{"id":14816,"date":"2019-04-23T21:25:48","date_gmt":"2019-04-23T21:25:48","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2019\/04\/23\/did-a-navy-command-retaliate-against-this-junior-sailor-for-reporting-misconduct\/"},"modified":"2026-08-08T18:55:07","modified_gmt":"2026-08-08T18:55:07","slug":"did-a-navy-command-retaliate-against-this-junior-sailor-for-reporting-misconduct","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/04\/23\/did-a-navy-command-retaliate-against-this-junior-sailor-for-reporting-misconduct\/","title":{"rendered":"Did a Navy command retaliate against this junior sailor for reporting misconduct?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">When Yeoman 3rd Class Maegan Bayless accused superiors of drunkenness and opioid use in a Wichita recruiting office last year, she never expected it would trigger charges or efforts by her command to kick her off active duty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the 22-year-old reservist\u2019s superiors tried to do just that, according to records obtained by Navy Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, the Navy Recruiting Command\u2019s Inspector General is investigating how <a href=\"http:\/\/www.cnrc.navy.mil\/pages-nrd\/stlouis\/default.html\" target=_blank>Navy Recruiting District St. Louis\u2019s<\/a> leadership treated the junior sailor, whether she faced reprisal from her CO and pressure from her command master chief to recant her allegations in order to protect the chiefs mess.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, Big Navy is walking back the disciplinary actions that Bayless\u2019 command attempted to take against her.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPetty Officer Bayless did the right thing by reporting misconduct by her shipmates,\u201d Navy Recruiting Command spokeswoman Lt. Cmdr. Jessica McNulty said in an email.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reversal came after Navy Times started asking questions about the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cShe is not facing reprisal for reporting,&#8221; McNulty said. &#8220;The Navy Recruiting Command has recommended no actions be taken against her and that she remain on recruiting duty as a Canvasser Recruiter in the Wichita, Kansas, recruiting station.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bayless\u2019 woes began in November, when she filed a statement accusing her chief, a petty officer first class and a petty officer second class of drinking on the job and swapping opioid pills in the office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In her statement and during the subsequent investigation, Bayless admitted to drinking a beer in uniform at lunch with those enlisted superiors about a week after reporting to Naval Recruiting Station Wichita-West last August.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI was told by my Chief that having \u2018liquid lunches\u2019 or drinking beer at lunch was a regular occurrence and that it didn\u2019t bother him,\u201d she wrote in her complaint. \u201cSo I drank a beer in uniform with the other recruiters at lunch.\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"960\" height=\"720\" src=\"\/wp-content\/uploads\/2026\/08\/bayless-3.JPG.jpg\" alt=\"\" class=\"wp-image-33137\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/bayless-3.JPG.jpg 960w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/bayless-3.JPG.jpg?resize=300,225 300w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/bayless-3.JPG.jpg?resize=768,576 768w\" sizes=\"auto, (max-width: 960px) 100vw, 960px\" \/><figcaption class=\"wp-element-caption\">Yeoman 3rd Class Maegan Bayless, shown here at a recruiting event, is accusing Naval Recruiting District St. Louis of reprisal against her after she reported drug and alcohol abuse among her enlisted superiors last year. (Photo courtesy Maegan Bayless)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">A few weeks after filing her complaint, Bayless alleged in another statement that the district\u2019s enlisted leader, <a href=\"http:\/\/www.cnrc.navy.mil\/pages-nrd\/stlouis\/loucmc.html\" target=_blank>Command Master Chief Latricia Robinson<\/a>, pressured her to recant her allegations, and she refused.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Robinson referred all questions to Navy Recruiting Command.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the investigation was completed in February, her bosses at Navy Recruiting District St. Louis opted to use that self admission to try and first take her to captain\u2019s mast and then separate Bayless, according to records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cmdr. Nathan Rockholm, the St. Louis district CO who signed off on the moves, recently handed over the district\u2019s reins in a scheduled change of command and did not respond to a request for comment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bayless told Navy Times she felt she faced reprisals for speaking up about the wrongdoing of her enlisted leaders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI am the most junior sailor at the command and I made allegations against a chief petty officer,\u201d she wrote in a February complaint to the Inspector General. \u201cI feel as though the command master chief and the chief recruiter wanted to protect the chief that I made allegations against. I also believe that they did not want these allegations to reflect negatively on the command itself.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the Navy proclaiming her job secure, Bayless said her command has since pressured her to submit an email asking to be removed from active duty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such documentation would show she volunteered for the separation she\u2019s been fighting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey want to be able to say, \u2018She signed it. She wants to leave,\u2019\u201d Bayless said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite McNulty reiterating that no actions will be taken against Bayless, the yeoman said Tuesday that she was routing paperwork to leave active duty due to pressure from her command to do so.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis isn\u2019t getting any better,\u201d she said of her situation at the recruiting station.