Trump has decided to restore convicted SEAL Edward Gallagher\u2019s pay grade to chief petty officer, overriding a decision last week by the Navy\u2019s top admiral, both Navy Times and Fox News learned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although naval officials and Navy Times discussed Trump\u2019s looming decision on Sunday, it was announced <a href=\"https:\/\/video.foxnews.com\/v\/6100312270001\/#sp=show-clips\" target=_blank>on the morning Fox and Friends show<\/a> by network contributor Pete Hegseth, who said he spoke directly with the president about intervening in three war crimes cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A week before Veterans Day, Trump\u2019s move clears the way to free Army 1st Lt. Clint Lorance, who was convicted on a pair of murder charges for ordering his platoon to shoot and kill three Afghan men on a motorcycle in 2012 and is serving a 19-year sentence at the U.S. Disciplinary Barracks at Fort Leavenworth.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also is poised to end the prosecution of Green Beret Maj. <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2018\/12\/13\/former-green-beret-major-faces-murder-charge-for-2010-afghanistan-incident\/\" target=_blank>Matthew Golsteyn<\/a>, who is accused of executing a suspected Taliban bomb maker in Helmand Province nine years ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis president recognizes the injustice of it,\u201d Hegseth said during the broadcast. \u201cYou train someone to go fight and kill the enemy. Then they go kill the enemy the way someone doesn\u2019t like, and then we put them in jail or we throw the book at them.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Tuesday, Chief of Naval Operations Adm. Mike Gilday decided to retain the spirit of a military jury\u2019s recommended sentence for Gallagher, 40, letting stand the panel\u2019s call to demote him but keeping him a petty officer first class and not the E-1 pay grade where Navy regulations would\u2019ve automatically left him after more than two decades of service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That same panel of his peers, mostly composed of Marine combat veterans, acquitted Gallagher on a string of war crimes charges during a trial that presented evidence of corruption inside the Navy\u2019s Judge Advocate General\u2019s Corps and the Naval Criminal Investigative Service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher was convicted on the sole charge of posing for a snapshot with a dead detainee. A dozen service members, including a commissioned officer senior to Gallagher, were not indicted or apparently punished for a crime resolved in the past through mild administrative actions.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/10\/29\/cno-wont-let-convicted-seal-retire-as-chief\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GallagherSNIPER.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">CNO won\u2019t let convicted SEAL retire as chief<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">But the decision allows Eddie Gallagher to retire with a military pension worth an estimated $1.5 over the course of his lifetime.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">And it remained unclear if Naval Special Warfare truly had finished with Gallagher, at least administratively.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy Times had been tracking the fate of the highly decorated SEAL on Friday, after he\u2019d been ordered to report to duty at Naval Base Coronado.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rumors swirled throughout the base that senior officers were poised to unleash a series of sanctions on him, including sending him to a Trident Review Board to strip him of the SEAL insignia, whispers also overheard by Gallagher\u2019s defense attorney, Timothy Parlatore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the close of business in California, however, no action had been taken by <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/09\/25\/ig-complaint-pits-trump-decorated-operators-against-rear-admiral-who-fired-a-seal-team-triad\/\" target=_blank>embattled Rear Adm. Colin Green <\/a>and new rumors percolated out of headquarters that senior officials had stepped in to halt the proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe didn\u2019t reach out to the president, but we\u2019re grateful that he\u2019s taking this action,\u201d Parlatore told Navy Times on Monday. \u201cThe idea that even after everything Green did to still go after Eddie\u2019s trident, that\u2019s not the action of a SEAL admiral. That\u2019s the action of a petulant child. It\u2019s a good thing the adults in the room are standing up.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore said he had yet to speak to Gallagher because it was 4 a.m. in California when Hegseth announced the impending intervention by the president.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn 3 \u00bd hours, I have the expectation that Green might still pull Eddie\u2019s trident when he shows up for duty,&#8221; Parlatore told Navy Times by telephone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Late Sunday, Parlatore emailed Green\u2019s staff a scathing letter addressed to the admiral, urging him to abandon \u201cyour fixation on harming Eddie Gallagher and his family.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe has already suffered indignities that vastly outweigh the severity of his alleged offenses. Continued unlawful attacks will serve only to undermines your ability to effectively lead the NSW community,\u201d Parlatore wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pointing to interviews he conducted with a number of SEALs during his defense of Gallagher, Parlatore wrote that he continued to hear a common complaint that Green\u2019s command \u201cuses operators and then casts them away like garbage the moment they no longer satisfy your needs.