{"id":18034,"date":"2021-11-15T23:43:28","date_gmt":"2021-11-15T23:43:28","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2021\/11\/15\/preliminary-hearing-delayed-for-sailor-charged-with-starting-uss-bonhomme-richard-fire\/"},"modified":"2026-08-08T19:00:08","modified_gmt":"2026-08-08T19:00:08","slug":"preliminary-hearing-delayed-for-sailor-charged-with-starting-uss-bonhomme-richard-fire","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2021\/11\/15\/preliminary-hearing-delayed-for-sailor-charged-with-starting-uss-bonhomme-richard-fire\/","title":{"rendered":"Preliminary hearing delayed for sailor charged with starting USS Bonhomme Richard fire"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A hearing to help determine whether a junior sailor will go to court-martial for allegedly setting fire to the amphibious assault ship <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2021\/08\/04\/sailor-accused-of-starting-uss-bonhomme-richard-fire-identified-in-warrant\/\" target=\"_blank\">Bonhomme Richard<\/a>, scheduled for this week, has been pushed back to December, Navy officials confirmed Monday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This summer, the Navy preferred arson and a hazarding a vessel charges against <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2021\/08\/04\/sailor-accused-of-starting-uss-bonhomme-richard-fire-identified-in-warrant\/\" target=\"_blank\">Seaman Apprentice Ryan Sawyer Mays<\/a> for starting the July 12, 2020, fire that eventually destroyed the ship as it underwent maintenance in San Diego.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Article 32 hearing, originally slated for Wednesday, would have involved an officer reviewing evidence against the junior sailor and then making a recommendation to the head of U.S. 3rd Fleet on whether charges should be referred to court-martial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But command spokesman Cmdr. Sean Robertson told Navy Times that Mays\u2019 defense team requested that the hearing be pushed back to the week of Dec. 13.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">May\u2019s lead civilian defense attorney, Gary Barthel, did not respond to requests for comment by Navy Times\u2019 deadline Monday, but said in August that Mays \u201calways maintained his innocence and denies any wrongdoing with regard to the fire aboard the Bonhomme Richard.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2021\/08\/04\/sailor-accused-of-starting-uss-bonhomme-richard-fire-identified-in-warrant\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"168\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/sawyer-mays-new.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Sailor accused of starting USS Bonhomme Richard fire identified in warrant<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Seaman Apprentice Ryan Sawyer Mays told investigators he was &quot;setup,&quot; according to an affidavit.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Despite the high-profile nature of the charges against Mays, whose identity was initially disclosed in a federal search warrant affidavit in August, 3rd Fleet has declined to publicly release a copy of Mays\u2019 charge sheet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such charge sheets are considered public records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In declining to release Mays\u2019 charge sheet, Robertson referred Navy Times to the sea service\u2019s <a href=\"https:\/\/www.jag.navy.mil\/library\/instructions\/JAGINST_5800.7G.pdf\" target=\"_blank\">Manual of the Judge Advocate General<\/a>, or JAGMAN. But the section of the manual cited by Robertson, <a href=\"https:\/\/www.jag.navy.mil\/library\/instructions\/JAGINST_5800.7G.pdf\" target=\"_blank\">0142<\/a>, makes no mention of why a charge sheet would not be releasable in such a high-profile case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy\u2019s refusal to make Mays\u2019 charge sheet public is a failure of \u201cbasic transparency,\u201d according to Eugene R. Fidell, a military law expert who teaches military justice at New York University\u2019s School of Law. In 2019, Fidell served on a panel for the Navy\u2019s comprehensive review of its legal system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The service\u2019s refusal to release such a public document is confounding, he said, especially given the fact that Article 32 hearings are open to the public.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt makes no sense,\u201d he said. \u201cIt\u2019s \u2026 a self-inflicted wound, in terms of public confidence in the administration of justice in the Navy.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the Navy has charged Mays with starting the Bonhomme Richard fire, an investigation released last month revealed that systemic failures at multiple levels allowed the amphib to burn for nearly five days.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2021\/10\/19\/uss-bonhomme-richard-fire-spread-wildly-due-to-repeated-failures-investigation-finds\/\" class=\"smg-interstitial-link__excerpt\">While the Navy has charged a junior sailor with starting the fire last summer, a command investigation lays blame for the botched response at all levels of command.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Big Navy later decided that it would cost too much to repair the devastated flattop, and the ship was sold for scrap earlier this year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The amphib was commissioned in 1998 and cost $1.2 billion in 2020 dollars.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was in the midst of a $250 million upgrade when the fire started, and the Navy paid several millions of dollars more to send it to the scrapyard, an ignominious end that began this spring.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dozens of Navy officials, including several admirals, are facing disciplinary action for failures to stop the inferno.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s a major case, and a case of great interest not only within the Navy but also of enormous interest to anyone concerned about