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bayless said she contacted Navy Times to tell her story because she feels that what happened was wrong and that she was just \u201ctrying to do the right thing.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf we are living by honor, courage, commitment, then I owe it to myself and the Navy to enforce the standard as a third class,\u201d she said. \u201cIt\u2019s all across the board, from junior enlisted to senior enlisted.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><b>\u201cSpecific items of concern\u201d<\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bayless said she knows it was wrong to have had a beer in uniform at lunch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She said she didn\u2019t feel right about it afterwards, consulted the regs and told her chief and first class she would not do it again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After that, she became the \u201csober cab\u201d the next time they all went out for lunch, Bayless wrote in her statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI knew I was being used in a sense because I was young and they knew I wanted to be a part of that group,\u201d Bayless told Navy Times. \u201cIt\u2019s important that I get in good because that\u2019s how recruiting is. John W. House was fired as head of Navy Recruiting District Michigan in January.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Bayless\u2019 non-judicial punishment notification from February cites the command investigation into her allegations as the reason for the action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As is her legal right, Bayless refused Rockholm\u2019s NJP, opting instead for trial by court-martial. (Photo courtesy Maegan Bayless)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The command investigation did not substantiate most of Bayless\u2019 allegations against the enlisted leaders, but it also did not rule them out, according to a copy of the report obtained by Navy Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Investigating officer Lt. Michael Dungan\u2019s probe raised questions about drug and alcohol abuse in the unit, a communal dysfunction the lead investigator thought might be fostered by the grinding pressures of recruiting an all-volunteer force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bayless said she was troubled by what she witnessed but at a loss for how to handle it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI didn\u2019t know what to do with the information,\u201d she told Navy Times. \u201cI didn\u2019t know who to call.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dungan wrote that he \u201cbelieves the assigned personnel at NRS Wichita West were engaging in the consumption of alcoholic beverages during the \u2018normal\u2019 workday.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBut as previously stated, without sufficient documentation or evidence\u2026it is extremely difficult to hold them accountable based on current stated policy,\u201d he wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dungan\u2019s probe also raised questions about whether \u201cthe increased intake of alcoholic beverages\u201d was a sign of a systemic \u201ccoping mechanism for the stress of recruiting duty.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the investigation, a petty officer first class contacted Dungan \u201cto provide a larger degree of credibility to YN3 Bayless (sic) accusations,&#8221; according to the investigation report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That petty officer reported seeing the chief and first class drinking while out at lunch \u201con a regular basis,\u201d and that he saw them \u201cabuse prescription medications\u201d when he was still with Navy Recruiting Station Wichita-West, according to the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the sailor also noted that he could not definitively say whether the drugs were being used in their intended manner and declined to submit a written statement, according to the report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investigating officer also warned of \u201cspecific items of concern noted during the investigation that may be reflective of stress induced self-destructive behaviors\u201d and \u201cborderline misconduct.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report noted that a close relative \u201cknown to have chronic conditions\u201d requiring \u201cmajor surgery\u201d might have supplied the petty officer first class with the pills, circumstances that \u201cmake it very plausible that YN3 Bayless\u2019s (sic) statement is accurate and credible.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the end, Dungan only substantiated one drug-related allegation involving the first class, who admitted to taking a hydrocodone pill because he suffered from chronic pain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That first class also stated his doctor would no longer prescribe him opioids, according to the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dungan wrote there was a \u201chigh probability\u201d that the first class \u201cwas suffering from a substance dependency with medication and alcohol to cope with his personal stress coupled with operational stress\u201d and that he was seeking help at the nearby McConnell Air Force Base.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a next generation of sailors.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The investigation failed to reach a conclusion about the allegations lodged by Bayless that CMC Robinson pressured her to recant during a meeting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThere may have been an appearance of an effort (either deliberate or unintentional) to question the validity of YN3 Bayless\u2019 initial allegations or to persuade her she did not witness the alleged abuse of prescription medications,\u201d Dungan wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dungan noted that Bayless felt \u201cbeing in a confined space\u201d with Robinson and another master chief was intimidating.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He recommended that the yeoman\u2019s lower echelon chain of command communicate with her going forward.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A petty
