{"id":50968,"date":"2018-11-26T18:55:57","date_gmt":"2018-11-26T18:55:57","guid":{"rendered":"https:\/\/one.sightlinemg.com\/militarytimes\/uncategorized\/2018\/11\/26\/sentence-reduced-for-marine-recruiter-who-sent-thousands-of-illicit-messages-to-four-high-school-students\/"},"modified":"2026-08-08T20:44:52","modified_gmt":"2026-08-08T20:44:52","slug":"sentence-reduced-for-marine-recruiter-who-sent-thousands-of-illicit-messages-to-four-high-school-students","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2018\/11\/26\/sentence-reduced-for-marine-recruiter-who-sent-thousands-of-illicit-messages-to-four-high-school-students\/","title":{"rendered":"Sentence reduced for Marine recruiter who sent thousands of explicit messages to four high school students"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A Marine recruiter who originally was sentenced to 12 years in prison for sexual misconduct and sending thousands of illicit sexual messages to four female high school students has had his sentence further reduced to four years&#8217; confinement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/www.jag.navy.mil\/courts\/documents\/archive\/2018\/CHIKAKA-201400251-Further%20Rev%20Nov%202018-UNPUB.pdf\" target=_blank>U.S. Navy-Marine Corps Court of Criminal Appeals<\/a> has ruled that unlawful command influence stemming from testimony provided by Staff Sgt. Nhubu C. Chikaka\u2019s commanding officer and the use of a photograph of then-Commandant of the Marine Corps General James F. Amos affected the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s the latest fallout from controversial remarks made by Amos in 2012 during a series of talks known as the Heritage Briefs that were aimed at reducing sexual assault and rape across the Corps.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At one of the talks, Amos said that nearly 80 percent of sexual assault allegations are legitimate, comments that have since set off a <a href=\"https:\/\/www.marinecorpstimes.com\/2015\/06\/04\/marine-s-sentence-cut-in-half-after-unlawful-influence-reversal\/\" target=_blank>series of appeals and reduced sentences<\/a> for Marines convicted of sex offenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During Chikaka\u2019s trial, a photograph of the commandant with a victim\u2019s great grandfather \u2014 who was receiving the <a href=\"https:\/\/www.marinecorpstimes.com\/veterans\/2018\/07\/05\/ignored-for-decades-wwi-heroines-could-be-recognized-with-congressional-gold-medal\/\" target=_blank>Congressional Gold Medal <\/a>\u2014 was admitted by the military judge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chikaka\u2019s defense alleged that the photograph of Amos was intended to \u201cput the face of the Marine Corps and the Heritage Brief directly in front of the members,\u201d in a document filed with <a href=\"https:\/\/www.armfor.uscourts.gov\/newcaaf\/briefs\/2016Term\/Chikaka160586AppellantReplyBrief.pdf\" target=_blank>The Court of Appeals for the Armed Forces<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chikaka\u2019s case has now appeared before U.S. Navy-Marine Corps Court of Criminal Appeals three times and his sentence has been reduced each time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2014, Chikaka, a recruiter with the Sixth Marine Corps District out of Douglasville, Georigia, was convicted of abusive sexual contact, unwanted sexual contact, adultery and obstruction of justice, among other offenses, and was sentenced to 12 years&#8217; confinement, reduction to E-1 and a dishonorable discharge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to a <a href=\"https:\/\/www.armfor.uscourts.gov\/newcaaf\/briefs\/2016Term\/Chikaka160586AppelleeBrief.pdf\" target=_blank>court filing<\/a>, Chikaka made inappropriate sexual comments to a 17-year-old female he was trying to recruit. He also engaged in unwanted sexual behavior, groped and sent sexual messages to a 19-year-old female recruit in the delayed-entry-program.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the former Marine recruiter had an affair with an 18-year-old recruit, sent her nude pictures of himself and purchased alcohol for her, court documents said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2016, the <a href=\"http:\/\/www.jag.navy.mil\/courts\/documents\/archive\/2016\/CHIKAKA-201400251-UNPUB.pdf\" target=_blank>Navy-Marine Corps Court of Criminal Appeals <\/a>found \u201can unreasonable multiplication of charges\u201d and Chikaka\u2019s sentence was reduced to five years&#8217; confinement, reduction to E-1 and a dishonorable discharge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The recruiter\u2019s defense filed an appeal seeking a retrial in June 2016, to the military\u2019s highest appeals court, the Court of Appeals for the Armed Forces, on the grounds of unlawful command influence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That court remanded the case back to the U.S. Navy-Marine Corps Court of Criminal Appeals to determine if unlawful command influence impacted the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court found that remarks made by Chikaka\u2019s commanding officer during the trial represented the most substantial impact of unlawful command influence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During his testimony, the commanding officer \u201cappealed to members to award a sentence that delivered a message,\u201d court documents said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chikaka\u2019s commanding officer essentially had asked the court for a sentence that would create a deterrent effect for other recruiters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But, \u201cthe government has not convinced us beyond a reasonable doubt that the introduction of the Commandant\u2019s picture did not insert the Commandant into the deliberation room,\u201d the Navy-Marine appeals court said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the Amos photo may have had some unlawful command influence, the court found no evidence that the Heritage Briefs themselves impacted the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe picture was not accompanied by any text or information that could be seen as directing a particular result in the case,\u201d the appeals court said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chikaka\u2019s sentence was reduced to four years\u2019 confinement, reduction to E-1, dishonorable discharge and forfeiture of pay as a result of unlawful command influence.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Former Staff Sgt.
