022\/01\/06\/panel-hears-dueling-versions-of-deadly-marine-aav-sinking\/","title":{"rendered":"Panel hears dueling versions of deadly Marine AAV sinking"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">CAMP PENDLETON, California \u2014 A Marine Corps officer takes responsibility for the <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/04\/15\/what-caused-the-marine-amphibious-assault-sinking-tragedy\/\" target=\"_blank\">sinking of an amphibious assault vehicle<\/a> off the Southern California coast that killed nine service members under his command, but <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2022\/01\/04\/marine-officer-faces-discharge-over-deadly-training-mishap\/\" target=\"_blank\">he doesn\u2019t deserve to be discharged<\/a> for any missteps, his attorney told a <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/12\/30\/more-boards-coming-for-marine-leadership-involved-in-deadly-aav-sinking\/\" target=\"_blank\">military panel<\/a> Tuesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Marine Corps attorney countered that <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2020\/10\/13\/commander-of-marine-unit-involved-in-aav-accident-that-killed-9-relieved\/\" target=\"_blank\">Lt. Col. Michael J. Regner<\/a>\u2019s missteps were egregious enough to justify ending his military service six months short of reaching his 20-year mark that would entitle him to full retirement benefits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regner, who spoke to Marine Corps investigators, is expected to address the three-officer panel during a Board of Inquiry hearing that began Tuesday and is expected to last up to four days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe\u2019s never shirked his responsibilities, he owned the fact that he was the commander at the time, he knows that he is responsible for the deficiencies that took place,\u201d said Maj. Cory Carver, Regner\u2019s attorney.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Carver added that while the buck stops with his client, his actions don\u2019t justify discharge.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/marinecorpstimes\/news\/your-marine-corps\/2021\/10\/07\/new-investigation-reveals-more-details-on-fatal-marine-aav-accident\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"158\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/aav-facebook-v2.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">New investigation reveals more details on fatal Marine AAV accident<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">New investigation reveals additional information about the fatal July 2020 amphibious assault vehicle accident.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">A Marine Corps investigation found that inadequate training, shabby maintenance and poor judgment by leaders led to the July 30, 2020, sinking of the AAV in one of the deadliest Marine training accidents in decades.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The AAV had 16 people aboard when it sank rapidly in 385 feet of water <a href=\"https:\/\/www.marinecorpstimes.com\/news\/your-marine-corps\/2021\/03\/31\/its-your-date-of-death-just-finish-this-mission-families-of-fallen-marines-sailor-react-to-investigation-of-tragic-aav-sinking\/\" target=\"_blank\">off the coast of San Clemente Island.<\/a> Seven Marines were rescued as the vessel was returning to a Navy ship on a training exercise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regner was relieved of command of the landing team of the 1st Battalion, 4th Marine Regiment, 15th Marine Expeditionary Unit, shortly after the sinking. A Marine Corps statement at the time said his removal was based on a \u201csubstantial amount of information and data\u201d and cited a loss of trust.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regner relied on other Marines to tell him that all service members were certified to swim, even though some weren\u2019t, said Carver.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regner was told \u201cthey\u2019re stellar, that they\u2019re above average, that they were deployable,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Regner knew of mechanical problems but was told they were fixed, said Carver. The armored vehicles outfitted with machine guns and grenade launchers look like tanks as they roll ashore for beach attacks, with Marines pouring out of them to take up positions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other Marines are expected to face possible discharge. Col. Christopher J. Bronzi, who supervised Regner, was relieved of command of the 15th Marine Expeditionary Unit in 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The panel was expected to review thousands of pages of investigative reports and evidence before turning to courtroom testimony, likely on Thursday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is going to be a difficult decision,\u201d Lt. Col. Michael McDonald said in the military\u2019s opening statement. \u201cThe bottom line is Lt. Col. Ragner\u2019s substandard performance set the conditions for the sinking.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every mission has problems, McDonald said, but Regner ignored red flags that should have led him to decide the crew was unprepared for its assignment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Marine Corps investigation found inadequate training of platoon members who were provided amphibious assault vehicles that had not been used in more than a year and were in \u201cpoor condition.\u201d The platoon made repairs in a rush to meet a deadline, according to the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It took 45 minutes for the AAV to sink and if the distress signal had been seen sooner, it\u2019s likely rescuers could have saved the troops, the report stated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the water levels continued rising, the troops who had only trained on land remained inside the broken-down AAV in seas that were rougher than expected, according to the findings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They were not told to remove their helmets, weapons and other gear, which prevented them from being able to escape. Their life jackets also may have prevented them from removing their body armor and proved useless in keeping them afloat because of the weight, according to the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At least two of the troops had not completed their swimming certifications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The emergency lights did not function, and no markings were put on a side hatch, leaving troops scrambling in the dark, using their cellphone lights to find it, according to the findings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once they did, they struggled to open it, losing time. As they finally pried open the hatch, another assault vehicle came to rescue the crew and ended up colliding with the distressed vessel, which turned broadside into a wave that swept over it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The troops were knocked off their feet, and water flooded through the hatch and into the compartment, causing the vehicle to rapidly sink.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u201cThis is going to be a difficult decision,\u201d Lt.