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/08\/23\/for-seals-its-back-to-regulation-haircuts-and-uniform-inspections\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"166\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/lectern.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">For SEALs, it\u2019s back to regulation haircuts and uniform inspections<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Stung by a string of scandals, on Tuesday Naval Special Warfare commander Rear Adm. Collin Green issued a four-page \u201cback to basics\u201d directive designed to shore up shoddy conduct, restore moral accountability and create better leaders.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In the wake of Gallagher\u2019s acquittal, Green in August issued a four-page \u201c<a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/08\/23\/for-seals-its-back-to-regulation-haircuts-and-uniform-inspections\/\" target=_blank>back to basics<\/a>\u201d directive designed to shore up shoddy conduct, restore moral accountability and create better leaders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Released to senior leaders and then obtained by Navy Times, Green\u2019s guidance sought to return his SEAL and boat teams to standards expected of service members across the fleet, with a mandate for leaders to conduct \u201croutine inspections of your units and strictly enforce all Navy grooming and uniform standards, including adherence to all Navy traditions, customs and ceremonies.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Parlatore\u2019s letter warned Green that mandating haircuts, outlawing unit patches \u201care not the problems\u201d plaguing Naval Special Warfare and instead directed Green\u2019s attention to a high tempo of overseas operations \u201cand a lack of proper support from failed leaders\u201d and \u201cscapegoating\u201d Gallagher will only undermine \u201cgood order and discipline; men are losing respect and confidence in their leadership.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pentagon officials did not respond to requests by Navy Times for comment, except to refer all questions to the White House.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/07\/31\/trump-nixes-nams-for-4-prosecutors-tied-to-seal-case\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"152\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Trump-Gard2.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Trump nixes NAMs for 4 prosecutors tied to SEAL case<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">It&#039;s not the first time a tweeting Trump has interjected himself into the case.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Fox\u2019s announcement of Trump\u2019s impending action isn\u2019t the first time he\u2019s intervened in Gallagher\u2019s case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On March 30, the president took to Twitter to announce that he ordered the Pentagon to release Gallagher from pretrial confinement in San Diego\u2019s Naval Consolidated Brig Miramar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn honor of his past service to our Country, Navy Seal <a href=\"https:\/\/twitter.com\/hashtag\/EddieGallagher?src=hash\"><del>#<\/del><b>EddieGallagher<\/b><\/a> will soon be moved to less restrictive confinement while he awaits his day in court,&#8221; Trump tweeted. \u201cProcess should move quickly!\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And it did, with Navy officials immediately moving to spring Gallagher from the brig.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A day after the verdict in Gallagher\u2019s court-martial case, Trump also <a href=\"https:\/\/twitter.com\/realdonaldtrump\/status\/1146430380981067777?lang=en\">tweeted congratulations<\/a> to the SEAL, his wife Andrea, and his entire family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYou have been through much together. Glad I could help!\u201d the president wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the president still wasn\u2019t done with a case plagued by allegations of prosecutorial and police misconduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before Gallagher\u2019s trial kicked off, Navy judge Capt. Aaron Rugh sanctioned prosecutors for violating the SEAL\u2019s constitutional rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Part of his punishment included booting Cmdr. Christopher Czaplak, the lead prosecutor, for <a href=\"https:\/\/www.navytimes.com\/news\/2019\/06\/04\/lead-navy-prosecutor-in-seal-war-crime-case-out-over-email-spying\/\">a warrantless surveillance program<\/a> cooked up with NCIS agents <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/05\/13\/defense-attorneys-for-navy-seal-accused-of-war-crimes-say-prosecutors-spied-on-them\/\">to track emails sent by defense attorneys and Navy Times.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Agents and prosecutors also were accused of manipulating witness statements to NCIS agents; using immunity grants and a bogus \u201ctarget letter\u201d in a crude attempt to keep pro-Gallagher witnesses from testifying; illegally leaking documents to the media to taint the military jury pool; and then trying to cover it all up when they got caught.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the Navy bestowed achievement medals on several prosecutors and their enlisted aides, Trump stepped in on July 31 <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/07\/31\/trump-nixes-nams-for-4-prosecutors-tied-to-seal-case\/\" target=_blank>to nix the decorations<\/a>, lampooning them as
